중국의 부동산등기제도의 현황과 개선방안 (The Present situation and The Improvement project of Real estate registration system in China)

재산권의 체계에서 부동산은 매우 중요한 지위를 차지하고 있다. 부동산등기제도는 물권법에 규정된 기본적인 제도다. 부동산등기제도에 대한 개선은 거래의 안전과 촉진의 측면에서 매우 중요하다. 그러므로 오랫동안 부동산등기제도에 대한 수정은 중국물권법학자들에게는 논쟁의 대상이었다. 2007년 물권법 반포한 이후 중국의 부동산등기제도는 이전보다 많이 개선되었지만 실제로는 여러 면에서 부족한 내용이 많다.
2015년 3월 1일 “부동산등기임시시행조례”의 반포에 따라 통일화된 부동산등기제도가 확립되었다. 그러나 역사적 문제와 현실적 조건 때문에 제도의 확립은 많은 곤경을 직면해 있다. 통일화된 부동산등기제도의 확립에 따라 부동산에 관한 재산권의 귀속과 여러 내용은 정확하게 확인할 수 있게 되었다. 또한 부동산재산권의 권리자에 관한 합법적인 권익도 보호할 수 있게 되었다. 통일화된 부동산등기제도는 시장경제의 기본적인 제도로서 등기기관이 실무에서 활용할 수 있는 유일한 근거이다. 따라서 이러한 제도의 제정은 중국의 국정실정에 맞아야 하고, 또 부동산등기의 조작과 같은 직면한 여러 문제도 고려되어야 한다. 본 연구의 중심도 이것에 있다.
본 논문에서 우선 중국 부동산등기제도의 내용과 종류에 대해서 소개하여 부동산등기제도의 현황과 “부동산등기임시시행조례”반포한 이후 개혁에 따른 변화를 통해서 부동산등기제도와 관련한 여러 문제를 발견했다. 즉 부동산등기제도의 불통일, 심사제도의 문제점, 부동산등기제도의 이원화, 배상제도의 문제점, 그리고 부동산등기정보의 조회에 관한 문제 등 이다. 본 연구에서는 이러한 문제점에 대해서 상응한 개선방안을 제안하는데 주안점을 두었다. 이러한 문제점을 해결하는 핵심적인 개선방안은 부동산등기제도를 통일화하는 것으로 생각한다.

Real estate occupy an important place in the system of property right. Real estate registration system is the basic systems in the legal system of property law. It’s is the embodiment of the demonstrative principle of real right, which is the core principles in property law. Improving the system of real estate registration is crucial to grantee the safety of commercial activity and promote transaction. So, how to set up the real estate registration system has been a controversy which attracts the academician's attention that in the field of the estate in China. Since the enactment of the property law in 2007, the real estate registration system in our country has improved greatly compared with the original system, but there are still some defects.
In March 1, 2015, the Provisional Regulations on real estate registration was formally implemented, which marked the establishment of a unified real estate registration system in china. Because of historical reasons and actual conditions, the establishment of the system still faces many difficulties. The establishment of a unified real estate registration system enables the ownership and content of real estate property rights to be accurately recognized, and can effectively protect the legitimate rights and interests of property rights holders, and avoid conflicts of property rights. As a basic system of market economy, the unified registration system of real estate will be the only basis for the actual operation of the registration department. Therefore, in the process of setting up the real estate registration system, we should combine the situation of our country and consider the problems that the registration department may face in the process of actual registration. This is also the keynote of this article, In this paper, the contents and types of China's real estate registration system are introduced first. Through the analysis of the status quo of real estate registration system as well as the reform and change of the Interim Regulations on real estate registration, the problems of unified real estate registration system have been found out. That is, at the present stage, the disunity of the real estate registration system, the imperfect of Censorship，the dualization of real estate registration system, the imperfect of Compensation system, and the problem of inquiry about real estate registration information. In view of these problems, the corresponding improvement plan is put forward. Moreover, the establishment of a unified real estate registration system will be the core of all the improvement programmes.
