간첩 등 체제위해사범 적정 신고 상금에 대한 고찰 (Study on the Appropriate Reward for Reporting Espionage and Criminals)

초록

최근 테러리즘에 대한 관심이 높아지면서 간첩이나 테러리스트 등과 같은 국가의 체제에 중대한 위협이 되는 적정 신고 상금에 대한 관심과 함께 신고 상금을 많이 올리면 간첩, 테러리스트와 같은 안보 체제 위협 사범에 대한 신고에 대한 관심도 집중되고 있다. 원론적으로 신고 상금을 올리더라도 신고 사례가 증가하지 않는다면 왜 그러한 지에 대한 논의를 할 필요가 있다. 그리고 범죄학적인 차원에서 고액의 상금 때문에 신고가 증가한다면 과연 믿을만한가라는 의문을 제기할 수 있다. 이러한 의문들은 범죄나 체제위협신고의 상금책정과 관련하여 여러 의문을 낳는다. 특히, 남북대치의 준전시 상황에 있는 우리의 안보환경에서 간첩이나 체제 위해 사범의 신고상금의 적절성과 효과성에 대한 고민은 상당히 중요한 문제이다.
우리나라는 일반 형사범과 안보사범과의 불법성을 동일시하고 있는데, 이는 신고 포상금과도 연결된다. 신고포상금 역시 간첩이나 테러리스트와 같은 불법성이 매우 높은 안보범죄임에도 불법성을 책정하지 않은 채 과거와 비슷하게 책정되어 있는 것을 알 수 있다. 이는 물가상승률을 고려하여 그만큼의 위험도에 맞게 금전적으로 국가차원에서 보호해야 한다. 그리고 국가의 안전을 고려해 볼 때, 비례성의 차원에서 국가의 안전과 공공의 이익을 보호하기에 충분한 대가를 통해서라도 보호할 만한 가치가 있다면 국가 차원에서 신고포상금을 높이겠다는 의지가 반영되어야 한다. 이에 본 논문에서는 논리 안보사범위험사범에 대한 신고포상금의 적정성에 대한 근거를 제시하고자 한다.

영어초록

Along with increasing interest in terrorism, interest is also growing immensely towards the appropriate reward for reporting criminals, including but not limited to espionage and terrorists, who are becoming a major threat to the national system. In addition, when the reward for reporting increases substantially, interest increases towards reporting criminals, including but not limited to espionage and terrorists, who are becoming a threat to national security. Moreover, theoretically, if there is no increase in number of reports with the increased amount of reward, then there is a need for further discussion on the cause of such case. Furthermore, if there is an increase in number of reports with the increased amount of reward, then the reliability of relevant reports could be questioned from the criminological perspective. Such questions can bring about further doubts related to reward allocation of reporting crime or threat in system.
Particularly, considering our security environment under North and South Korea's 'quasi-state of war,' contemplation over the appropriateness and effectiveness of the reward for reporting espionage or criminals is significantly important. However, there have only been a few relevant research or validity analysis completed in Korea. Henceforth, the objective of this study is to offer a logical basis for such issue.
Currently, the reward for reporting espionage is allocated from KRW 500 million up to KRW　750 million. However, there is a relative absence of discussion on what type of logical, effective basis determined the allocated reward and whether the allocated reward is effective in augmenting reliable reporting or not. Theoretically, reward for reporting is allocated to induce human behavior in reporting a specific crime or threat. In addition, the appropriate amount of reward must be found in the appropriate balance point between the expected change in action and the cost(namely, reward for reporting) for inducing this expected outcome. In other words, the appropriate reward for reporting must be determined under the minimum cost of reward for reporting and the maximum point in expected outcome of the augment of reliable reporting.
In order to suggest a logical basis of determining an appropriate reward for reporting, this study expects to generate an implication by comparing the amount of reward for criminal reporter of economic offense, tax evasion and witness protection program of the States with similar internal and external cash incentive.
