이러닝(e-learning)의 법적 쟁점에 관한 소고 (A Study on the Legal Issues of E-Learning)

초록

이러닝은 단순한 산업적 측면을 넘어서서 「이러닝(전자학습)산업 발전 및 이러닝 활용 촉진에 관한 법률」을 비롯한 여러 관련 법률들에 의해 운영되고 있는 법적 제도라는 점에서 법적 시각에 근거한 검토가 필요하다. 이러한 점에 착안하여 본고는 헌법, 행정법, 저작권법, 약관규제법, 소비자보호법 등 다양한 관련 법분야와 연결되는 이러닝의 법적 쟁점들을 검토해 보는 데 그 목적이 있다.
총론적 검토로서, 이러닝은 헌법상ㆍ법률상 근거를 두고 있으며, 이를 바탕으로 몇몇 조항에서 구체적 권리성을 도출해낼 수 있음을 확인할 수 있다. 아울러 소위 이러닝 기본법 도입 여부에 관한 법제 정비방안도 검토할 필요가 있다.
각론적 검토로는, 먼저 지식재산권의 인정범위와 관련하여, 이러닝 사업자의 지식재산권 보호 및 교육 목적을 위한 타인의 저작권 제한 범위를 합리적으로 설정할 필요가 있다. 다음으로 소비자 권익보호와 관련하여, 이러닝 표준약관이 마련되어 있어 사업자와 소비자 모두에게 실익을 주고 있다. 마지막으로 품질인증과 관련하여, 이러닝 품질인증제도는 규제로서의 성격을 가지므로 융통성 있는 정책운용이 필요하며, 이러닝 사후심사의 강화, 이러닝 사업자에 대한 정당한 보상, 이러닝 공동활용의 확대 등 품질향상 방안을 강구해야 할 것이다.
향후 이러닝 관련 법제 정비, 이러닝과 관련된 공적 주체의 역할, 이러닝 사업자의 권리보호 범위설정, 이러닝 콘텐츠의 다양화와 질적 수준 향상을 위한 정책운영 등의 제반 과제에서 파생되는 다양한 법적 문제에 효과적으로 대처하기 위한 보다 진전된 법적 연구를 기대해 본다.

영어초록

E-learning is necessary to be analyzed from the legal point of view, because it is the legal institution that is regulated by some related legislations including the 「Act on the Development of E-learning Industry and the Promotion of the Utilization of E-learning」. This article is to review the legal issues of e-learning related with various legal branches, such as Constitutional Law, Administrative Law, Copyright Act, Deregulation of Standardized Agreement Act, Consumer Protection Act, etc.
On the general review: As e-learning has the constitutional and legislative grounds, we can ascertain that the concrete claim of rights is deduced by some above provisions. Also organizing e-learning related Acts and legal systems, accompanied with the introduction of the so-called Framework Act on E-learning, is required.
On the particular review: First, concerning the scope of application of the intellectual property rights, it is necessary to establish reasonable bounds about the protection of e-learning business operators’ property rights and the limitation on authors’ copyrights for the purpose of education. Second, concerning the protection of consumers’ rights and interests, as the standardized agreement of e-learning is already instituted, it is useful for both business operators and consumers. Third, concerning the quality certification, due to the e-learning quality certification having the nature of regulation, the application of the flexible policy is required. And the policy on improvement of service quality, such as the intensification of post evaluations, the proper reward to e-learning business operators, the enlargement of mutual utilization systems, etc, is necessary.
Hereafter, more advanced studies are anticipated to be introduced in order to effectively cope with the various legal issues derived from unsettled problems, such as the organization or verification of e-learning related legal systems, the role of governmental authority, the scope on the protection of e-learning business operators’ rights, the policy concerning the diversification of e-learning contents and the quality improvements.
