감정평가법인등의 업무에 대한 법적 고찰 - 부동산 컨설팅 업무를 중심으로 - (Reflections on the Operations of Appraisal Firms from a Legal Perspective - With a Focus on Their Real Estate Consulting Services -)

초록

감정평가사제도는 공정한 감정평가를 통해 국민의 재산권을 보호하고 국민경제의 발전을 도모하기 마련된 제도로, 공공복리의 증진이라는 공익달성을 위한 국가 전문자격제도라고 할 수 있다. 한편 전문자격제도는 직업선택의 자유라는 국민의 기본권에 제약을 두면서 성립되는 만큼 공적 제한의 한 형태로 이해할 수 있다. 따라서, 감정평가법인등에게 독자성인 인정되는 업무의 범위는 제한적으로 새길 필요가 있다. 감정평가법에서의 감정평가 개념은 문리해석상 ‘가치추계업무’에한정하여 해석함이 타당하다. 한편, “토지등의 이용 및 개발 등에 대한조언이나 정보 등의 제공”업무를 규정하고 있는 감정평가법 제10조제7호의 업무는 ‘부동산 컨설팅 업무’를 의미하는 것으로, ‘비가치추계업무’영역에 해당하고, 감정평가법상 감정평가의 범위에 해당함이 없는 만큼, 감정평가법의 적용 범위에서 벗어난다고 해석하는 것이 타당하다. 감정평가의 개념을 ‘가치추계업무’에 한정하는 전제에서, ‘부동산컨설팅 업무’를 감정평가법인등의 업무에서 분리하여, 전문자격사가아닌 일반적 지위에서 수행할 수 있게 하는 방안을 생각해 볼 수 있다. 궁극적으로 부동산 컨설팅 업무에 대한 일반적인 기준을 마련하는 토대로 감정평가법인등이 참여하여 전문성을 발휘할 수 있는 영역을 한정하는 방안을 제시하는 것이 타당하며, 이러한 방침은 “다른 법령에따라 감정평가법인등이 할 수 있는 토지등의 감정평가”를 규정하고있는 감정평가법 제10조 제8호 규정과의 중복 여지가 있는 바, 사실상동법 동조 제7호 업무의 삭제를 의미할 수 있다. 감정평가법인등의 업무를 명확히 규정함으로써 사회적 혼란을 방지하고, 감정평가법인등의 전문성이 발휘될 수 있도록 하는 제도의 정비가 필요하다.

영어초록

An appraiser is a nationally certified professional designated to fulfill the public duties involved in promoting the public welfare with a view to protecting people’s property rights and facilitating the development of the national economy. National certification of professionals is understood as a kind of limitation for the public good, as it builds on the limitations of fundamental rights. Accordingly, the scope of operations that is recognized as exclusive to appraisal firms needs to be defined in a limited way. Interpreting the concept of appraisal as specified in the Law on Appraisal and Certified Appraisers should logically be limited to the work of “value estimation.” The duty, as specified in Article 10, Paragraph 7 of the Law on Appraisal and Certified Appraisers as “Provision of advice, information, etc. on the use, development, etc. of land, etc.” refers to “real estate consulting services.” As it falls into the “non-value estimation” category and does not fall within the scope of appraisal as specified in the law, it is only logical to view the duty as lying outside the scope of application specified in the Law on Appraisal and Certified Appraisers. While limiting the concept of appraisal to “value estimation,” this study considers the possibility of separating “real estate consulting services” from the duties of appraisal firms etc. and allowing them to perform them as a generalist and not as a certified professional. Ultimately, it makes sense that appraisal firms etc. engage in defining the areas in which their specialty is demonstrated as the basis for creating general standards for real estate consulting services. As this guideline runs the risk of repeating the provision in Article 10, Paragraph 8 of the Law on Appraisal and Certified Appraisers that stipulates “Appraisal of land, etc. that an appraisal business entity is allowed to perform pursuant to other statutes,” it may necessitate the deletion of the duty as described in Paragraph 7 under the same article of the said law. The system needs to be reorganized so as to clearly specify the duties of appraisal firms etc. in order to prevent confusion and ensure that the specialties of the appraisal firms etc. are put to their best use.
