2000년대 民事판례의 傾向과 흐름(債權法) (The Law of Obligations : Current Trends and Development in Case Law, 2000-2009)

초록

판례를 정리하고 되돌아보는 것은 판례의 흐름을 읽는다는 의미에서 그 자체로 중요한 일이지만, 이 시기의 특성이 판례에 어떻게 반영되었는지를 살펴보는 것은 앞으로의 방향을 설정하기 위해서도 중대한 의미가 있다.
2000년대에 들어와 우리 대법원이 내린 판결들을 보면, 이제 판례는 우리 사회를 조직하는 중심축으로 자리잡아가고 있음을 알 수 있다. 대법원은 2004년부터 사회적으로 이목을 끄는 중요한 사건에 관해서 공개변론을 열고 있고, 전원합의체 판결을 비롯하여 새로운 판례를 끊임없이 내놓고 있다. 특히 성년 여성이 종중원이 되는지 여부, 성전환자의 성별정정이 허용되는지 여부, 금융실명제 하에서 예금계약의 당사자가 누구인지, 연명치료 중단이 허용되는지 등 우리 사회의 중요 문제가 법원에 의하여 결정되었다. 국회가 입법으로 해결하지 못하고 있던 여러 난제들이 법원의 결단을 기다려 그 해결책을 찾아가는 현상은 이제 드문 일이 아니다.
이 글에서는 지난 10년 동안의 채권법 판례에 관하여 그 흐름을 살펴보는 데 중점을 두었다. 민법전의 편별이나 순서에 구애받지 않고 이해하기 편하게 판례를 분류하였다. 먼저 계약, 부당이득, 불법행위로 구분하고, 그 중 계약에 관해서는 계약의 성립부터 소멸까지 순서대로 살펴본다는 의미에서 ‘계약 일반, 계약의 성립, 계약의 내용, 계약의 이행, 채무불이행, 계약의 해소, 계약과 제3자, 책임재산의 보전과 인적 담보’로 분류하여 정리하였다.

영어초록

The period between 2000 and 2009 has a symbolic meanung as the first decade of the 21st century. The dawn of a new millenium called for a fresh start in almost all areas of the society, in particular when Korea was undergoing radical economic and social changes due to its reliance on the emergency fund of the International Monetary Fund to overcome the ramifications of the 1997-1998 East Asian financial crisis. Meanwhile, the Supreme Court, which sets most of the country's legal precedents, strives to enhance diversity within its judiciary.
Looking back on the court rulings rendered during this period is meaningful in the sense that this reveals the latest trend and development of the nation's legal judgment; further, understanding how the characteristic traits of the times influenced the rulings is also significantly relevant.
Rulings of this decade show that court precedents have become an increasingly important aspect of the nation's social organization. The Supreme Court started in 2004 to hold public hearings for socially prominent cases, and continously produced new precedents. A number of matters of social significance sought Supreme Court Review, including, but not limited to, the following: Whether adult females can constitute a Jongjung (family clan), whether legal gender change should be permitted for transsexual persons, who shall be the party to a bank deposit contract under a financial system that does not allow the use of a third party's name in financial dealings, and whether discontinuance of life-sustaining treatment should be allowed. It is no longer unusual to find many intricates issues such as these that the parliament fails to adequately address with legislative measures switching their course to find a solution at the court.
In this paper, law of obligation precedents rendered from 2000 to 2009 are presented in the following three categories: Contract, Unjust Enrichment, and Torts. Please note that the precedents under the "Contract" category are listed not according to the order or the classification method employed by the Korean Civil Code but rather in a manner that make it easier for readers to follow along and understand the life of a contract from its formation to extiction.
