초록

대상 판결은 어린이집 평가등급 결정의 처분성을 인정하면서, 해당 결정을 평가대상 어린이집에 개별적으로 문서나 전자문서로 통보하지 않고개별 법령에 따라 홈페이지에 공표한 것이 행정절차법 제24조 제1항에규정된 문서주의에 위반되지 않는 것으로 판단하였다. 즉, 원심 판결이해당 결정에는 처분의 형식을 문서로 하지 않은 하자가 있어 무효라고 본것과는 달리, 대상 판결은 해당 결정을 공표하도록 규정하고 있는 영유아보육법 등의 규정이 행정절차법 제24조 제1항에 규정된 소위 문서주의의예외인 “다른 법령 등에 특별한 규정이 있는 경우”에 해당한다고 보았다.
대법원은 행정 내부의 중간적 행정결정에 대해 과거와 달리 분쟁을 조기에 근본적으로 해결하기 위하여 쟁송법적 처분으로 보거나 실체법적처분으로서 확인적 행정행위에 해당한다고 보아 처분성을 인정하고 있다. 이 사건 평가등급 결정도 후행 처분인 공공형어린이집 선정취소처분의 전제가 되고 있다는 점에서 중간적 행정결정의 외형을 가지는데, 그자체로 국민의 권리 의무에 직접적 영향을 미치는 것으로서 처분성이 인정된다.
행정절차법 제24조 제1항의 문서주의 원칙은 처분 내용의 명확성을 확보하고 처분상대방의 권익을 보호하기 위한 것이다. 행정절차법은 문서주의 원칙을 강하게 고수하면서 예외적으로만 전자문서나 구술, 기타의방법을 인정하고 있는데, 판례도 그러한 예외의 인정을 상당히 엄격하게판단할 뿐만 아니라 문서주의를 위반한 경우 중대 명백한 하자로서 무효로 보고 있다. 이러한 엄격한 해석은 처분이 국민의 권익에 미치는 영향이 크다는 점을 고려한 것이지만, 처분의 명확성이나 상대방의 절차적 기회가 침해되지 않았음에도 불구하고 문서주의 위반으로 보거나 위반의유형이나 정도를 따지지 않고 원칙적으로 무효로 보는 것은 타당하지 않다. 또한 새로운 형태의 처분이 계속 등장하고, 전자화 디지털화가 급속도로 진행되며, 인공지능과 스마트행정의 발달로 행정환경이 빠르게 변화하고 있는 현 시점에서 다양한 처분 형식을 활용할 있도록 있는 행정절차법 규정의 재정비가 필요하다. 이와 관련하여 전자문서 및 그 밖의 처분형식을 서면과 대등하게 규정하고 있는 독일 연방행정절차법 규정이참고가 될 수 있을 것이다.
그리고 처분 개념의 확대와 관련하여 고려되어야 할 것은 법원이 소송단계에서 처분성을 확대하여 인정하는 경우, 행정청이 해당 처분을 할 당시에는 처분절차를 거치지 않았을 가능성이 높으므로 절차적 하자로 인하여 항상 원고가 승소하는 불합리한 결과가 발생할 수 있다는 점이다.
이는 행정소송법상 처분 개념과 행정절차법상 처분 개념이 동일하게 규정되어 있는 데에서 비롯된다. 현행법상으로는 새롭게 인정되는 처분에있어 행정절차법 제24조 제1항에서 인정하고 있는 예외인 “다른 법령 등에 특별한 규정이 있는 경우”를 탄력적으로 넓게 해석하여 처분 절차의대상이 아니라고 보는 방법이 유용한 해결책으로 생각된다. 그리고 입법론적으로는 확대된 처분개념과 행정절차법상 처분절차 간의 관계를 고려한 행정절차법의 개정이 필요하다.

영어초록

The subject judgement(hereafter “judgement”) concluded that announcing such decisions on the website, without individually notifying the concerned kindergartens through documents or electronic documents, does not violate the principle of documentation mandated by Article 24, Section 1, of the Administrative Procedures Act. The judgement considered the regulations of the Child Care Act which stipulates the announcement of such decisions, as an exception to the principle of documentation.
The Supreme Court has gradually broadened the concept of dispositions under administrative litigation law. Especially for intermediate administrative decisions, they can be recognized as dispositions in order to fundamentally resolve disputes early on. The decision on the evaluation grade is seen as having an intermediate administrative decision form. However, the decision itself also directly affects citizens’ rights and obligations, thus it can be recognized as a disposition.
The principle of documentation in Article 24, Section 1, of the Administrative Procedures Act aims to ensure the clarity of the disposition and protect the rights of those subject to the disposition. While the Administrative Procedure Act strongly adheres to the principle of documentation, allowing electronic documents, oral communication, or other methods only exceptionally, case law also strictly judges the recognition of such exceptions and considers the violation of the principle of documentation as a significant and clear defect. This strict interpretation considers the significant impact of dispositions on citizens' rights, but it is not reasonable to deem dispositions invalid for violating the principle of documentation or to invalidate them without considering the type or degree of violation. Moreover, with the continuous emergence of new forms of dispositions, rapid progress in digitalization, and the development of artificial intelligence and smart administration, it is necessary to reorganize the provisions of the Administrative Procedure Act to utilize various forms of dispositions. The provisions of the German Federal Administrative Procedure Act could serve as a reference in this regard.
Regarding the expansion of the disposition concept, it is crucial to consider that if courts newly recognize a administrative decision as a disposition at the litigation stage, it might result in irrational outcomes where plaintiffs always win due to procedural errors. This issue stems from the alignment of the concepts of disposition in both Administrative Litigation Law and the Administrative Procedures Act. A flexible and broad interpretation of the exception in Article 24, Section 1, of the Administrative Procedures Act, as “special provisions in other laws,” could serve as a practical solution.
Although the judgement specifically discusses this exception, it also implicitly considers preventing irrational outcomes. Legislatively, an amendment to the Administrative Procedures Act, taking into account the expanded concept of disposition and the procedures, is necessary
