초록

이 논문은 디지털 뉴딜 등 다양한 법정책은 인공지능과 빅데이터 기술 등 4차산업혁명기술의 발전에 따라 규범의 배경이 되는 생태계가 변화되어 이에 대한 올바른 법정책적 방향을 찾아가기 위한 노력을 위하여 연구되었다. 특히 인공지능 등을 적극적으로 활용하는 디지털 전환의 시대가 행정작용 환경에 가져온 변화를 조명하며, 이로 인한 행정의 이념, 이론, 실제 작용의 변화와 효과, 그리고 향후 방향성에 대해 탐구한다. 머리말에서는 연구의 배경과 목적을 소개하고, 디지털 뉴딜 등 법정책과 디지털 전환의 개념을 정의하며, 디지털변환, 디지털화, 디지털전환의 단계를 구분하여 연구의 기둥들을 세우기로 한다.
첫번째로는 디지털혁명이 가져온 현대행정서비스의 변화와 입법체계를 분석한다. 디지털 플랫폼 정부 구현의 법적 기반과 국민의 권리보장을 논의하며, 민간부문과 공공부문의 변화, 네트워크의 초연결 사회 도래, 플랫폼 출현과 다양한 이해관계자의 참여 가능성 증대에 주목한다.
두번째로는 정부 형태와 구조의 변화를 다룬다. 디지로그 정부, 전자정부, 디지털 플랫폼 정부로의 발전과 공사협동의 강화를 통한 정부 강화의 한계와 민간 전문성 활용, 신시장활성화 등을 분석한다.
세번째로는 디지털 전환 시대의 규제를 비롯한 행정작용 변화를 통해 추구하는 이념과 이론을 고찰하여, 종합적이고 융합적인 관점의 교환을 실시하여 정책적 시사점을 도출하고자 한다. 실용주의, 자연법주의, 실증주의, 공리주의, 대화이론, 법경제학, 게임이론, 정의론과 디지털 디바이드, 지속가능한 개발 및 환경보호 등 다양한 관점에서 디지털 전환의 법철학적 관점에서의 정책적 시사점들을 논의하고 평가한다.
네번째로는 디지털 전환 시대가 가져온 행정작용의 법제도의 변화에 대해 논한다. 알고리즘에 의한 주체와 기준의 변화, 규제작용의 변화, 행정절차와 구제 방식의 혁신을 포함하여 디지털 기술이 행정에 미치는 긍정적 및 부정적 영향을 상세히 설명하면서, 디지털 전환 시대의 규제가 나아갈 방향과 입법론을 담아보기로 한다. 이를 통해 본 논문은 인공지능 등 4차산업혁명기술을 활용한 디지털 뉴딜의 발전과 행정작용 등 규제 사이의 연계에 대한 통찰을 제공하여 각 국가의 상황과 여건에 적합한 전략과 정책을 개발하는 데 기여하고자 한다.

영어초록

This paper investigates the evolving ecosystem underpinning norms and policies in response to the advancement of Fourth Industrial Revolution technologies, such as artificial intelligence (AI) and big data. It aims to explore appropriate legal and policy directions for the development of the Digital New Deal. Specifically, the research focuses on the transformative impact of the digital era—marked by the active utilization of AI—on administrative operations. It examines changes in the ideals, theories, practices, and effectiveness of administrative functions, and projects future directions.
In the introduction, the background and objectives of the study are presented, along with definitions of key concepts, such as the Digital New Deal and digital transformation. A distinction is made between the stages of digitization, digitalization, and digital transformation to establish the conceptual pillars of the research.
The first section analyzes the changes brought about by the digital revolution in modern administrative services and the legislative system. It discusses the legal foundations for implementing digital platform governments, the safeguarding of citizens’ rights, and the implications of a hyper-connected society. Attention is given to the emergence of platforms, the increasing involvement of diverse stakeholders, and the evolving roles of the private and public sectors.
The second section examines the transformations in government structure and function. It analyzes the evolution from electronic governments to digital platform governments, the strengthening of public-private collaboration, the limitations of government roles, the utilization of private expertise, and the activation of new markets.
The third section explores the ideals and theories pursued in the era of digital transformation. From various perspectives—pragmatism, natural law, positivism, utilitarianism, discourse theory, law and economics, game theory, theories of justice, digital divides, sustainable development, and environmental protection—the study evaluates policy implications from a jurisprudential standpoint.
The fourth section delves into the legal and institutional changes in administrative operations caused by digital transformation. It addresses shifts in regulatory subjects and standards driven by algorithms, changes in regulatory functions, and innovations in administrative procedures and remedies. By analyzing the positive and negative effects of digital technologies on administration, this section outlines future regulatory directions and legislative approaches in the digital era.
By contributing to international academic discussions, this study seeks to provide insights into the nexus between digital transformation and administrative evolution. It aspires to aid in the development of strategies and policies tailored to the conditions and needs of individual nations.
