초록

This study is on the North Korea's Commerce Act. In the study on the North Korea's Commerce Act, we should examine its contents rather than its characteristics. That's why the explanation of its characteristic is liable to describe the Social system focused on the political aspects.
NK's social supply is furnishing food to the inhabitants. Here we can see the important characteristic of the Communism.
The Act stipulates the facilities services (health care service, goods prosessing service, repairing service, facilities- utilizing service), which are not concretely divided as our Commerce Act §46(1-21).


In the NK, The custody of goods is regarded as one of the distribution, where the nationalized enterprise, massed enterprise take charge of it.
NK's Commerce Act emphasises the culture of the commerce, demanding the participants' social enthusiastic sacrifice.
So the high level of commercial culture and service is regarded as the unique means of enhancing the good's quality.
Nevertheless, the level cannot be concreted by the Communism system itself.
In North Korea, they try to modernize the commercial facilities, to make the commercial management scientific and systematized, as a way to enhance the level of the commercial culture and service.
One of the characters of the Social economy is that the whole economic system is subject to the planned ordering of the Labourers' Party.
The NK's Commerce Act has the punitive articles, such as the injunction of the unlawful acts, penalty, etc.


In the liberal system, we have the articles concerning the breach of the private contracts. In contrast of it, NK's system has the stipulation about the breach of the public contracts only.
