초록

현행 위험물안전관리법은 위험물 제조소등의 안전관리에 대한 전반적인 사항을 규정하고 있다. 그럼에도 불구하고 위험물안전관리법은 현실과의 괴리 여부가 지적되고 있는바 그 내용은 다음과 같다.
첫째, 현행 위험물의 안전 관련 법상 위험물의 안전관리를 규정이 여러 법률에서 각각 분산되어 규정되어 있어서 위험물의 안전관리에 대한 법률의 명확한 개념의 규정이 어렵고 일관성있는 법의 해석과 적용이 어렵다는 것이다. 둘째, 현실적으로 위험물 관련 법체계가 엄격하게 규정되어 있음에도 불구하고 무허가 위험물 제조소등의 위법행위가 지적되고 있다. 셋째, 위험물 제조소등의 관리가 소홀하다는 것이다. 최근 5년간 위험물 제조소등의 안전관리가 소홀하여 안전사고의 발생율도 증가하고 있다는 것이다. 넷째, 위험물 제조소등의 안전관리에 대한 행정상 관리・감독이 중요한데 현행 법체계상 대부분 재량행위로 되어 있고 법적 규정도 대부분 불확정개념으로 되어 있어서 위험물 시설에 대한 실효성확보가 어려운 실정이다. 다섯째, 위법한 위험물 제조소등에 대하여는 엄격한 제재로서 실효성 확보가 중요하다. 그럼에도 불구하고 현실적으로 위법한 위험물 제조소등에 대한 제재가 미미한 실정이다.
이상 위험물 제조소등에 대한 법적 문제점에 대하여는 다음과 같은 개선사항이 요구된다.
첫째, 위험물 관련 법령에 대한 규정이 일목요연하게 체계적으로 규정될 필요가 있다. 즉 위험물 관련된 법규정을 통합적으로 규정함으로써 보다 더 쉽고 용이하게 위험물 법규의 해석과 적용이 되도록 해야 하며 위험물 관련 콘트롤타워를 형성하여 위험물 안전관리의 효율성을 기할 필요가 있다. 둘째, 위험물 제조소등의 안전요건을 엄격하게 법률로 규정하여 이러한 요건에 합치하는 위험물 제조소등만을 허가하고 운영함으로써 위험물 제조소등의 위험의 사전예방을 실현하고 위험에 대한 신속한 대응조치 등 사후관리 또한 필요하다.
셋째, 위험물 제조소등의 안전관리를 위하여는 법적 요건들이 구비되어야 한다.
위험물 제조소등의 구조와 위치, 그리고 배관시설과 그 부속시설 등이 완비되어야 하고 그 밖에 위험물 제조소등에 대한 기술능력・시설 및 장비 등으로 사전점검으로 항상 안전성능을 충분하게 갖추어야 한다.
넷째, 위험물 제조소등의 안전관리를 위하여는 행정상 엄격한 관리・감독이 필요하다. 즉 관리・감독상 재량행위보다는 기속행위를 규정하고 불확정개념보다는 가능한 구체적인 개념의 관리・감독을 규정이 필요가 있다.
다섯째, 위법한 위험물 제조소등에 대하여는 엄격한 제재로서 실효성 확보가 필요하다. 위험물안전관리법 위반에 대하여는 공공의 안전차원에서 엄격한 제재가 필요하다.

영어초록

Hazardous substances are extremely dangerous goods that have characteristics such as flammability or ignition, so their safe control is very important. So the current Act on the Safety Control of Hazardous plants etc (hereafter the “Act”) stipulates the general matters on safety control of hazardous plants etc.
However, people have pointed out that we are neglectful on handling (control) of hazardous plants etc in reality and especially due to the enormous property damages in the fire incident at Goyang oil reservoir in October 2018, there has been more emphasis on safety control of dangerous plants etc.
Particularly, people point out the gap between the current Act and reality and the following is a summary of the comments; First, people point out that it is difficult to have a clear definition on the Act and to interpret and apply the Act consistently due to the fact that each provision on safety control of hazardous plants etc are distributed and stipulated in a variety of laws under the Act.
Second, despite the fact that the hazardous plants etc related legal system is rigorously defined, illegal acts such as those of non-licensed hazardous plants etc producers have been noted.
Third, there is a lack of control at hazardous plants etc producers. People point out that in the last five years, there has been insufficient safety control at hazardous plants etc producers, thereby increasing the incident rate of safety accidents.
Fourth, in administrative issues on safety control of hazardous plants etc, control and supervision are important, but under the current legal system, most of them are defined as discretional activities and even the legal provisions are mostly uncertain definitions, so it is difficult to secure their effectiveness on hazardous plants etc.
Fifth, we need to secure effectiveness on illegal hazardous plants etc producers with stringent sanctions. However in reality, there have been limited sanctions on illegal hazardous plants etc producers producers.
For the abovementioned legal problems on hazardous plants etc, we need the following improvements; First, the provisions on plants etc related laws need to be defined clearly and systematically. In other words, the laws and regulations on plants etc must be defined integrated so that interpretation and application on laws and regulation on hazardous plants etc can be done more easily and we need to form a hazardous plants etc relevant command center to seek for effectiveness of hazardous plants etc safety control.
Secondly, safety requirements of a hazardous plants etc must be strictly defined by law and only allow and operate hazardous plants etc that satisfy such requirements so that we can realize proactive prevention on hazardous plants etc and also, we need follow-up control such as rapid response measures.
Third, we need legal requirements for safety control of hazardous plants etc. They must be complete with structures and locations, and then piping facilities and their auxiliary facilities and additionally, they must be sufficiently equipped with safety performance with technical competency, facilities and equipment along with pre-inspections.
Fourth, we need administrative stringent control and supervision for safety control of hazardous plants etc. In other words, rather than discretionary activities in control and supervision, we need legally binding activities, and rather than uncertain definitions, we need to stipulate possible control and supervision with concrete concepts.
Fifth, we need to secure legal effectiveness on illegal hazardous plants etc with stringent sanctions. We need stringent sanctions on violations of the Act on the public safety level.
