해외 문화재 등의 국내 전시에 대한 법적 규제 ― 문화행정법의 새로운 과제 ― (The Study on the Regulation for Exhibition of the Cultural Thing from Foreign Country — New Tasks of Cultural Administrative Law —)

초록

문화국가를 추구하는 헌법적 이념에 비추어 이를 구체화하는 문화행정법 분야에서 입법의 흠결이 발생하고 있다. 해외에 소재해 있는 문화재, 박물관자료, 미술품 등을 국내에 들여와서 전시를 하고자 하여도 문화행정법에 대한 입법이 되어 있지 않아 문제가 되고 있다. 최근 일본, 프랑스 , 이란 등 분쟁 대상이 되는 문화재를 많이 소유하고 있는 나라들이 우리에게 이들 물품에 대한 법적 보호를 위한 입법이 되어 있는지를 우리 국내에서의 전시를 위한 대여조건으로 제시해 오고 있다. 문화국가의 원리가 헌법에 선언되어 있지만, 이러한 헌법을 구체화하는 문화행정법 분야에서 문화향유권을 조화롭게 보장할 수 있는 입법이 흠결되어 있다. 따라서 우리 국민들은 다양하고 풍부한 해외 문화재, 해외 미술품, 해외 박물관 자료 등에 대하여 국내에서 전시를 접할 기회가 매우 어려운 상황에 있다. 이러한 문제를 어떻게 입법적으로 해결할 것인가? 문화재 압류방지를 위한 입법은 문화재를 전시하더라도 압류당하지 않도록 보장하겠다는 취지에서 이루어진 것으로서, 전시 및 교류를 활성화시킬 수 있는 ‘법적인 장치’(Legal Instrument)이다. 이는 약탈되거나 절취 및 강제로 반출된 문화재 등에 대한 반환(Restitution)의 정당성을 부정하는 것이 아니다. 다만, 그 반환은 정치적이고 외교적이며 경제적인 문제들이 복잡하게 얽혀져 있어서 시간이 매우 오래 소요될 수 있다. 따라서 분쟁의 해결과 별도로 전시를 통한 문화향유의 기회를 제공해 주는 공적인 과제(Aufgabe)가 문화국가에게 있다. ‘선반환 후전시’(先返還 後展示)는 분쟁해결을 위한 시간이 오래 소요되고 비용도 많이 요구되며. 문화재 전시 기회의 목적을 달성할지가 매우 불분명하다. 따라서 ‘선전시 후반환’(先展示 後返還)이라는 방식을 취할 수 있도록 하는 것이 충돌하는 가치들을 조화롭게 해결하는 것이다. 이를 위하여 충돌하는 정의와 문화재 향유권 등 상충되는 가치들을 모두 존중하면서도 조화롭게 추구할 수 있도록 국민들에게 분쟁의 소지가 있는 문화재들을 잠정적으로 전시의 기회를 제공하는 입법을 할 필요성이 있다. 소유권 반환은 영구적인 과제이지만, 문화재 전시는 잠정적인 과제이기 때문이다. 논리적으로 양립이 가능할 뿐만 아니라, 법감정에도 반드시 반한다고 할 수 없다. 따라서 이에 대한 구체적인 문화행정법 분야에서 흠결된 입법의 모델을 만들어서 제시해 보고자 한다. 문화체육관광부장관의 이들 물품의 보호결정에 대한 재량규정을 신설하고 이에 대한 절차 및 기한, 그리고 세부적인 내용들에 대한 입법을 제시하고자 한다. 또한 문화행정법 분야에 대한 법이론적 기반을 제공하고자 하였다. 특히 국가가 문화영역에 대한 접근방식으로서 종래의 규제국가에서 탈피하여 문화의 자율성을 존중하고 예외적으로 개입하여야 한다는 ‘제어국가의 국가관’과 이에 적용하여야 할 ‘거리의 원칙’을 제시하였다.

영어초록

In the view of the constitutional ideology that pursues the cultural state, legislative deficiencies arise in the field of cultural administrative law which embodies this.
Even if we try to bring in cultural assets, museum materials, and artworks, which are located in the foreign countries, in Korea, it is not ready for the legislation on the Culture Administrative Law. That is significant problem.
Recently, the countries that have a lot of cultural assets, such as Japan, France, and Iran etc, have presented us with legal conditions for legal protection of these items as conditions for renting for exhibitions in our country.
Although the principles of a cultural state are declared in the Constitution, there is a lack of legislation that can harmonize the Cultural Rights in the field of cultural administrative law that embodies these constitutions.
Therefore, it is very difficult for the Korean people to have access to exhibitions in Korea for diverse and abundant overseas cultural assets, overseas art objects, and overseas museum materials.
How can we find solution for these issues legitimately? Legislation for the prevention of foreclosure of cultural properties is intended to ensure that even if exhibited cultural assets are not seized, it is a “Legal Instrument” that can promote exhibition and exchange.
This does not deny the legitimacy of restitution, such as plundering, deception, and forcibly exported cultural properties.
However, the return of it can be very long time because political, diplomatic and economic problems are complex entangled.
Therefore, there is a public duty in the cultural country that provides an opportunity to enjoy the culture through the exhibition separately from the resolution of the dispute.
The way of ‘Exhibition after return’ takes a long time to resolve the dispute and is costly. It is very unclear whether the objective of exhibiting cultural assets will be achieved. Therefore, to be able to take the way of ‘return after the exhibition’ is to resolve the conflicting values harmoniously.
For this purpose, there is a need to make temporary protected exhibit of cultural assets from seizure possible so that they can pursue harmoniously while respecting conflicting values such as justice for return of it and cultural rights.
Return of ownership is a permanent task, but the exhibition of cultural properties is a tentative task. Not only is it logically compatible, it is not necessarily against the legal sense.
Therefore, I would like to create and present the legislation that is lacking in the specific cultural administrative law field.
The Ministry of Culture, Sports and Tourism shall establish discretionary rules for the protection of these items and propose legislation on procedures, deadlines, and details.
I also tried to provide a legal theoretical basis for the field of cultural administrative law.
In particular, the ‘Steering State’ and the ‘the Principle of the Distance’ that should be applied to the Cultural State. It is proposed as a way of approaching the cultural realm, in which the cultural autonomy should be respected and exceptionally intervened by that principle.
