다문화사회의 헌법적 가치와 사회통합 (Constitutional value and social unification of multicultural society)

초록

현재 우리나라는 다문화사회에 대한 현상을 부정할 수 없는 상황이다. 학문영역에서도 법학, 사회학, 교육학 등에서 많은 연구의 실적물이 쏟아져 나오고 있다. 그럼에도 불구하고 여전히 다문화사회 혹은 이민사회에 대한 정책적 대안이 미비한 상태에 있다. 대표적으로 외국인근로자에 대한 이주노동정책, 결혼이주민에 대한 정책 및 그들의 가정이나 자녀에 대한 정책, 난민이나 탈북자에 대한 정책 등은 결국 안정된 사회질서를 유지하기 위한 사회통합이라는 국가의 목적이다. 결국 우리나라가 다문화사회에 있어서 추구하고자 하는 목적은 국가관을 비롯한 헌법적 가치에서 있다. 다양한 국가, 인종, 문화가 공존하는 과정에서 외국인의 문제로 둘러싸여, 급격한 사회변화를 겪고 있는 현재 우리나라는 이주민 사회통합을 위한 이민정책을 마련할 필요가 있다.
우리나라 다문화사회의 통합을 위한 법체계는 한국으로 입국하는 이주자를 인정하고 이들에 대한 전반적인 헌법적 가치질서를 실현하는 방향으로 발전시켜야 한다. 결국 이민사회 또는 다문화사회에 있어서 국가발전을 위한 사회통합은 다양성을 존중하며 수용성을 마련하는데 있다. 그리고 외국인정책이든 이민정책이든 다문화사회라는 사회적 개념을 갖고 입법이나 행정은 사회통합정책의 대상자들에 대한 헌법상의 보호규범적 가치가 분명히 정립되어야 한다. 국가발전이든 사회안정이든 국가목적으로서 사회통합은 이민정책과 다문화사회 정책이든 일부 중첩되지만, 다문화사회 정책은 정치적 및 경제적 공동체로서 외국이주민이나 그들로 형성된 가족만을 위한 것은 아니다. 즉 그것은 다문화 혹은 이민에 대한 바람직한 인식과 헌법적 가치가 반영되어야 하고, 그리고 나서 다문화사회에서의 정책대상인 재외동포를 포함한 재한외국인, 이주노동자, 결혼이주민으로서 다문화가족, 난민, 탈북자 등에 따른 실질적 정책이 마련되어야 한다.
국가는 법규범에서도 지향해야 할 통합적 이민정책을 마련되어야 하는데, 결국 다양한 문화적 배경을 가진 구성원들이 정치적 공동체 속에서 함께 공유해 나갈 때 국가발전을 위한 시회통합으로 자리매김할 수 있다. 우리나라는 앞으로 다문화사회의 정책에 대한 국민적 공감대의 형성이라는 법제도적 합의나 정책적 합의를 전제로 하지만 결국 이것 또한 국가의 기반이 되는 헌법적 가치질서에 부합해야 한다.

영어초록

The nation is now unable to deny the perception or phenomena of multicultural society. Achievements of studies in law, sociology, and education are pouring in in academic circles. Still, there is still a lack of policy alternative to multi-cultural societies or immigrant societies. All of these policies are aimed at maintaining a stable social order for foreign workers, such as foreign workers, policies for migrant migrants, policies on their families and policies, and policies for refugees and refugees. In the end, the aim of the nation's pursuit of a multicultural society should be rooted in the constitutional values, including the National Gallery. Currently, the nation needs a national policy for integrating migrant society with a rapidly changing social change, surrounded by foreigners ’ problems in the coexistence of various nations, races and cultures.
The legal system for promoting the social integration of multicultural societies should be developed to recognize the migrants entering Korea and realize the overall constitutional value of the nation. In the end, the purpose of social integration for the advancement of the state of society or multicultural societies should be supplemented from the perspective of enhancing the diversity of the nation's people. And with a social concept of a multicultural society or a multicultural society, legislation or administration should clearly establish the constitutional protection of the constitutional protection of the social inclusion policy. Social integration, or social stability, for national purposes, can be duplicated in part as part of a multicultural policy or policy, but the multicultural social policy does not necessarily mean a culture of cultural diversity and a family of foreigners, regardless of the diversity of culture. Whether it is a multicultural, or multicultural law, the proper perception or perception of multicultural families should be reflected in multicultural families, followed by foreign nationals, migrant workers, refugees, refugees, and refugees from multicultural families, including foreign nationals residing in multi-cultural societies.
Social integration can be achieved only by establishing models of multicultural models that should be pursued in our society or legal norms. Social members of the various cultural backgrounds can be positioned in a way that can contribute to the development of national development when combined within the community. The most important aspect of our approach to entering a multicultural society in the early stages is the formation of a national consensus on the model of multicultural society that we pursue in the future. Of course, the formation of a consensus is subject to legal consensus or policy agreement, but it must conform to the constitutional values of the constitutional values that form the foundation of the nation.
