초록

스마트폰의 사용증가에 따라 누구나 언제 어디에서든 쉽게 자신의 휴대전화나 손쉽게 구매할 수 있는 초소형 크기의 촬영기기를 사용하여 타인을 촬영할 수 있게 되었다. 이에 따라 ‘몰래카메라’ 피해가 사회적으로 많은 문제가 되고 있다. 「성폭력처벌법」 제14조에서 규정하고 있는 ‘카메라등이용촬영죄’는 이와 같은 이동통신기기의 발달과 온라인이 여성들에 대한 성폭력의 수단으로 작용하는 새로운 유형의 성폭력이다. 카메라등이용촬영죄와 기존 성폭력들의 동일한점은 결국 여성의 몸이 대상화된 범죄라는 것이다. 하지만 기존 성폭력과 달리 카메라등이용촬영죄는 인터넷을 이용한 빠른 전파성으로 인해 촬영물이 일단 유포된 경우 영구삭제가 거의 불가능하여 피해 회복이 어렵다. 또한 빠른 과학 기술의 발전으로 촬영 및 유포의 수단과 방법은 진화하고 있지만, 법이 이러한 현실을 따라가지 못하는 입법 공백 상태도 발생하고 있다.
타인을 동의없이 촬영하는 행위와 이를 유포하는 행위는 범죄의 위험성과 비난가능성 측면에서 상이하기 때문에, ‘유포행위’의 불법성에 상응하는 엄격한 처벌을 위해서는 촬영행위와 유포행위를 각 행위별로 조항을 구분하여 규정하여 처벌하여야 한다. 또한 유포의 ‘방식’과 관련하여서는 제3자에게 유포하는 행위방식을 제한적으로 열거하지 않고, 촬영물이 제3자에게 인식되게 하는 모든 행위를 처벌하도록 개정하여 입법공백을 막을 수 있도록 개정되어야 한다.
촬영물이 유포되어 여성이 피해를 입은 경우 촬영물 삭제와 그 비용을 개인에게 부담시키는 것은 한계가 있다. 따라서 국가가 적극적으로 개입하여 피해를 구제하는 방법을 강구하여야한다. 현재의 정보통신기술의 발전이 어떻게 어느 수준까지 발달할지 예측하기 힘들기 때문에 카메라등이용촬영죄뿐 아니라 온라인 성폭력에 대응하기 위해서는 현재 성폭력 피해자 지원체계를 구축하고 있는 ‘여성가족부’가 중심이 되어 경찰, 방통위, 민간 인터넷 자율기구와 함께 ‘온라인 성폭력 대응센터’를 설치하여야 한다. ‘온라인 성폭력 대응센터’는 온라인 성폭력 피해자를 지원할 뿐만 아니라, 사법집행기관들에 대한 교육 및 일반 국민들의 인식 함양 및 교육캠페인을 통해 온라인 성폭력을 예방하는 등 종합적인 온라인 성폭력 대응 체계를 마련하여야 한다.

With the increased use of cellphones, Anyone can easily take pictutes anyone, anytime and anywhere, with their own mobile phone device or a small-sized imaging device that can be easily purchased. This has given rise to diverse social problems in recent years. The crime of taking pictures using cameras is stipulated in Article 14 of the “Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes” and taking pictures using mobile communication devices and posting them online is a newly emerging type of sexual violence against women.
The similarity between existing sexual violence crimes and the crime of taking photos using cameras is that both crimes objectify the female body. However, the crime of taking photos using cameras makes it difficult to recover damages because of the fast dispersiveness through the Internet; it is also impossible to delete a photo permanently from the Internet. And The technical development of devices has also made it possible to film a person secretly. In addition, while the ability to take and circulate photos has been developing as technology improves, Article 14 exists in a legislative vacuum, which means that it is not able to reflect reality.
To have the punishment commensurate with the illegality of the action of circulating photos, it is necessary to differentiate between the action of taking the photos without permission and the action of circulating the photos since the actions have different aspects of criminal risk and possibility to criticize. With regard to the method of circulating photos, to fill the legislative vacuum, the current law should be revised to punish all actions to make third party recognize the illegality of the photos taken rather than restrictively listing methods to circulate photos to a third party.
When the photos is spread and the woman is damaged, there is a limitation to impose a duty to delete the photos and cost on an individual, it is necessary for the government to deliberate how to actively intervene and relieve a victim’s damages. It is difficult to foresee the extent to which the current information and communication technology could develop. Therefore, to deal not only with the crime of taking photos using cameras, but also with online sexual violence, the Police, the Korea Communications Commission and civil self-regulatory body for the Internet, and the Ministry of Gender Equality and Family should forge a “Center to Response Online Sexual violence” to support victims of sexual violence. A comprehensive system to take action on online sexual violence should include the education of law enforcement organizations, an education campaign and fostering awareness for the public, and support for victims of online sexual violence.
