피해자 등에 대한 신변안전조치의 개선방향 (A study on improvement direction for personal safety measures for crime victims)

초록

이 글은 현행법상 범죄피해자 등에 대한 신변안전조치의 현황과 그 개선방향을 검토함에 그 목적이 있다. 이를 위하여 범죄피해자 신변보호의 정책변화(Ⅱ), 범죄피해자 등에 대한 신변안전조치의 근거법령(Ⅲ) 범죄피해자 등 신변안전조치의 강화방안(Ⅳ) 등을 순차적으로 검토하고, 이를 기반으로 나름의 생각을 제시하였다.
먼저, 범죄피해자 신변보호와 관련한 정책은 지금까지 3차에 걸쳐 입안되고 시행된 범죄피해자 보호・지원계획에 의하여 상당한 진척을 이루었음을 살펴보았다. 지금까지 범죄피해자의 사생활의 평온 및 신변안전이라는 정책과제는 제1차 기본계획에서 제3차 기본계획에 이르는 과정에서 다양한 입법적 시도와 정책추진의 결과로 인하여 점차로 명확하고 구체적인 세부과제로 진화되어 왔음을 알 수 있다.
다음으로, 범죄피해자 등에 대한 신변안전조치의 근거법령에 대하여 살펴보았는데, 지금까지 신변안전조치의 기본적 형태는 「특정범죄신고자 등 보호법」에 기반하고 있었다. 그러나 가정폭력범죄의 처벌에 관한 특례법을 시작으로 범죄신고자법과는 다소 구분되는 취지의 신변보호제도가 증가하는 경향에 있다. 이는 종래 증인 및 참고인보호를 출발점으로 하여 신변보호제도가 발전해 왔다는 점을 고려할 때 피해자의 특성을 반영한 신변보호제도로의 분화와 특화가 필요한 시점에 이르렀음을 나타내는 사실이라 할 수 있다. 특히 아동학대 등 가정폭력범죄와 데이트폭력 등 스토킹범죄가 이러한 분화와 특화를 가속화하는 계기로 작용할 수 있을 것으로 보인다.
마지막으로, 범죄피해자 등 신변안전보호조치의 강화방안으로 ① 범죄피해자 신변보호를 위한 일반법적 근거마련, ② 증인보호와 피해자보호의 분리, ③ 접근금지명령의 활성화, ④ 범죄신고자법 및 가정폭력처벌법 등 개별법률의 정비를 통한 신변안전조치의 개별화와 다각화가 요구된다는 점을 지적하였다. 덧붙여서, 종래 범죄피해자 보호・지원에 관한 기본계획을 통하여 추구되어 온 신변보호 조치의 실효성 제고, 개별기관에서 시행하고 있는 신변보호조치의 법제화, 수사기관의 인식변화와 대국민 홍보를 통한 사회일반의 인식제고, 검찰과 경찰 등 유관기관 사이의 명확한 역할분담 등도 필요하다.

The purpose of this article is to review the current state of personal safety measures for crime victims, etc. under the current law and the direction of their improvement. To this end, we sequentially review policy changes for the protection of crime victims (II), laws based on personal safety measures for crime victims, etc. (Ⅲ), and measures to strengthen personal safety measures for crime victims (IV).
First, it can be said that the policy related to the personal protection of crime victims has made considerable progress through the crime victim protection and support plan devised and implemented three times so far. The policy tasks of peace in the privacy and safety of crime victims according to the plan have gradually evolved into clear and specific detailed tasks according to the results of various legislation and policy promotion in the process from the 1st Basic Plan to the 3rd Basic Plan. It can be said that it has been Next, we looked at the laws based on personal safety measures for crime victims, etc. The personal safety measures under the current law can be broadly divided into two types. In particular, considering the fact that the personal protection system has developed with the protection of witnesses and witnesses as a starting point, it is necessary to differentiate the personal protection system that reflects the characteristics of victims that are distinguished from witnesses. I thought that stalking crimes could be the trigger.
Lastly, as a measure to strengthen personal safety protection measures for crime victims, etc., ① prepare a general legal basis for personal protection of crime victims, ② separate witness protection and victim protection, ③ activate an order prohibiting access, ④ crime reporter law and domestic violence punishment law The revision of individual laws was suggested. In addition, improvement of the effectiveness of personal protection measures that have been pursued through the conventional basic plan for protection and support for crime victims, enactment of personal protection measures implemented by individual institutions, changes in the perception of investigative agencies, and public awareness of the general public through public relations He pointed out that there is also a need for a clear division of roles between relevant agencies such as prosecutors and police.
