초록

이 글은 경찰대학 설립의 배경과 취지를 살펴보고, 경찰대학 존폐론의 내용과 의미를 분석 및 평가하고 있다.
경찰대 존폐론은 경찰대의 학사과정 존폐론이다. 치안대학원을 유지하자는 점에 대해서는 다툼이 없기 때문이다. 경찰대 존치론은 경찰대 학사과정 존치론인데, 정확히말하면 경위공채시험 도입론이다. 이에 대해서는 시험의 방식이 논란이 될 수 있고, 우수인재 유치에 어려움이 발생하여 경찰대 설립 취지에 어긋날 가능성이 있으며, 더욱이 경찰대 졸업생의 로스쿨로의 이탈을 더욱 가속화시킬 우려가 있다.
경찰대 폐지론은 경찰대 학사과정 폐지론이다. 승진적체론, 고위직독점론, 특혜론, 상황변화론, 조직이탈론 등이 이에 해당한다. 이 가운데 경찰대 졸업생의 다수가 로스쿨로 진학하는 상황은 경찰대 존립에 위기가 될 수 있다. 경찰 조직을 위해 선발한 경찰대 졸업생의 대다수가 경찰 조직을 떠나서 비경찰조직에서 일한다면 경찰대가 존재할 이유가 없기 때문이다. 이런 점에서 경찰대 졸업생의 경찰 조직 이탈 상황과 이탈했던 경찰대 졸업생이 다시 경찰 조직으로 회귀하는 상황에 대한 공개와 정확하고 면밀한 실태 분석 및 그 이유가 밝혀져야 한다고 본다. 만일 조직이탈론이 타당하여 경찰대 학사과정이 폐지되어야 한다면 예컨대 5급 공무원 공채시험에 경찰직을 신설하여이를 대체하는 우수 인재를 경찰조직이 확보할 수 있도록 하는 방안이 조직의 발전을위해 마련되어야 한다
