해양법협약상 심해저 활동의 독과점 금지 규정 이행의 한계 (A Study on the Scope of Applicability of Anti-Monopoly Provision under the International Seabed Regime)

초록

국제통상과 관련되지 아니한 조약에 반독과점 규정이 명문화되어 있는 경우는 흔치 않는데, 해양법협약의 심해저 제도에 그러한 규정이 포함되어 있다. 이러한 규정은 일반적인 시장거래 독과점과 의미가 다른 생산지 점유 독과점 방지 규정으로 1970년대 기술과 자본을 갖추어 심해저 광물자원이 이용 가능하였던 미국이 품위와 매장량이 높은 광구를 독차지 하는 것을 견제하기 위하여 탄생한 것이다.
비록 미국이 해양법협약을 비준하지 아니하였으나 영국에 자회사 설립을 통하여 최근 두 건의 망간단괴 탐사신청을 하였고, 캐나다 노틸러스사는 개발도상국에 자회사 설립을 통하여 두 건의 망간단괴 탐사신청, 심해저공사와의 합작 제의를 통하여 망간단괴 유보광구 탐사제안서 제출 등 단일 주체의 복수광구 신청이 발생하고 있어 독과점화가 불가능하지 않게 되었다. ISA는 그러나 이러한 신청에 대해서 ‘독과점화’를 이유로 이들 신청을 거부하거나, 이 후 추가적인 반독과점 상세규정 개발을 실제 시도하지 아니하였다. ISA 회의에서는 비탐사국들이 반독과점 포괄적 규정의 추가, 상세규정 개발 제안, 독과점 정의의 명확화 제안 등 이 규정의 추가 개발을 시도하였으나, 탐사면허를 가진 당사국들의 동의를 이끌어 내지는 못하였다.
이 논문은 중요 자원개발국의 ISA 참여율을 저해하지 아니하기 위하여 반독과점의 상세조치 개발이 미뤄진 것이 해양법협약 심해저 제도의 기본원칙인 인류 공동의 유산 원칙에 위배되는 것인지를 규명하였다.
인류 공동의 유산 원칙은 행위의 의무이며 이 원칙을 실현하기 위한 구체적 이행 조치 중 하나인 반독과점 원칙도 행위의 의무이므로, 독과점 여부를 결정할 정의조차 개발되지 아니한 것은 인류 공동의 유산 원칙을 충실히 이행하지 아니하는 것이라 할 수 있다.

영어초록

It is a rare case that a public international law besides international trade law deals with anti-monopolization. The Law of the Sea Convention which provides comprehensive rules to govern the entire ocean affairs includes a provision on anti-monopolization in particular of seabed mining activities in the Area. This provision focuses on the prevention of concentration of exploration areas allocated to one entity while trade law in general prevents monopolization of market transactions by one entity. This provision was proposed during the third conference on the Law of the Sea held in 1970's and 1980's to prevent monopolization of seabed activities by USA which was then the only State with financial and technical capacities to explore and exploit the seabed resources.
Although USA has not ratified the LOSC yet, it has involved in the seabed activities in the Area and recently one of its mining companies has applied for exploration of manganese nodules through establishment of a subsidiary in a member State of the LOSC, UK. Nautilus Minerals Inc. which is a Canadian company has attempted three times to apply for reserved areas. None of these applications were rejected for the reason of anti-monopolization by the International Seabed Authority(ISA).
Within the ISA, the comprehensive provisions on anti-monopolization attempted to be elaborated, a provision referring to anti-monopolization was suggested to be included in the Regulation for exploration of the manganese nodules, and monopolization was proposed to be defined. However, these attempts have not resulted in adoption of a detailed rules on anti-monopolization since participating states to exploration did not agreed to further develop it.
This paper reviewed whether delay of elaboration of the anti-monopoly provision not to derogate interests of major mining States is a breach of the concept of the common heritage of mankind. This paper confirmed that the concept as well as the anti-monopoly provision is the obligations of conduct rather than result. Thus, the fact that the anti-monopoly provision has not been elaborated by objections of mining States proves that the concept of common heritage of mankind has not been elaborated diligently.
