통일 전후 동서독 보험제도의 통합이 현재의 개성공단 보험보호에 주는 시사점 연구 (Unification of Insurance Industry in East and West Germany 20 years ago Implicates Some Lessons to the Current Gaesong Industrial Complex)

초록

본 연구는 20년 전 동서독 보험제도의 통합과정을 분석하고, 동서독경협보험의 역할을 살펴보고 현재의 우리나라 개성공단에 주는 시사점을 연구한다. 문헌연구를 통한 서술적 연구방법론(descriptive study method)과 개성공단 입주기업과 보험회사와의 면담방법을 사용한다.
독일 통일과 더불어 동서독 보험감독법(VAG)이 통합되었다. 독점시장에서 경쟁시장으로 전환되었으며, 동서독 민영 합작보험회사가 설립되었다. 그러나 통일 전에 동서독 보험권의 인적 및 정보의 사전 교류가 전혀 없었다. 동독 국영 보험회사는 합작 보험회사로 재탄생되어 생존하게 되었지만, 생산성을 높이기 위해서 강도 높은 구조조정이 실시되었다. 또한 대대적인 서독의 자본투입이 필요하였다. 합작 전 보험계약의 보험사고에 대해서 서독 정부가 지급보증한 사례는 현재의 개성공단에 주는 중요한 시사점이다.
개성공단은 남북 경협의 상생모델이다. 개성공단 입주기업들의 약 90% 이상이 북한의 정칙적 위험을 보장하는 경협보험에 가입하고 있다. 그러나 화재보험의 가입률은 5%로 매우 낮다. 개성공단에서는 북측 KNIC보험회사만 보험사업을 할 수 있으며, 북측은 남측 보험회사의 진입을 허용하지 않고 있다. 북한은 보험사업을 달러벌이 수단으로 여기고 있기 때문이다.
결론적으로 20년 전의 동서독 보험제도의 통합 경험은 현재의 개성공단에 훌륭한 모범사례이다. 특히, 서독 정부가 특별계정에서 동독 구계약 보험금을 지급한 사례, 구동독기업의 지급불능위험을 독일 정부가 보장한 사례는 현재의 개성공단에 주는 시사점이 매우 크다. 개성공단에서의 화재보험 미활성화, 자동차보험의 이중가입 문제는 입주기업이나 남측 보험회사가 해결할 수 없으므로 보다 적극적인 정부의 역할이 필요하다. 개성공단에서 북측 KNIC 보험회사의 지급신뢰도 문제를 해결하기 위하여 정부는 북측과 계속 협의해야 하지만, 20년 전 동서독 사례와 같이 KNIC의 지급불능위험을 정부가 지급보장하는 방안을 고려할 필요가 있다.

영어초록

This paper attempts to find out implications to the current Gaesong Industrial Complex(GIC) based on the analysis of unification of insurance industry and inter-Germany economic cooperation insurance in East and West Germany 20 years ago. This study uses a descriptive research methodology in order to find a new fact from the review of related literatures. And an interview conducted by some companies of Gaesong Industrial Complex(GIC) and the insurance specialist is also used.
The insurance law of est and west Germany was combined with a german unification. The monopolistic market was changed into the competitive market and a private east-west joint-venture insurance company was established successfuliy. But there are no insurance information and personal exchange between East and West Germany before the unification The new joint-venture insurance company conducted massive layoffs as part of restructuring.
Allianz insurance company had to provide large-scale capital into a new joint-venture insurance company. The new unified german government provided a payment guarantees to the insurance claims of past days. It indicates a important roll of government.
Gaesung Industrial Complex is a model case and a challenge to form a Korean exonomic community by combining South Korea‘s capital and technology with North Korea‘s labor force. Over 90% of Gaesong Industrial Complex‘s companies buy Inter- Korean economic cooperation insurance, which covers political risk of North Korea. But only 5% of them insure there‘s property against fire and it is a big problem. Korea National Insurance Company(KNIC) of North Korea is a a monopolistic enterprise and did not permit entry of South Korea‘s insurance company in Gaesong Industrial Complex.
In conclusion, the experience of unification of insurance industry and inter-Germany economic cooperation insurance in East and West Germany 20 years ago is a excellent best practice for Gaesong Industrial Complex. The following points should be emphasized. The Government have to talk about to solve the problem of Korea National Insurance Company's confidence in Gaesong Industrial Complex. It would be worth consideration that government would provide a payment guarantees in case of inability to pay of Korea National Insurance Company. It indicates a important roll of government like a case of 20 years ago in Germany.
