뉴노멀시대의 국가과제와 국가권력구조의 개정 방향 (A study on the direction of constitutional change of the power structure in the new normal era)

초록

헌법개정에 있어서 권력구조의 개정방향에 대한 논의는 종전에는 제도적인 측면에서 정부형태의 선택의 문제에 집중하는 모습을 보여주었다. 이 글에서는 2008년 글로벌 금융위기 이후에 등장하기 시작한 이른바, 뉴노멀 시대의 국가적 과제들을 먼저 확인하고, 이를 실현하기 위해 필요한 국가권력구조의 변화라는 관점에서 뉴노멀 시대의 국가권력구조의 변화 방향을 검토하였다.
그동안 뉴노멀 시대의 국가적 과제로는 저성장으로 인한 불평등의 심화를 해소하기 위한 균형있는 국민경제의 성장과 안정, 저성장의 구조속에서 새로운 성장동력의 확보, 경제주체간의 조화를 통한 경제민주화의 실현, 공정경쟁의 실현과 중소기업의 보호, 소기업-자영업의 지속가능성의 보장과 노동시장의 개선, 보편적 기본소득의 도입, 재난과 위험으로부터 국민의 보호, 공공재로서의 공적 방역시스템과 의료체계의 구축 등이 논의되어 왔다. 이러한 과제들은 헌법상의 기본권의 실현과도 밀접한 관련이 있는데, 문제는 이러한 다양한 문제의 해결을 위해서는 중앙정부와 지방자치단체의 적극적 역할도 중요하지만, 이와 함께 시민사회, 전문가, 시장 간의 협력적 거버넌스의 형성도 필요하다는 점이다. 왜냐하면, 뉴노멀 시대의 경제적, 정치적, 사회적, 환경적 과제들은 초연결성으로 인하여 서로 밀접히 연결되어 있고 그로 인한 위험도 다양한 영역에서 연쇄적으로 발생하고 있으므로, 이를 중앙정부와 지방자치단체의 역할에만 맡겨놓을 수는 없기 때문이다. 그런 점에서 헌법상의 국가권력구조는 중앙집권적이고 수직적인 권력구조에서 벗어나 분권적이며, 수평적이며, 자율적이고 협력적인 구조로의 변화를 필요로 한다. 따라서 뉴노멀 시대의 국가권력구조의 변화 방향으로는 ‘분권과 협치의 실현’, ‘지방분권의 강화’를 제시할 수 있으며, 국가권력구조의 이러한 변화를 통하여 궁극적으로는 뉴노멀 시대의 국민의 기본권의 실질적 보장으로 이어져야 할 것이다.

영어초록

The discussion on the direction of the revision of the power structure in the constitutional revision showed that the previous focus was on the issue of choice of government form from the institutional point of view. In this paper, the national tasks of the so-called new normal era, which began to appear after the 2008 global financial crisis, were first of all identified. Then the direction of change in the national power structure was reviewed from the perspective of the national power structure necessary to realize these tasks.
The national tasks of the new normal era include the balanced growth and stability of the national economy to resolve the deepening inequality caused by low growth, securing new growth engines in the structure of low growth, the realization of economic democratization through harmony among economic agents. In addition, the realization of fair competition and protection of small and medium enterprises, the guarantee of sustainability of small enterprises and self-employment and improvement of the labor market, the introduction of universal basic income, the protection of the people from disasters and risks, and the establishment of public prevention of epidemics and public medical systems are being discussed. And these tasks are closely related to the realization of fundamental rights.
The problem is that the active role of the central government and local governments is important to solve these various problems, but at the same time, it is also necessary to form cooperative governance between civil society, experts, and the market. This is because the economic, political, social, and environmental tasks of the new normal era are closely connected with each other due to hyper-connectivity, and the resulting risks are interconnected in various fields.
Therefore, in order to solve this problem, the constitutional power structure should be changed from a centralized vertical power structure to a decentralized, horizontal, autonomous, and cooperative structure. For this reason, 'realization of decentralization and governance' and 'strengthening of devolution’ can be suggested as the direction of constitutional change in the power structure in the new normal era. And through this change in the state power structure, it should ultimately lead to the practical guarantee of the people's basic rights in the new normal era.
