초록

집합건물에 있어서 대지사용권은 구분소유의 존재를 전제로 한다. 건물소유는 필연적으로 건물이 있는 대지의 이용을 전제한다. 대지사용권은 구분소유자가 전유부분을 소유하기 위해서 건물의 대지에 대하여 가지는 권리로서 구분소유자가 임의로 그 권리가 아닌 다른 권리를 대지사용권으로 정할 수 없다. 대지사용권은 전유부분에 대한 종속성이 매우 강하여 구분건물과 대지사용권은 일체･불가분의 관계가 된다.
논문은 주로 대지사용권과 대지권이 같은 개념인지, 다르다면 어떻게 다른 개념인지의 문제에 착안하였다. 대지사용권에 관해서는 「집합건물법」 제2조 제6호가 “대지사용권이란 구분소유자가 전유부분을 소유하기 위하여 건물의 대지에 대하여 가지는 권리를 말한다”라고 규정하고 있다. 그리고 대지권에 관해서는 「부동산등기법」 제40조 제3항이 “집합건물법 제2조 제6호의 대지사용권으로서 건물과 분리하여 처분할 수 없는 것”이라고 규정하고 있다. 대지사용권이 구분건물을 소유하기 위하여 대지를 사용할 수 있는 실체법상의 권리임에 반해, 대지권은 대지사용권이 전유부분과 분리처분될 수 없음을 등기부상 공시하기 위하여 고안된 절차법상의 개념이다.
이 글은 「집합건물법」이 규정하는 대지사용권과 「부동산등기법」이 규정하는 대지권의 관계를 밝히는 것을 주된 연구목적으로 한다. 이를 위하여「집합건물법」상 구분소유권의 성립 후 대지사용권의 법적 성질, 처분일체성의 여부와 그 근거, 「집합건물법」상 대지사용권과 「부동산등기법」상 대지권의 관계 및 차이점, 대지권과 대지사용권의 구별을 통한 사법적 실익의 검토 등을 검토한다.

영어초록

In Condominium Buildings, the right to use the land presupposes the existence of partitioned ownership. Building ownership inevitably presupposes the use of land with buildings. The right to use the land is a right that the divided owner has to the land of the building in order to own the exclusive part, and the divided owner cannot arbitrarily determine a right other than the right as the right to use the land. The right to use the land has a very strong dependence on the exclusive portion, so the divisional building and the right to use the land are integrated and inseparable, and of course, the prohibition of separate disposition does not apply until the divisional ownership is established.
The thesis mainly deals with solving the problem of whether the right to use the land and the right to use the land are the same concept or how they are different. Regarding the right to use the land, Article 2, Subparagraph 6 of the Act On Ownership And Management Of Condominium Buildings stipulates that “the right to use the land refers to the right of the divided owner to own the exclusive part of the building.” And the land right is stipulated in the Real Estate Registration Act. While the right to use land is usually a right under the substantive law to use land to own a separate building, the right to use land is a concept of procedural law designed to disclose on the register that the right to use land cannot be separated from the exclusive part.
The main purpose of the thesis is to clarify the relationship between the right to use the land stipulated in Act On Ownership And Management Of Condominium Buildings and the right to use the land stipulated in the Registration Of Real Estate Act. In other words, the purpose of the study is to review the legal nature of the right to use the land under the Act On Ownership And Management Of Condominium Buildings, whether or not the disposition is unified, the relationship and difference between the right to use the land and the right to use the land.
