청소년성보호법상 위장수사 등의 개선방안 (Improvement Measures for Undercover Investigations under Act on the Protection of Sexuality for Children and Adolescents)

초록

위장수사 등 특례수사제도는 2021. 3. 23. 자로 개정된 「아동·청소년의 성보호에 관한 법률」 에서 아동·청소년을 대상으로 하는 디지털성범죄에 한정하여 도입되었는데, 법률상 명문의 근거 를 찾기 어려웠던 종래의 상황과는 달리 아동·청소년을 대상으로 하는 디지털성범죄에 한하여 명 시의 규정이 도입되었다는 점에서 새로운 논의의 필요성을 찾을 수 있다. 이 글은 새롭게 위장수사 등 특례수사제도가 도입되어 3년이라는 시간이 흐른 현시점에서 아동･청소년대상 디지털 성범죄의 예방과 증거자료의 확보라는 입법취지를 살려 위장수사 등의 특례수사제도(청소년성보호법 제25조 의2~제25조의9)를 활성화하는 방안을 고민함에 목적이 있다. 이를 위하여 ① 위장수사제도의 도 입경과와 내용, ② 위장수사제도의 활용현황과 한계 및 문제점, ③ 위장수사제도의 적정하고 효율 적인 활용을 위한 나름의 개선방안 등에 대하여 차례로 살펴보았다. 결론적으로 제도도입 당시의 기대와 달리 특례수사가 활발하게 활용되고 있지는 않다는 점을 지적하였다. 그러나 특례수사의 활 성화가 필요하다는 점에는 공감하지만, 섣부르게 대상범죄를 확대하거나 성인대상의 범죄에 대해 서도 특례를 적용하도록 하는 것은 바람직하지 않다고 보았다. 또한 현재의 특례수사제도를 보완하 고 이를 활성화하는 것에 중점을 두고 어느 정도 제도가 안착된 이후에 법령을 정비하여 궁극적으 로는 형사소송법에 이 제도를 명문화하여 도입하는 방안이 바람직하다는 점을 기술하였다.

영어초록

The special investigation system, including undercover investigations, was introduced in the revised Act on the Protection of Children and Adolescents from Sexual Abuse on March 23, 2021, limited to digital sex crimes targeting children and adolescents. Unlike the previous situation where it was difficult to find explicit legal grounds, the introduction of explicit provisions only for digital sex crimes targeting children and adolescents suggests the need for new discussions. The purpose of this article is to consider ways to activate the special investigation system, including undercover investigations (Articles 25-2 to 25-9 of the Juvenile Sexual Protection Act), in order to fulfill the legislative intent of preventing digital sex crimes against children and adolescents and securing evidence at a point in time when three years have passed since the introduction of the new special investigation system, including undercover investigations. To this end, we examined ① the introduction process and contents of the undercover investigation system, ② the current status, limitations, and problems of the utilization of the undercover investigation system, and ③ our own improvement measures for the appropriate and efficient utilization of the undercover investigation system. In conclusion, it was pointed out that, contrary to expectations at the time of the introduction of the system, special investigations are not being actively utilized. However, although it is agreed that special investigations need to be activated, it is not desirable to hastily expand the target crimes or apply special investigations to crimes against adults. In addition, it was described that it is desirable to focus on supplementing and activating the current special investigation system, and to revitalize it, and to ultimately introduce the system by specifying it in the Criminal Procedure Act after the system has been stabilized to some extent.
