본 논문은 실무적 중요성이나 우리 안보현실과의 직접적 연관성에도 불구하고 국내 학계의 주목을 받지 못해온 UN 금융제재의 실태, 효과 및 쟁점 등에 대해 논의한다. 첫째, 외교적 목표를 달성하기 위해 사용되는 금융제재의 연혁 및 기본적인 메커니즘을 살펴보고 교역금지 등 일반적 경제제재수단과의 차이점을 부각한다. 둘째, 단편적으로 부각되어 온 금융제재의 효력 및 취약점에 대한 연구성과를 정리하여 실제 금융제재조치가 그 명성에 걸맞은 성과를 거두고 있는지를 고찰한다. 셋째, 금융분야의 제재수단이 성공하기 위해서는 어떠한 여건이 만족되어야 하는지를 살펴보고 다양한 이해당사자간 타협문제는 어떻게 쟁점화되고 있는지를 분석한다. 이를 위해 UN 안전보장이사회의 결의안 등 1차 문헌을 분석하고 서구 학계의 논의 등 2차 문헌을 검토하는 한편, 미국 패터슨연구소의 데이터를 활용하여 대테러․WMD 비확산 관련 금융제재의 빈도 및 효과를 추정하였다. 이를 통해 그간 언론보도에 치중되어 온 UN 금융제재에 대한 국내의 논의를 보완하고 UN 금융제재에 대한 종합적인 이해를 모색하는 데 목적이 있다.

영어초록

Financial sanctions have increasingly taken on important roles in addressing global security problems such as terrorism and WMD proliferation. This article surveys the field of financial sanctions in pursuit of these security goals, especially those employed by the United Nations, by looking into their evolution, impact, and outstanding issues. In so doing, it seeks to highlight the underlying conditions for a successful implementation of such sanctions and elicit some useful lessons for dealing with the current North Korean nuclear issues. First, it illustrates modern-day financial sanctions mechanics in the United Nations Security Council with episodes from existing sanctions committees on Al-Qaeda (1267 Committee) and Iran (1737 Committee). It focuses on why the targeted sanctions regime came about and how it is different from traditional economic sanctions. Second, it evaluates the effectiveness of financial sanctions in terror and WMD related activities in theoretical as well as practical terms, utilizing the database developed by the Peterson Institute for International Economics. Given the low success score in the area, it looks into a recent example of US Treasury's sanction on Banco Delta Asia, often touted as an unexpected success, to suggest the potentials of such tools in the globalized finance. Finally, it lists some contentious political debates on the issue at the international level: legality of non-proliferation law; due process in the implementation of targeted sanctions. These areas are pointed out as the weak links that could endanger the proper functioning of financial sanctions regime at the United Nations. Against this backdrop, the article emphasizes the limitations of current financial sanctions policy to curb North Korea's nuclear ambitions and suggests some policy tools at South Korea's disposal, such as introducing the specific 'asset-freeze' clause in its legal framework, to improve the situation.
