초록

본 논문에서는 일본헌법 제9조와의 관계에서 평화적 생존권이란 제3세대 인권이 등장하는 시기인 1964년부터 2000년까지의 자위대와 미군기지와의 관계, 자위대와 자위대 비용의 위헌여부, 일본헌법 제9조와 오키나와의 관계, 또한 일본과 미국의 안전보장관계의 변천, 더 나아가 일본이 드디어 파병단계까지 나아가 집단적 자위권이란 개념이 생성되고 일미안보체제의 변용이 오는 단계까지를 살펴보았다.
위 사건들에서 자위대와 미군기지의 일본 주둔이란 사건유형에서 일본국민과 사법부, 그리고 일본 정부의 입장이 각각 상이함을 알 수 있다. 즉 일본 국민과 사법부의 原審裁判들은 자위대와 미군기지의 일본 주둔에 대하여 일본 헌법 전문과 제9조를 연관시켜 ‘평화적 생존권’을 인정하는 추세이나, 일본 정부나 最高裁의 재판은 사법심사의 대상에서 회피 내지 두 존재를 위헌은 아니라는 판결로 간접적으로 두 군대조직을 인정하고 있음을 알 수 있다.
다음으로 또한 평화적 생존권과 관련이 있는 사항으로는, 일본에 있어서 일본 헌법 제9조와 오키나와의 미군기지와 자위대 주둔은 불가분의 관계이므로 이를 점검하였다.
또한 걸프전쟁으로 인하여 유사법제이론이 등장하면서, ‘유엔평화협력법안’, ‘PKO 5원칙’등을 내세워 일본 정부는 ‘국제사회의 일원’으로서의 역할을 한다는 이름하에 ‘평화의 국가’에서 ‘보통의 국가’로 바뀌어가고 있다.
물론 이로 인하여 일본 국민들은 흔히 ‘제3세대 인권’이라고 하는 ‘평화적 생존권’을 주장하며 정부와 맞서는 운동들이 전개되기도 한다.
이상과 같이 일본에 있어서의 일본 헌법 제9조와 자위대에 관한 인식은 시대에 따라 해석개헌을 하면서 이제는 마침내 정식으로 헌법개정 작업을 진행하고 있다.

영어초록

This thesis deals with (i) the right to live in peace in relation to the Article 9 of Japan's Constitution, (ii) the relations between Japan's Self Defense Forces and U.S military base from 1964, when the third generation rights started to emerge, to 2000, (iii) unconstitutionality of Japan's Self Defense Forces and the expenditure thereof, (iv) the relations between the Article 9 of Japan's Constitution and Okinawa, (v) the changes of Security between Japan and U.S, and (vi) the overseas dispatch of troops which results in generating the concept of Collective Self Defense and changing Japan-America Security System.
The abovementioned series of events show that the general public of Japan, its Judiciary and Government have different positions with respect to the fact of Self Defense Forces and the stationing of U.S military base in Japan. That is, the Japanese people and original trials of the Judiciary show tendency to recognize the 'Rights to Live in Peace'concerning the facts thereof by connecting them the Preamble and Article 9 of Japan's Constitution. Nevertheless, Japan's Government and the judgment of Supreme Court maintain that the presence of Self Defense Forces and U.S military base is neither subjected to judiciary examination nor violation of constitution, which shows that they recognize the two military organizations in a roundabout way.
There is another issue related to the 'Rights to Live in Peace': The relations between the Article 9 (Japan's Constitution), Self Defense Forces and U.S military base stationed in Okinawa. This thesis describes the inseparable relations thereof.
Furthermore, with the emergence of Emergency Legislation Theory due to Gulf War, Japan's Government uses 'UN Peace Cooperation Bill' and 'Five Principles of PKO' to turn itself from 'Peace State' to 'Normal State' by justifying that Japan performs its role as a 'Member of International Society' faithfully. The Japanese people develop various campaignsagainst these excuses by Government, holding on to the 'Rights to Live in Peace' - what they call 'The Third Generation Rights'. The recognition of the relations between Article 9 of Japan's Constitution and Japan's Self Defense Forces has changed with interpretative amendment of constitution of the times, and constitution amendment is officially on the move now.
