발트3국에 관한 조약들의 체계 (System of treaties relating to the Baltic States)

초록

발트3국은 국제사회에 독립 국가로 등장하면서 국제법 주체가 되었다. 한국과 이 국가들이 참여하는 UN이나 WTO 차원의 다자간 국제규범은 새로운 논제의 출현으로 다양한 논의가 이루어지며, 그 결과에 따라서 새로운 조약의 체결이나 기존 조약의 변화가 많이 일어날 수 있다. 한국과 EU 차원에서도 양측의 관계가 다양하게 전개되므로, 기존 조약들이 새로운 협력 분야에 활용되거나, 새로운 조약이 체결되는 등 국제법 기반이 변화될 수 있다. 물론 한국과 어느 발트국가 사이에는 양자간 조약이 체결되기도 한다. 양측의 협력은 기존 국제법 근거를 활용하거나 그 기능을 재발견하면서 수행될 수 있다. 예를 들어, 비경제 분야로 인식되었던 노동과 환경이라는 분야는 경제 분야와 연결되어 관련 FTA 규정을 활용하여 규율과 협력을 확대/발전시킬 수 있는 것이다. 이러한 논제들에 관하여 기존 한-EU 조약에 근거하여 대응 방안을 찾아야 한다. 한국과 발트3국의 양자간 조약의 수와 분야들이 아직 많지 않다는 점에서, 이들의 관계는 여전히 한-EU 차원의 조약에 많이 의존하고 있다. 그러나 이러한 양자간 조약의 현실이 오히려 향후 3국의 개성이 투영된 한국과의 개별적인 조약이 확대되기를 기대하게 만든다.

영어초록

The Baltic states emerged as independent states in the international community and became subjects of international law. Multilateral international norms at the UN or WTO level, in which Korea and the Baltic countries participate, are subject to various discussions due to the emergence of new topics, and depending on the results, the conclusion of new treaties or changes to existing treaties may occur. As the relationship between the two sides develops in various ways at the level of Korea and the EU, the basis of international law may change, such as existing treaties being used in new areas of cooperation or entirely new treaties being concluded. New treaties for new cooperation are sometimes concluded. Cooperation between the two sides may be carried out by utilizing existing legal foundations or rediscovering their functions. The fields of labor and environment, which were recognized as non-economic fields, are connected to the economic field and can develop discipline and cooperation by utilizing related FTA regulations. Given that the number and areas of bilateral treaties between Korea and the Baltic countries are still limited, their relationship still relies heavily on treaties at the Korea-EU level. However, the reality of these bilateral treaties makes us expect that individual treaties with Korea that reflect the individuality of the three countries will expand in the future.
