초록

여야는 ‘상설특검’을 규정한 ‘특별검사의 임명 등에 관한 법률안’과 ‘특별감찰관법’을 2014년 2월 28일 임시국회 마지막 날 통과시켰다. 당시 상설특검법은 ‘무늬만 상설특검’, ‘누더기 상설특검’이라는 비판을 상당히 많이 제기됐다. 이는 결국 현실이 되었다. 상설특검법에서 가장 크게 문제점으로 지적되는 것은 제3조 “특별검사의 수사가 결정된 경우 대통령은 특별검사후보추천위원회에 지체없이 2명의 특별검사 후보자 추천을 의뢰하고 추천을 받은 날부터 3일 내에 추천된 후보자 중에서 1명을 특별검사로 임명한다”는 부분이다. 국회에서 2명을 추천한다면 여야 각 1명씩 추천하게 될 것이고, 대통령은 당연히 여당 측 후보를 임명하게 되어 겉으로는 여야가 합의해 특별검사를 임명하는 것처럼 보이지만, 실제로는 대통령과 여당이 원하는 후보가 특별검사로 임명될 수밖에 없는 구조이다. 또한, 사안이 불거질 때마다 특검을 발의하는 지금의 ‘제도특검’ 방식으로는 한계가 있는 만큼 상설 전문기관을 별도로 설치해 특검으로 하여금 수사를 담당하도록 개정함이 상당하다. 또 특검의 선정 주체를 국회로 하고, 특검 추천위원은 각 교섭단체 및 비교섭단체 대표, 대한변호사협회 회장, 한국법학교수회 회장 등의 추천으로 구성함이 상당하다. 나아가, 국회의원 소수의 의견으로도 수사개시를 가능하도록 요건을 완화하는 한편, 대통령을 비롯해 국무총리, 법무부 장관, 검찰총장, 국가정보원장 등도 수사대상에 포함되어야 한다. 한편, 특별감찰관법은 폐지 후 향후 개정되는 특별검사법에 흡수하여 통합 운영되도록 함이 상당하다.

The most serious problem in the Standby Inquiry Law is that Article 3, “If the investigation of the Special Inspection is decided, the President shall refer the Special Inspection Candidate Recommendation Committee to the two Special Inspection Candidate without delay and recommend it within 3 days from the date of recommendation One of the candidates is appointed as a special exam”. If the two are recommended by the National Assembly, one nominee will be nominated for each one, and the president will nominate a candidate for the ruling party, apparently appointing a special prosecutor, It is a structure that can only be appointed by inspection. In addition, as there is a limit to the current system of ‘special system for the system’ which initiates a special investigation every time a problem is raised, it is significant that a permanent specialist institution is separately installed and the special investigation is carried out for investigation. In addition, the selection of the special prosecutors is referred to as the National Assembly, and the special recommendation committee consists of representatives from each bargaining group and comparative group, chairman of the Korean Bar Association, and chairman of the Korean Law Faculty. In addition, the requirements for the start of investigation can be eased by a small number of members of the National Assembly, while the President, the Prime Minister, the Minister of Justice, the Attorney General and the Director of National Intelligence should also be included in the investigation. On the other hand, it is significant that the Special Inspector Law is absorbed in the Special Inspection Law revised in the future after the abolition, and is integrated.
