사회복지사 등의 처우 및 지위 향상에 관한조례의 역할에 관한 연구 -경기도를 중심으로- (A Study on the Role of Municipal Ordinances for Improving the Treatment and Status of Social Workers -Based on the Gyeonggi-do Provincial-)

초록

본 연구는 경기도 본청과 경기도 기초지방자치단체를 중심으로 사회복지사 등의 처우 및지위향상에 관한 조례 내용을 분석하여 법령과 조례의 역할이 어떻게 구분되어 나타나고 있는지, 지방자치단체 간 조례내용은 어떤 차이가 있는지, 조례에 나타난 사회복지사 등의 처우개선과 관련한 수익적 조치 내용들은 무엇인지를 분석하는데 목적이 있다. 이를 통하여 지방자치단체의 조례에서 사회복지사 등의 처우가 개선될 수 있는 유익한 수익적 조치가 포함 될수 있도록 그 방안을 제시하고자 한다.
연구 결과는 다음과 같다.
첫째, 조례에서는 어느 정도 법령의 내용을 확대시키거나 구체화 하는 역할을 하고 있고, 자체적으로 수익적 조치 관련 내용을 제정하고 있었다. 하지만 규정형태는 낮은 수준이었다.
둘째, 사회복지사 등에 대한 수익적 조치 내용으로는 처우개선과 관련하여 인권 및 권리옹호, 각종 수당지원, 건강검진지원, 연수지원 등이 있다. 신분보장과 관련해서는 본인 의사에반한 부당한 면직금지, 운영주체가 변경되어도 고용보장이 이루어지게 하였다. 신변위협 느끼지 않도록 안정적 직무환경조성과 관련하여서는 신변보호 장비구입, 각종 사고에 대한 상해보험 가입, 인권침해 예방과 인권 옹호, 업무방해금지 등이 있다. 또한 공공시설 사용료 감면 등편의제공과 포상 등을 들 수 있다.
셋째, 지방자치단체의 조례들은 대부분 타 지방자치단체의 조례를 모방하여 거의 비슷한 수준으로 제정되어 있다는 점에서 한계가 드러났다.
조례의 개선방안을 제시하면 다음과 같다.
첫째, 조례에서는 세부적인 처우개선사업을 위해 국가나 상위인 지방자치단체가 제시한 내용은 물론이고, 그 이상의 각 지방자치단체별 특성을 반영한 자주적 사업들을 규정할 필요가있다.
둘째, 조례에서는 사회복지사 등의 신분보장을 강화하기 위해 신분보장 영역의 확대와 신분보장에 대한 책임을 지방자치단체장이 지도록 규정할 필요가 있다.
셋째, 조례에서는 사회복지사 등이 안정적으로 그 직을 수행할 수 있도록 구체적인 신변안전보호서비스지원이 마련되어야 한다.

영어초록

This study aims to analyze municipal ordinances on improving the treatment and status of social workers based on the Gyeonggi-do Provincial Government Office and municipal offices. It aims to examine how the role of laws and municipal ordinances are divided, how municipal ordinances are different across different municipal offices, and what remuneration measures to improve the treatment of social workers are included in municipal ordinances. By doing so, this study intends to provide suggestions so that remuneration measures that would benefit social workers can be included in municipal ordinances.
The following are this study’s results: First, municipal ordinances played a role in expanding or specifying laws to some extent and provided their own remuneration measures. The level of such measures, however, was low.
Second, remuneration measures and treatment improvements for social workers included human rights and the protection of rights, various benefits, medical check-ups, and training. With regard to ensuring job security, the measures banned unfair layoffs against one’s will and guaranteed job security even if the operator changed. With respect to establishing a stable work environment so that workers would not feel threatened or fear for their safety, the measures included the purchase of personal protection equipment, the provision of accident insurance for various types of accidents, the prevention of human rights violations and the protection of human rights, and a ban on the obstruction of work. In addition, there were other conveniences and rewards such as discounted fees for public facilities.
Third, there were limitations with respect to municipal ordinances as they were mostly copied from one another and enacted on a similar level.
This study presents the following suggestions to improve municipal ordinances: First, municipal ordinances need to state not only what is set forth in specific projects to improve social workers’ treatment by the central government or higher-level local government offices, but also the independent projects that reflect the characteristics of each municipal office.
Second, municipal ordinances need to hold heads of municipal offices responsible for expanding the scope of job security as well as ensuring job security to reinforce the job security of social workers and others.
Third, municipal ordinances should provide specific personal safety protection services so that social workers can perform their duties safely.
