몽골 부동산 등기제도에 관한 연구 (A Study on the Mongolian’s Real Property Registration Act)

초록

부동산은 개인이나 법인 등 단체에게 있어서 보유자산 중 재산적 가치가 큰 재산권 중 하나이며, 이 재산권을 보호하기 위한 법⋅제도적 장치가 부동산등기이다. 부동산등기법은 각 국가별사회문화적 상황 및 해당 국가의 법체계에 따라 입법체계 및 내용 등이 상이하며 다양한 형태로나타날 수 있다. 본 연구는 자유시장경제로 빠르게 발전하는 몽골(Mongolia) 국가의 부동산 등기제도에 관하여 연구하고자 하였다. 1992년 신헌법에 의해 사회주의 국가에서 민주주의 국가로전환된 몽골은 자국민의 거주용으로 분배된 토지를 먼저 사유화한 후에 다른 용도의 토지로그 소유권 취득 범위를 넓히겠다는 계획 하에, 가족 공동수요용으로 지역에 따라 차등을 두어0.07ha에서 0.5ha까지 국가토지 일부의 소유권을 무료로 분배하였다. 몽골에서 부동산 및 토지권리 등기는 1997년에 부동산 등기에 관한 법이 개정되면서 개인과 법인이 소유권을 확보하고국가등기기관에 등기하기 시작했지만 부동산의 정보와 부동산등기제도가 완전히 이뤄지지 않았다. 여전히 부동산 등기와 관련하여 자유 시장경제 중심의 여타 국가와 비교해 볼 때, 몽골의부동산기제도는 개선되고 발전되어야 할 부분이 많다. 이에 현재 몽골의 부동산 등기제도를고찰해 봄으로써, 현재 등기제도에 대하여 개정이 필요한 부분과 제도적으로 보완할 부분은 무엇인지 연구함으로써, 빠르게 발전하는 몽골의 사회 경제의 변화에 부합하는 부동산 등기제도의규율성과 방향에 대해 통찰하고, 미래 법제체계의 변화와 법률을 개정하기 위한 법제개혁 방향을 적극적으로 연구해서 시행해야 할 필요성이 있다. 또한, 제도적 개선과제를 발굴하고 보완함으로써 몽골의 부동산 소유권 제도가 국내 시장경제의 발전 속도에 부응함은 물론, 국제사회에서 시행하는 제도와의 마찰을 감소시켜 경제 활성화를 촉진하고 국가발전에도 크게 도움이 될것으로 판단한다.

영어초록

Real estate is one of the high property values among assets held by individuals or corporations, and real estate registration is a legal and institutional device to protect the property right. The real estate registration law has different legislative systems and contents depending on the socio-cultural situations of each country and the legal system of the country, and can appear in various forms. For example, there are differences in the legal system and legal content of the real estate registration law between continental and Anglo-American legal countries, and the legal system and legal content of the real estate registration law also differ for each individual country within the continental and Anglo-American countries. However, between individual countries within the continental and Anglo-American countries, the mutual legal development experience for the real estate registration system may affect the mutual real estate registration law. This research is to study the characteristics of the real estate registration system in Mongolia, which is rapidly developing into a free market economy since the new constitution in 1992, Mongolia privatized land, distributed for residential purposes and then expanded the scope of ownership to other uses, distributing free ownership of some of the land from 0.07 ha to 0.5 ha. In Mongolia, when the Real Estate and Land Rights Registration Act was revised in 1997, individuals and corporations secured ownership and began to register with state registration agencies, but the real estate information and real estate registration system were not fully implemented. Comparing to other countries centered on the free economy market in relation to real estate registration, Mongolia’s real estate fundamental system still has many areas to be improved and developed. Therefore, by considering the current real estate registration system, we study the parts that need to be revised and the parts that need to be systematically supplemented, and also the rapidly developing Mongolian society. There is a need to actively study and implement legal reforms on changes in the future legal system and directions to revise laws through insights into the discipline and direction of the real estate registration system in line with economic changes. In addition, by discovering and supplementing institutional improvement tasks, Mongolia’s real estate ownership system will not only respond to the pace of development of the domestic market economy but also reduce friction with the international system, thereby promoting economic revitalization and greatly helping national development.
