가등기 담보의 규율범위 및 판단기준 등과 관련한 법적 문제 (Legal Matters in Connection with Application Scope, Standard and Others of the Provisional Registration Security)

초록

이 논문의 제목은 가등기담보와 관련한 법적 문제라고 하였다. 장래에 어떠한 문제가 발생할 것인지를 현재의 시점에서 정확하게 예측할 수는 없다. 그러나 그것이 사회질서를 규율하는 제도라고 한다면 불합리한 결과가 발생되지 않도록 그 위험성을 최소화할 수 있는 방법이 모색되어야 한다. 특히 가등기담보와 같은 비전형 담보제도는 새롭게 창출된 제도라는 점에서 종래에 발생한 문제점들을 면밀하게 파악한다면, 장래에 정립될 가등기담보제도는 보다 합리적이고 실질적 정의에 합치될 수 있을 것으로 보여 진다. 특히 부동산은 중요한 재산권 중의 하나이면서 안정성을 이유로 선호되고 있는 재산적 객체라고 볼 수 있다. 그러므로 국민의 재산권을 보호하기 위하여 부동산 거래의 안정성과 편리성을 확보할 필요성이 있다. 이와 관련하여 부동산을 중심으로 하고 있는 가등기담보법은 채권자의 부당한 강요에 대하여 경제적 지위가 약한 채무자를 보호할 목적으로 제정된 특별법(1983.12.30.)이라고 할 수 있다. 이 법률이 제정된 이후에 그 법적 구성, 적용범위, 통지방법, 등기의 공신력 인정여부 등과 관련하여 다양한 법적 문제가 발생하고 있다. 예를 들어 소유권이전형식의 매도담보나 양도담보에 있어서는 등기부상의 채권자가 소유권자의 모습을 하고 있다. 이러한 이유로 담보제공자가 진실한 소유자임에도 불구하고 등기부상의 권리자인 채권자가 그 담보물을 제3자에게 양도한 경우에는 그 제3자가 소유권을 취득할 가능성이 있다. 이것은 등기에 공신력을 인정하고 있지 않은 현행 법체계에 반하는 것은 아닌지의 문제가 있다. 이렇게 가등기담보와 관련하여 다양한 법적 쟁점들이 존재하고 있지만, 이 논문에서 저자는 특히 법적 구성과 적용범위, 가등기담보의 판단기준 등과 관련한 문제점을 중심으로 검토하면서 그 개선방안을 제시하였다.

영어초록

The title of this thesis is “Legal Matters in connection with the Provisional Registration Security”. It would be difficult at the present moment to predict exactly what problems may arise in the future. However, there should be efforts to find solutions for problems related to regulation of public order so that the risk of causing unreasonable consequences can be minimized. Since the Provisional Registration Security System is something that is being newly developed, a thorough examination of past problems can lead to a future the Provisional Registration Security System that is more rational and accords with substantial justice. Real estate, one of the most important property rights of people, is the most preferred property because of its stability. Therefore, it can be said that it is an important thing to secure the stability and convenience of real estate transactions so as to protect the property right of people. Provisional Registration Security Act (Established on Dec. 30, 1983) was established to give ordinary citizens, the weak in economy, sufficient legal protection against extortion from creditors. However, since the establishment of Provisional Registration Security Act, there have been raised many Legal Matters theoretically including legal composition, scope and notification method of the Provisional Registration Security Act. For example, the creditor shall be the real estate owner on the register book in the mortgage of sale or the mortgage of transfer that takes a form of the passage of title. But in case the rightful person on the register book transfers the security to the third party though the provider of the security many internally be the creditor who is the true owner in this case, the third party comes to acquire the title to it, which results in admitting the public trust in provisional registration for security. It is contrary to the reality that the general doctrine and judicial precedent do not acknowledge public trust in real estate registration. I explained about the main contents of the Provisional Registration Security System and dealt with the important contents of the Provisional Registration Security System and suggested especially the problems and improvements in connection with legal composition, scope and standards to determine the Provisional Registration Security in the Provisional Registration Security System.
