노아 언약과 두 나라 이론에 비추어 본 세속의 정치공동체와 법의 성경적·신학적 의의 (The Biblical and Theological Significance of the Secular Political Entity and Law in Light of Noah Covenant and the Two Kingdoms’ Theory)

초록

본고의 연구는 세속의 정치공동체와 법의 존재 및 기능을 성경적으로 또한 신학적으로 정당화하기 위한 시도이다. 세속의 정치공동체는 노아언약을 통해 베풀어지는 하나님의 보존적 은혜를 입고 있으며, 이를 위해 존재하고 일정한 역할을 부여받는다. 따라서 세속의 공동체가 정치와 법을 통하여 ‘구속적 통치’ 혹은 ‘구원의 복’을 구현하는 것은 불가능하며, 이를 시도하는 것은 자신의 본질과 목적에 부합하지 않을 뿐 아니라, 경우에 따라서 교만의 죄를 범하는 것일 수 있다. 국가와 법이 달성할 수 있는 도덕적 달성은 결코 ‘최대’가 아니고, 응보적 정의, 사회의 유지와 존속에 요구되는 수준 정도이다. 이러한 점에서 국가의 법과 제도를 통하여 그 이상의 도덕적 목적, 이를테면 거룩과 성결의 수준을 달성하고자 하는 것은 그 본령에 부합하지 않는 것이 된다. 바로 여기에 ‘기독교적 국가’ 혹은 ‘기독교 정치’의 이상이 내용적 및 수단적 측면에서 견지하여야 할 한계가 있다.
노아언약에 대한 이러한 해석은 개혁신학의 두 나라 이론이 주는 통찰과도 부합하는 것인데, 이 이론은 죄로 인한 타락 이후 일반은혜에 의해 보존되는 창조질서에 기반하여 개혁신학적 사회사상을 정초한다. 무엇보다도 비폭력적인 그리스도의 나라와 칼을 지닌 강제적 국가 사이를 뚜렷하게 구별하고, 각각이 행사할 수 있는 권한과 권력을 한계를 분명히 한다는 점에 그 큰 의의가 있다. 또한 모든 사람에게 있는 양심은 하나님께서 새겨놓으신 법을 증거하고 있으며, 이러한 보편적이고 일반적인 법은 그리스도인과 비그리스도인이 공유하는 공통성에 해당한다. 이러한 공통의 토대 위해서 그리스도인과 비그리스도인은 정의롭고 선한 것을 추구할 수 있으며 문화적 탁월성을 성취할 수 있다. 특히 종교의 자유를 수용하고 국가-교회를 부인하는 오늘의 다원적 사회에 있어서 개혁신학 전통의 두 나라와 자연법 이론은 세속의 정치공동체인 국가의 법을 신학적으로 이해하도록 하는데 적합한 체계와 개념을 제공한다.
세속의 정치공동체를 바라보는 노아언약에 대한 해석과 개혁신학의 통찰은 법학의 영역에서 이루 어지는 법의 기능에 대한 고찰과도 공명하는 것이어서, 세속법에 대한 법신학적 이해를 더욱 명쾌하고 풍부하게 한다. 형법의 영역에서 이루어지는 법의 기능에 관한 논의, 즉 그 기능이 사회윤리규범을 보호하는데 있는지 아니면 법익에 대한 침해로부터 개인을 보호하는데 있는지의 문제는 세속 국가의 역할을 적극적으로 부여하면서 또한 소극적으로 한계지우고 있다. 인간의 타락한 본성의 작용을 억제하기 위한 법의 적극적 역할이 분명히 있으나, 법을 통해 타락한 본성을 정화하거나 인간을 구속하는 것은 불가능하다. 즉, 국가의 역할과 작용은 일반적 은총의 영역에서의 보존과 유지에 머무를 수밖에 없는 것이다. 형법학계의 논의도 사회윤리보호 기능에 치우치려는 경향을 차단하고 법익보호 기능을 통하여 그 세속성을 유지하기 위해 한계를 세우고자 하는데, 이는 노아언약의 성경신학적 함의와 두 나라 신학의 개혁신학적 통찰과도 궤를 같이 하는 것이다. 비록 형법상 도덕·윤리적 성격을 갖는 여러 규범들은 하나님께서 모든 인간의 양심에 새겨놓으신 자연법과 대체로 일치하는 것이기는 하지만, 국가가 권력적 수단을 통하여 그 이행을 담보하고자 할 때에는 하나님과의 언약 차원에서 또한 공동체로부터의 위임 차원에서 분명한 한계를 준수하여야 한다. 만약 이러한 한계를 위반하여 권력을 행사한다면 그 권력을 위임한 해당 공동체의 구성원에 대해서 뿐 아니라 궁극적으로는 하나님 앞에서 책임을 져야 할 것이다.

영어초록

This study is an attempt to justify the existence and function of secular political entities and laws both biblically and theologically. The secular political entities is blessed with God's preserving grace, which is given through the Noah covenant, and is given a certain role. Therefore, it is impossible for secular entities to implement “redemption or salvation" through politics and law, and attempting to do so is not only inconsistent with their nature and purpose, but in some cases, they may commit the crime of arrogance. The moral achievement that the state and law can achieve is by no means "maximum", but at the level required for retributive justice, maintenance and survival of society. In this respect, it is not in accordance with its nature to achieve a higher moral purpose, such as the level of holiness and purity, through secular laws and institutions. This is a limitation where the ideal of ‘Christian State' or 'Christian Politics' must keep.
This interpretation of the Noah covenant is also consistent with the insights given by the Two-Kingdoms’ theory of Reformation Theology, which establishes social thoughts based on the creation order preserved by Common Grace after corruption caused by sin. Above all, it is of great significance in that it distinguishes between the nonviolent Kingdom of Christ and the forced state with a sword, and clarifies the limits of the powers each can exercise. In addition, every human’s conscience proves the law that God has engraved, and these universal and general laws correspond to the commonness shared by Christians and non-Christians. For this commonness, Christians and non-Christians can pursue the just and good, and achieve cultural excellence together. In today's pluralistic society, which embraces religious freedom and denies state-church, the Two Kingdoms’ and the Natural Law Theory of Reformation Theology provide a framework and concept suitable for theological understanding of the secular laws and political entities.
The interpretation of Noah's covenant and insight into the secular political community resonate with considerations of the function of laws, further clarifying and enriching the legal and theological understanding of secular laws. The discussion of the function of the law in the field of criminal law, that is, whether its function is to protect social and ethical norms or individuals from infringement of legal interests, is granting the role of a secular state and also limiting it. There is clearly an active role of the law to curb the action of the fallen nature of man, but it is impossible to purify the fallen nature or redeem men through the law. In other words, the role and action of the state is bound to remain preserved and maintained in the realm of General Grace. Discussions in criminal law academia also want to set limits to maintain their secularity through legal interests protection, which is in line with Noah Covenant's implications and theological insights of the Two Kingdoms’ theology. Although various norms with moral and ethical characters under the criminal law are largely consistent with the Natural Law that God has engraved on all human conscience, when the state seeks to secure its implementation through power, it must comply with limitations in terms of a covenant with God and in terms of delegation from the community. If you exercise power in violation of these limits, you will have to take responsibility not only for the members of the community who delegated that power, but ultimately before God.
