초록

공연입장권 등의 부정판매는 공연 등을 관람하고자 하는 자의 기회를 박탈하며, 공연 등을 관람하고자 하는 자는 공연입장권 등을 재판매시장에서 고가로 구입하여야 하기 때문에 재산적피해를 입게 된다. 또한 공연입장권 등에 대한 공정한 거래질서를 침해하여 문화예술체육 분야의 발전을 저해한다. 따라서 공연입장권 등의 부정판매를 금지하기 위해 경범죄처벌법에서 이를처벌하고 있으며, 공연법 및 국민체육진흥법을 개정하여 처벌규정을 신설하였다. 그러나 신설된공연입장권 등의 부정판매 금지에 관한 규정은 금지하는 행위가 무엇인지 모호하며, 단순히 금지규정과 처벌규정만을 신설하였기 때문에 공연입장권 등의 부정판매를 효과적으로 근절하기에는 충분하지 않다. 따라서 공연입장권 등의 부정판매를 효과적으로 근절하기 위해서는 다음과같은 법적 개선이 필요하다.
첫째, 공연입장권 등의 부정판매를 규제하기 위해 공연법과 국민체육진흥법이 개정되었지만, 개별법의 한계로 인해 모든 입장권의 부정판매를 규제할 수 없기 때문에 공연입장권 등의 부정판매를 전문적으로 규제할 수 있는 특별법의 제정이 필요하다. 둘째, 매크로 프로그램을 이용하여 취득한 공연입장권 등의 부정판매행위만을 금지하는 것만으로는 이러한 행위를 근절할 수없기 때문에 업으로써 매크로 프로그램을 이용하여 공연입장권 등을 구입하는 행위도 금지할필요가 있다. 셋째, 공연입장권 등의 부정판매 근절을 위해 국가는 이러한 행위가 위법이라는사실을 국민 모두가 알 수 있도록 홍보 및 교육을 실시하여야 하며, 이를 차단하기 위한 기술개발 등에 대한 지원이 필요하다. 또한 공연입장권 등의 판매사업자는 매크로 프로그램을 통해 공연입장권을 구매할 수 없도록 판매방식의 다양화 및 차단 시스템을 설치한 사이트에서 공연입장권 등을 판매하고, 재판매시장을 운영하는 온라인 플랫폼 운영사업자는 공연입장권 등의 부정판매가 해당 온라인 플랫폼에서 이루어지지 않도록 조치를 취하여야 할 것이다. 넷째, 공연입장권 등의 부정판매를 근절하기 위해 필수적 몰수를 규정하여 이러한 부정판매를 통해 이익을 얻을 수 없도록 할 필요가 있다. 마지막으로 매크로 프로그램을 이용한 공연입장권 등의 구매계약 및 부정판매에 대한 사법적 효력을 무효로 규정으로써 위법행위를 통해 이익을 얻을 수 없도록 규정할 필요가 있다.

Illegal sales of tickets for performances deprive people of the opportunity to watch performances, and those who want to watch performances suffer property damage because they have to purchase tickets for performances at a high price in the resale market. It also hinders the development of the field of culture, arts, and sports by violating the order of fair trade for performance tickets, etc. Therefore, the Misdemeanor Punishment Act punishes the illegal sale of performance tickets, etc., and the Public Performance Act and the National Sports Promotion Act were revised to establish punishment regulations. However, the new regulations on the prohibition of illegal sales of performance tickets are ambiguous, and it is not enough to effectively eradicate illegal sales of performance tickets because only prohibited regulations and punishment regulations have been newly established. Therefore, the following legal improvements are needed to effectively eradicate illegal sales of performance tickets.
First, the Public Performance Act and the National Sports Promotion Act were revised to regulate illegal sales of performance tickets, but due to the limitations of individual laws, it is necessary to enact a special law that can professionally regulate illegal sales of performance tickets. Second, it is necessary to prohibit the purchase of performance tickets using macro programs because only prohibiting illegal sales such as performance tickets acquired using macro programs cannot eradicate this behavior. Third, in order to eradicate illegal sales of performance tickets, etc., the state should conduct publicity and education so that all people can know that these acts are illegal, and support for technology development to block them is needed. In addition, sales companies such as performance tickets should diversify their sales methods and sell performance tickets on sites with a blocking system so that they cannot purchase performance tickets through macro programs, and online platform operators operating resale markets should take measures to prevent illegal sales of performance tickets on the online platform. Fourth, in order to eradicate illegal sales of performance tickets, etc., it is necessary to stipulate essential confiscation so that profits cannot be obtained through such illegal sales. Finally, it is necessary to stipulate that the judicial effect of purchasing contracts and illegal sales of performance tickets using macro programs cannot be obtained through illegal acts by invalidating them.
