북극해 영유권 갈등의 정치학: 동아시아 지역에 주는 시사점 (Politics of a Conflict Regarding Sovereignty in the Arctic Ocean: Implications to the East Asia)

초록

본 본문은 북극권 지역에서의 영유권 갈등과 관할권 해결 문제를 논의하고 있다. 북극의 해빙이 가속화되면서 북극해에서의 갈등 양상은 북극권 8개국을 포함하여 중국과 영국까지 가세하는 등 국가 간 각축이 더욱 심화되고 있다. 이에 본 논문은 북극해의 영해갈등이 아･태지역에서의 영해 갈등과 어떤 차이와 유사점을 지니는 지를 살펴 갈등 해결의 가능성을 탐색하는 데 연구 목적이 있다. 영유권과 관할권 갈등은 국제레짐(international regime)을 통한 규범적 해결의 가능성과 한계는 무엇인지를 논의한다. 이에 북극해 영유권 갈등의 해결 모델서 1920년 체결된 ‘스발바르조약(The Svalbard Treaty)’이 지닌 의의를 검토한다. 당초 14개 국가들 간에 체결된 이 조약은 북극 스발바르 제도를 비무장지대로 설정하고 노르웨이의 자치권을 인정하지만, 노르웨이 법률 전체가 적용되지 않는다는 내용을 점을 담고 있다. 따라서 현재 44개국에 이르는 모든 서명국은 군도에서 평등하게 경제 활동을 할 권리를 지닌다. 2012년 노르웨이와 러시아는 이 권리를 행사하였다. 스발바르 제도 사례는 동아시아 지역의 영유권 갈등에 대한 적지 않은 시사점을 제공한다. 러시아와 노르웨이는 40년 간 이뤄진 협상과정에서 상호 신뢰를 축적하였으며, 그 결과 공동의 이해를 도출할 수 있었다. 즉, ‘공동 이익의 딜레마(dilemma of common interests)’를 통한 해결이 이뤄진 것이다. 반면 최근 남중국해에서는 중국, 베트남, 필리핀 등 관련국 간 영유권 분쟁을 넘어 해로이용의 자유와 동맹국의 군사개입 등을 둘러싼 미국과 중국 간의 갈등으로 전개되고 있다. 요컨대 본 논문은 북극지역 영유권 갈등의 협력적 변화 모델로서 ‘스발바르조약’은 북극권 지역의 여타 영유권 갈등해결의 기준이 될 것으로 전망한다. 그리고 아･태지역의 영유권 갈등 해결을 위한 참고 모델이 될 것으로 보고 있다.

영어초록

In this study, a conflict regarding the sovereignty and jurisdiction in the Arctic Circle and its solutions are discussed. Due to the accelerated melting of Arctic sea ice, a conflict in the Arctic Ocean between eight countries in the Arctic Circle as well as China and the UK is being more intensified. Therefore, the purpose of this study is to explore the possibility to resolve such conflicts by reviewing the differences and similarities between the conflict regarding the territorial waters in the Arctic Ocean and the conflict regarding the territorial waters in the East Asia. For the conflict regarding sovereignty, the possibility of a normative resolution through international regime and its limitations are discussed. Therefore, the significance of the Svalbard Treaty concluded in 1920 is reviewed for the settlement model of the conflict regarding sovereignty in the Arctic Ocean. This Treaty, which was originally concluded by 14 countries, contains the contents indicating that Svalbard in the Arctic Ocean is demilitarized and the autonomy of Norway is acknowledged but the entire Norwegian law does not apply. Therefore, all 44 signatories have the right to conduct economic activities equally in the Svalbard archipelago. Norway and Russia exercised this right in 2012. The case of Svalbard archipelago provides significant implications for the conflict regarding the territorial waters in the Asia Pacific region. Russia and Norway have accumulated mutual trust through negotiation processes over 40 years, and as a result, they were able to draw common interests. In other words, the conflict was settled through the dilemma of common interests. On the other hand, the conflict regarding the sovereignty between relevant countries including China, Vietnam, and the Philippines in the South China Sea has been developed into a conflict between the U.S. and China regarding the freedom to use the sea routes and the military intervention by allies. In short, it is expected in this study that the Svalbard Treaty will be a standard for the settlement of the conflict regarding sovereignty in the Arctic Circle as a collaborative change model for the conflict regarding the sovereignty in the Arctic region. In addition, such model will become a reference model for the settlement of the conflict regarding the sovereignty in the Asia Pacific region.
