집회 및 시위에 관한 법률상 확성기 등 일시보관 조치의 법적 성격에 대한 고찰 (A Study on the legal character of Temporary Storage Action of Loudspeaker in the Act on Assembly and Demonstration)

초록

「행정기본법」의 제정과 행정상 강제 조항의 시행에 따라, 개별법에 산재된 행정상 강제의 근거 조문은 일반법과의 적용관계를 명확히 하기 위한 정비가 요구되고, 이에 따라 「집회및시위에관한법률」상 확성기 등 일시보관 조치가 직접강제와 즉시강제 중 어느 것에 해당하는지 해석해 낼 필요가 있다. 먼저 ‘행정상 의무의 불이행’을 기준으로 직접강제와 즉시강제를 구별하는 경우, 일시보관 조치는 법정 기준을 위반하는 소음을 발생시키지 않을 의무를 위반하는 경우를 요건으로 하고 있어 일견 그 법적 성격을 직접강제로 해석할 만하다. 그러나 일반적 금지조항에 따른 의무 불이행을 행정상 강제의 구별 기준으로 하는 경우 범주가 지나치게 확장되어 기준으로서의 역할을 하기 어려운 점, 선행의 행정행위가 없는 경우 대상자의 예측가능성이 낮다는 점 등을 고려할 때, 직접강제와 즉시강제의 형식상 구별의 징표를 ‘의무를 부과하는 선행의 행정행위의 존부’에서 찾는 견해가 타당하다. 그렇다면 확성기 등 일시보관 조치는 현행법 체계상 선행의 행정행위 없이 집행될 수 있는 점, 집회·시위의 종료와 함께 행정행위의 실익이 없게 되는 점, 과도한 집회 소음은 사람의 신체에 위해를 끼치거나 재산에 중대한 손해를 끼칠 우려가 있는 점을 종합할 때, 구체적 의무를 부과하는 선행의 행정행위를 할 여유가 없는 경우로서 현재의 급박한 행정상의 장해를 제거하기 위한 즉시강제에 해당하는 것으로 해석함이 상당하다

영어초록

In accordance with the enactment of the General Act On Public Administration and the enforcement of Administrative Compulsion provisions, it is necessary to reorganize the provisions on the basis of Administrative Compulsion scattered in individual lawsto clarify the application relationship with general laws. Accordingly, it is necessary to explain whether the legal character of the temporary storage action of loudspeakers under the Act on Assembly and Demonstration is direct compulsion or immediate compulsion. Some argue that direct compulsion and immediate compulsion should be distinguishedbased on 'non-fulfillment of administrative obligations'. On this premise, they insist that the legal character of temporary storage action of loudspeaker is directcompulsion. However, It is reasonable to find a sign of distinction in the form of direct compulsion and immediate compulsion in “the existence or absence of the preceding administrative act that imposes obligations”. Because if non-fulfillment of obligations with general prohibitions is the criterion for distinguishing administrative Compulsion, the range is overstretched for a standard and it becomes to be hard for administrative objects to predict the administrative act. Therefore, it is considerable to explain that the legal character of the temporary storage action of loudspeaker is immediate compulsion. Because first of all, it can beenforced without preceding administrative act that imposes obligations under the currentlegal system. Secondly, there will be no real benefit to administrative action with the end of assembly and demonstration. Finally, excessive noise from the assembly and demonstration may cause serious damage to human health or to the property.
