초록

행정실무에서 행정청이 처분을 함에 있어서는 여러 가지 이유로 주된 행정행위에 다양한 부관을 부가하고 있는 것이 현실이지만 이러한 부관은 당사자에게는 예상치 못한 내용으로 인하여 주된 행정행위 자체를 사실상 포기하게 하거나 이를 수용하지 못하는 경우 부관부 행정행위에 대한 법률적 분쟁으로 귀결되는 사례가 빈번하게 발생하고 있다. 2021. 3. 23. 제정･시행된 행정기본법에서는 그동안 명문의 규정이 없이 판례와 학설에서의 논의를 통해 축척되고 있었던 부관의 의미, 종류, 부관의 부가 가능성과 부관의 한계 등에 대하여 명시적으로 규정을 하였으나(행정기본법 제17조), 이는 종래 부관에 관한 많은 판례와 학설의 논의를 함축하여 정리한 것으로 이러한 명문 규정에도 불구하고 실제 부관부 행정행위를 둘러싼 많은 논쟁이 획기적으로 감소할 것으로 예상되지는 않는다. 한편, 제주특별자치도에서는 제주특별법의 특례조항을 활용하여 행정 차원에서 적극적으로 추진하였던 영리 목적 외국의료기관(녹지국제병원) 개설 과정에서 부정적 여론과 사회적 분위기 등 제반 상황과 맞물려 내국인 진료 제한이라는 조건부 허가로 우회하게 되면서 이러한 조건부 허가의 취소를 구하는 외국의료기관 개설 허가조건취소 사건 등의 법적 분쟁이 시작되었는데, 근본적인 원인에 대한 다툼인 외국의료기관 개설 허가조건취소 사건의 1심과 항소심의 판단이 엇갈린 끝에 최근 대법원에서 심리불속행 기각이 되면서 제주특별자치도지사의 조건부 허가가 적법한 것으로 최종적으로 판단되었다. 이에 본 연구에서는 위 외국의료기관 개설 허가조건취소 사건에 대한 항소심 판결을 대상판결로 하여 부관으로서의 부담, 주된 행정행위의 법적성질과 그에 따른 부관의 부가 가능성과 그 한계에 대한 검토와 더불어 제주특별자치도지사의 외국의료기관 개설과 관련하여 부가한 ‘내국인 진료제한’이라는 부관 및 외국의료기관 개설허가의 법적성질, 위 부관의 문제점 등에 대하여 살펴보았다. 행정행위 부관 부가를 하게 된 출발점은 분명히 주된 행정행위만을 허용하였을 경우 발생할 수 있는 여러 가지 문제점에 대한 행정청의 많은 고민을 반영한 결과물일 것이다. 그러나 부관의 한계에 대한 행정기본법 제17조 제4항이 마련되었음에도 불구하고 여전히 어떤 행정처분에 어떠한 부관이 부가될 것인지는 예측하기 어려워 행정청의 자의적 부가 가능성이 있고, 특히 막강한 여론과 정치적 입장변화라는 중대한 변수가 작동하는 경우에 대한 부작용이 심각할 수 있는 만큼 여전히 행정기본법상 부관에 대한 조항은 명백히 한계가 있다 할 것이고, 본 사례에서 보듯 주된 행정행위의 법적성질과 부관의 한계에 대한 법원의 판단이 심급을 달리하여 엇갈리는 점에서 알 수 있듯이 부관의 한계는 행정기본법의 제정에도 불구하고 꾸준히 학계와 실무계에서 함께 고민하고 연구되어야 할 것이다.

영어초록

In administrative action by administrative authority, ‘subordinate clause’ referring to conditions, deadlines, encumbrances, reservation of right to withdraw, etc. may be attached for various reasons. The receiving party may not foresee contents of such subordinate clause which may lead to give up the administrative act itself or not accept the subordinate clause, so that it often ends up with legal claims or disputes on the subordinate clause attached to administrative act. General Act on Public Administration (GAPA) enacted on March 23, 2021 stipulated expressly the meaning of, type of, ability to attach and limit of subordinate clause (Clause 17 of GAPA) which was connoted and organized legal cases and discussions of theory accrued regarding subordinate clause. Nevertheless, it wouldn’t be able to dramatically decrease legal claims and disputes involving in subordinate clause attached to administrative act.
Jeju Special Self-Governing Province (Jeju Special Province) had actively driven profit purpose medical institution (i.e., Nokji International Hospital) by applying special clause of Jeju Special Province Special Development Law. By the time opening the profit hospital, the governor of Jeju Sepcial Province provided a conditional permit that prohibits local residents from receiving a medical treatment at the profit hospital to circumvent negative public opinions and vibes, but such conditional permit brought legal claims to seek withdrawal of the conditional permit. The decisions on the case to seek withdrawal of the conditional permit for opening profit hospital were different from each court of the first instance and appeal court. The Supreme Court dismissed the case to uphold the decision of the appeal court that allowed the conditional permit limiting local residents to see a doctor at the profit hospital.
In this writing, a review on the above case to seek withdrawal of the conditional permit for opening profit hospital was based on the judgment of the appeal court and took a closely look at issues, such as burden of subordinate clause, legal nature of main administrative act, possibility to attach subordinate clause and its limits, and further, reviewed the subordinate clause of “restriction on medical treatment of local residents” arising out of opening foreign medical institution permitted by the governor of Jeju Special Province and legal nature of its permit and drawback of such subordinate clause.
It was important to note that the outset of attaching subordinate clause was an outcome of administrative authority’s deliberation to cope with various drawbacks in allowing main administrative act without subordinate clause. Even though Clause 17 (4) of GAPA enumerates conditions to attach subordinate clause, it is still difficult to anticipate what subordinate clause attaches to what administrative act which gives rise to possibility of the administrative authority to attach subordinate clause at its sole discretion, which, in particular, powerful public opinion and political shift in stance on social issues may cause side effects in attaching subordinate clause. Thus, it could be said that clause of GAPA related to subordinate clause is still not enough to cover the issues addressed above. Like the case in this writing, the courts have different views in legal nature of subordinate clause and its limits. Notwithstanding enactment of GAPA, legal issues on the limits in connection with subordinate clause should be further studied and reviewed together with academic and practice of law.
