우리나라 농‧어촌 정비 및 재생을 위한 법제도 개선방안 -농어촌공간계획을 중심으로- (A plan to improve the legal system for maintenance and regeneration of rural and fishing villages in Korea - Focusing on rural spatial planning -)

초록

우리나라에서 현재 농어촌 한쪽은 무분별하게 들어선 공장과 축사로 신음하고 다른 한쪽은 금방 무너질 것 같은 빈집들을 걱정한다. 즉 체계적 공간계획 부재로 난개발과 저개발 문제를 동시에 앓고 있는 것이 그 현실이다. 이처럼 우리나라 농어촌개발 관련 법제도는 그 체계적 측면에서, 국토계획과 각종 농어촌사업계획 간의 상호관계에 관한 법적 근거가 부족한 것이 가장 큰 문제이다. 이에 농어촌개발계획에 관하여 국토계획이나 각 농어촌계획 상호간의 관계 정립을 명확히 하기 위한 법제도적 정비가 필요하다. 최근 「농촌공간 재구조화 및 재생지원에 관한 법률」이 제정되어 농촌공간 재구조화 및 재생 지원제도 도입을 위한 근거법과 사업법으로서 역할을 동시에 수행하게 될 것으로 예상되나, 이 법이 특별법으로 제정된 것이 아니어서 법 시행하는 과정에서 국토계획법 등 기존 법률과 충돌할 경우 이 법이 배제될 수도 있어 위 법률의 제정취지가 반감될 우려가 크다. 이에 차제에는 위 법이 다른 법령에 우선한다는 점도 명확히 할 필요가 있다. 즉 2024년 3월 시행되는 「농촌공간 재구조화 및 재생지원에 관한 법률」에 따른 농어촌재생기본계획에서 농어촌공간구조와 농어촌생활권을 설정하는 것은 국토 전반을 대상으로 하는 공간계획인 국토계획법상 도시ㆍ군 기본계획과 중복되고, 농어촌특화지구와 용도지구가 상충하는 부분이 있으므로, 국토계획법상 개별 정비계획과 지구지정 등을 개정 및 정비하여 농어촌재생을 보다 활성화하는 방안도 검토가 필요하다. 나아가, 국토계획법상 도시·군 기본계획과 용도지구·용도지역을 더욱 세밀하게 규정함으로써 기존 법률 범위 내에서 농어촌공간계획에서 추구하는 농어촌재생·정비라는 목적이 가능하게 하는 한편, 국토계획법의 정비 외에도, 농어촌계획의 수립 근거를 기존 농어촌발전계획 기준인 「농업·농촌기본법」에 기본적으로 두고, 지구(농어촌계획지구) 지정 등 토지이용에 관한 사항은「농촌공간 재구조화 및 재생지원에 관한 법률」과 「농어촌정비법」 등을 활용하여 기존의 농어촌공간계획을 보다 체계적으로 수립해 나가야 한다. 또한, 현행 우리나라 농어촌개발계획은 형식상으로는 국가 사무이나, 실질적 내용에서는 지자체 고유사무가 혼재되어 있어 이에 대한 관계 및 관할 정비도 필요하다.

영어초록

In Korea, one side of rural villages is currently groaning over indiscriminately built factories and barns, while the other side is worried about empty houses that are about to collapse. In other words, the reality is that it suffers from the problems of reckless development and underdevelopment at the same time due to the absence of systematic space planning. As such, the biggest problem in Korea's rural development-related legal system is the lack of legal grounds for the mutual relationship between national land planning and various rural project plans in terms of its system. Therefore, regarding the rural development plan, it is necessary to revise the legal system to clarify the relationship between the national land plan and each rural plan. Recently, the Act on Support for Restructuring and Regeneration of Rural Spaces was enacted, and it is expected that it will serve as both a ground law and a business law for the introduction of a support system for rural space restructuring and regeneration. In the process of enforcing the Act, if it conflicts with existing laws, such as the National Territory Planning Act, this Act may be excluded, and there is a high possibility that the purpose of the Act will be halved. Therefore, it is also necessary to clarify that the above law takes precedence over other laws. In other words, the establishment of rural spatial structures and rural living zones in the basic plan for rural regeneration under the 「Act on Support for Restructuring and Regeneration of Rural Spaces」, which will be enforced in March 2024, is a spatial plan covering the entire national territory. Since there is overlap with the county basic plan, and there is a conflict between specialized rural districts and use districts, it is necessary to review a plan to further vitalize rural regeneration by revising and reorganizing individual rearrangement plans and district designation under the National Territory Planning Act. Furthermore, the purpose of rural regeneration and reorganization pursued by rural spatial planning within the scope of the existing law is made possible by more precisely defining urban/county basic plans and use districts/use areas under the National Territory Planning Act. , Establishment of rural planning is based on the 「Framework Act on Agriculture and Rural Areas」, which is the standard for rural development planning, and matters related to land use, such as designation of districts (rural area planning districts), are based on 「Act on Support for Restructuring and Regeneration of Rural Spaces」 and 「Rural Community Reorganization Act」, the existing rural spatial planning should be established more systematically. In addition, the current agricultural and fishing village development plan in Korea is state affairs in form, but in actual content, local government-specific affairs are mixed, so it is necessary to reorganize the relationship and jurisdiction.
