초록

생활밀착형의 소비자거래는 매우 다양하다. 통상적으로 재화나 서비스를구매하는 소비자거래에 해당하는 계약은 약관을 통해 이루어지는 경우가많다. 2018년을 기준으로 한국소비자원에서 다루었던 서비스 분쟁조정사건중에서 주로 문제가 된 것은, 헬스클럽이용계약, 통신서비스계약, 여행계약, 인터넷 교육서비스계약 등이 주를 이루었다. 특히 해당 계약에서 문제가된 것은 계약의 내용변경이나 해제 및 해지권 행사와 관련한 것인데, 이와관련하여 소비자거래약관에서 개선되어야 할 점이 몇 가지 확인되었다.
소비자계약에서 거래약관이 업계, 소비자단체, 학계 그리고 관련한 공공기관의 노력으로 과거에 비하여는 공정하고 투명해진 것으로 판단된다. 그러나 여전히 약관의 행간에 숨겨진 의미나 그 의도가 소비자의 권리를 해치거나 사업자의 편중된 이익으로 될 가능성이 있다. 과거 거래약관에서는 불공정한 내용이 명확하게 확인되었던 반면, 최근에는 약관의기술(記述) 방법이 개선되어 명확한 불공정함은 많이 사라졌으나 문구의맥락이나 문장과 문장 사이의 충돌 등으로 불공정함이 숨어 있는 경우가있다. 이 과정에서 약관을 이용해 체결하는 계약에서 소비자보호에 역행하는 경우가 종종 발견된다. 특히 이러한 불공정성은 소비자에게 인정된철회권에 위배되기도 하고 소비자의 해지권을 제한하는 것으로도 나타난다. 그럼으로써 서비스의 종류에 따라 소비자관련 규범인 소비자기본법, 약관규제법, 방문판매법, 전자상거래법 등에 위배되는 경우가 있다. 소비자거래 약관의 규정은 명확하여야 한다. 약관 규정에서 불명확한 것을 포함하여 소비자의 이익을 침해해서는 아니된다. 그러한 측면에서 한국소비자원에 제기된 소비자약관과 관련한 서비스계약에서의 불공정한 약관은 시정되거나 불명확한 약관은 명확하게 해석하여 적용되어야 한다.

영어초록

The lifestyle-related consumer transactions are very diverse. Consumers enter into conventional consumer transaction agreements, in which purchase goods or services, through the terms and conditions. As of 2018, it is proven that the main issues of the dispute settlement cases related to lifestyle filed with the Korea Consumer Agency related to the fitness, the communication service, the travel, and internet education service. The disputes are related to the amendment and termination of the contracts. And it found that the improvements in the terms and conditions of the consumer transaction are needed.
The terms and conditions of the consumer contract appear to be fair and transparent compared to the past, thanks to the efforts of industry, consumer groups, academia, and related institutions. However, there is still a possibility that hidden meanings of or intentions by a business operator in the terms may harm the rights of the consumers or bias the interests of the business operator. Unfairness has been identified in past transaction terms.
On the contrary, the method of describing the contents of the agreement in recent years has been improved. On the other hand, it has been improved the way to explain the content of the terms and unfair content obviously. However, despite the improvement, there are still cases in which unfairness is implicated by the context of sentences or the conflict of contents between sentences. In such cases, it may be contrary to the purpose of consumer protection to contracting through the terms and conditions. The unfair terms and conditions limit withdrawal right or termination right by consumers, which may violate the consumer protection norms, such as the Framework Act on Consumers, the Act on the Regulation of Terms and Conditions, the Act on Door-to-Door Sales, Etc., and the Act on the Consumer Protection in Electronic Commerce, Etc.
The terms and conditions for consumer transactions shall be clear. The Business operators shall not infringe on the interests of consumers with uncertain terms and conditions. In this respect, the unfair terms of the contracts closely related to the lifestyle in which the consumers raise the issues with the Korea Consumer Agency shall be corrected, and the unclear terms shall be clearly interpreted.
