초록

전광석 선생님의 정년을 맞이하여 헌법학자로서 학문의 길을 되돌아보고 기본권 분야에서의 학문적 발자취를 기록해본다. 전 선생님은 헌법 원리와 실정법의 연결점으로서 기본권 이론을 전개하면서, 기본권이 국가 권력 발동의 근거이고, 실정법을 구현하는 기준이 된다는 이론을 헌법의 규범구조 및 법제의 현황과 발전 과정을 통해 역사적이고 체계적인 맥락에서 펼쳐 보여주셨다. 기본권의 진화적 성격과 기본권 보장의 상대성이라는 특성이 사회･세대･정치의 변화와 국민 가치관의 변화에 따라서 역동적으로 변화하는 헌법 해석으로 기능한다는 점에서, 살아있는 헌법의 면모를 여러 저술을 통해서 입체적으로 풀어내셨다. 자유권, 청구권, 참정권 등 기본권의 여러 분류 중에서도 사회적 기본권에 관한 많은 학술논문을 저술하셨는데 사회보장법의 대가로서 한국의 사회보장법학의 틀을 정립하신 만큼, 사회보장과 궤를 같이 하는 사회적 기본권의 헌법적 실현구조와 기능, 개정 방향을 면밀하게 제언해주시면서 국가목표로서 국민통합의 방향까지 연결시키셨다. 선생님의 업적을 통해 기본권 이론에 미치는 영향을 살펴보는 작업이 의미 있는 이유는, 선생님의 연구가 우리 헌법학의 기본권 이론의 발전에 끼친 공로를 기리게 되기 때문이고, 이러한 작업을 통해 제기되는 헌법적 쟁점을 고찰함으로써 후학들의 헌법에 대한 이해를 깊게 하는데 기여할 수 있기 때문이다.

영어초록

Let's look back on the academic path that Professor Cheon has taken and record the academic footprints in the world of fundamental rights that he has achieved. Professor Cheon develops the theory of fundamental rights as a connection point between constitutional principles and positive law, and explains the theory that fundamental rights are the basis for exercising state power and the standard for implementing positive law through historical and systematic context through the current status and development process of the normative structure of the Constitution and the legal system. He unfolded it and showed it. In that the evolutionary nature of basic rights and the relativity of basic rights guarantees function as a dynamically changing interpretation of the Constitution according to changes in society, generation, and politics and changes in people's values, the aspects of the living Constitution are presented in three dimensions through various writings. Among the various categories of basic rights, such as the right to freedom, the right to claim, and the right to vote, he has produced many academic papers on basic social rights. As a master of social security law, he has established the framework of Korean social security law. As such, he has established the constitutional framework of basic social rights that are in line with social security. He carefully suggested the realization structure, function, and direction of revision, linking it to the direction of national integration as a national goal. The reason why it is meaningful to examine the impact of your work on fundamental rights theory is because you realize the contribution his research has made to the development of fundamental rights theory in our constitutional law, and the issues. This is because examining the constitutional issues raised through this work can contribute to deepening younger students’ understanding of the Constitution as well.
