초록

최근 대법원은 코로나19 팬데믹 시기에 광주광역시장이 관내 종교 시설에 대해 내린 대면예배 금지 처분이 종교의 자유를 침해하지 않으며, 평등의 원칙 위반도 아니라고 판결하였다(대법원 2024. 7. 18. 선고 2022두43528 전원합의체 판결). 이 판결은 종교의 자유에 대한 우월적 지위를 인정하지 않는 대법원의 종래 입장을 그대로 답습하였다. 한편 헌법재판소는 일반적․중립적 법규제에 대한 종교적 면제를 불허하고 있고, 그러한 종교적 면제 입법을 정교분리 위반으로 보는 입장을 취하고 있다. 반면에 미 연방대법원은 주정부가 코로나19 방역을 이유로 종교 시설에 대해 내린 대면예배 금지 조치가 종교의 자유를 침해한다고 판결하였다[S. Bay United Pentecostal Church v. Newsom, 140 S. Ct. 1613 (2020)]. 이처럼 동일한 사안에 대해 상반된 판결이 내려진 원인은 미국에서는 종교의 자유에 대한 우월적 지위를 인정하여 다른 헌법상 권리에 적용되는 위헌심사기준보다 더 엄격한 기준을 적용하고 있기 때문이다. 아울러 미 연방대법원은 일반적․중립적 법규제에 대한 종교적 면제 입법에 대해서 합헌으로 판단하고 있다. 한편 미 연방대법원은 1990년에 Employment Division v. Smith 판결을 통해 일반적․중립적 법규제에 대한 종교실행의 자유 침해 심사에 있어서 엄격심사기준을 포기하였지만, Smith 판결에 반발한 미 연방의회는 「종교의 자유 회복법(RFRA)」을 제정하여 일반적․중립적 법규제로 인해 종교의 자유에 실질적인 부담이 발생한 경우에 대해서도 엄격심사기준 적용을 복구하였으며, 종교의 자유 보호가 형해화되지 않도록 소송 제기권, 항변권, 손해배상 청구권을 보장하였다. 종교의 자유는 표현의 자유와 함께 입헌주의 국가에서 가장 중요한 정신적 자유권 중 하나이다. 종교의 자유에 대해서도 표현의 자유와 동일하게 우월적 지위를 인정하고 다른 자유권보다 더 엄격한 심사기준을 도입하는 것이 타당하다. 이를 위해서 미국과 유사한 「종교의 자유 보호법」의 제정이 필요하다. 「종교의 자유 보호법」을 입법하여 종교의 자유를 침해하는 법령이나 공권력의 행사로 인해 기본권을 침해당한 당사자가 「종교의 자유 보호법」에 따른 구제 수단을 활용하도록 한다면, 종교의 자유를 침해하는 법령과 관행, 그리고 공권력의 행사를 획기적으로 개선하는 효과를 가져올 수 있을 것이다. 현재의 상태로는 우리나라가 정신적 기본권에 대해 두터운 보호를 제공하는 민주주의 선진국의 대열에 합류하기는 어렵다. 이러한 맥락에서 「종교의 자유 보호법」의 입법은 시급하다. 헌법이 국가에 부여한 기본권 보장 의무에도 부합하며, 기본권 최대 보장 원칙의 측면에서도 입법의 정당성이 인정된다.

영어초록

Recently, the Supreme Court of Korea held that the Gwangju Metropolitan City Mayor's ban on indoor worship services at religious facilities during the COVID-19 pandemic did neither infringe on religious freedom nor violate the principle of equality (Supreme Court of Korea, July 18, 2024, 2022Du43528, En Banc Adjudication). This ruling simply followed the Korean Supreme Court's previous position of not recognizing the preferred position of religious freedom. The Constitutional Court of Korea also takes the position that religious exemptions from neutral laws of general applicability are not permitted, and that such religious exemption legislation violates the separation of church and state. On the contrary, the U.S. Supreme Court held that the state government’s ban on indoor worship services at houses of worship for the purpose of preventing the spread of COVID-19 infringed on religious freedom[S. Bay United Pentecostal Church v. Newsom, 140 S. Ct. 1613 (2020)]. The reason for such conflicting rulings on the same issue is that the United States recognizes the preferred position of religious freedom and applies the stricter standard of review to religious freedom than those applicable to other constitutional rights. In addition, the U.S. Supreme Court has held that the legislation for religious exemptions from the neutral laws of general applicability is constitutional. Meanwhile, in 1990 the U.S. Supreme Court, in the Employment Division v. Smith case, abandoned the strict scrutiny standard for reviewing whether a neutral law of general applicability infringe on the freedom of religious practice. However, in response to the Smith, the U.S. Congress enacted the 「Religious Freedom Restoration Act (RFRA)」, which restored the application of the strict scrutiny standard even to cases where neutral laws of general applicability cause a substantial burden on religious freedom, and guaranteed the right to file a lawsuit, the right to defend, and the right to seek damages to prevent the protection of religious freedom from being undermined. Freedom of religion, along with freedom of expression, is one of the most important spiritual freedom in a constitutional state. It is reasonable to recognize the same preferred position for freedom of religion as freedom of expression and adopt stricter standards of review for freedom of religion than other freedoms. To this end, it is necessary to enact a 「Religious Freedom Protection Act」 similar to RFRA of the United States. If the 「Religious Freedom Protection Act」 is enacted so that people whose fundamental rights have been violated due to laws or the exercise of public power that infringe on religious freedom can utilize the means of relief under the 「Religious Freedom Protection Act」, it will have the effect of drastically reforming laws, practices and the exercise of public power that infringe on religious freedom. In its current state, it is difficult for South Korea to join the ranks of advanced democratic countries that provide strong protection for spiritual fundamental rights. In this context, the enactment of the 「Religious Freedom Protection Act」 is urgent. It is in line with the obligation to guarantee fundamental rights imposed on the government by the Korean Constitution, and the legitimacy of the legislation is acknowledged in terms of the principle of maximum guarantee of fundamental rights.
