초록

본 논문은 ‘어린이 인권’과 ‘선언’이라는 두 가지 축을 중심으로 어린이 인권에 작용하는 생명 정치적 사유의 내면을 읽어내기 위해 1980년대 이후부터 2000년대까지 어린이 선언의 수사학적 퍼포먼스가 공동의 경험들을 어떻게 조직하고 재구성해내는지를 알아보고, 어린이 인권 선언의 문제의식이 인류세와 포스트휴먼, AI 시대로 지칭되는 오늘날의 문화지형에 맞닿아 있음을 살펴보고자 하였다. 1970년대 이후 최근에 이르기까지 살펴본 어린이 인권 선언은 ‘세계화 시대, 한국인으로서의 어린이 인권 → 새천년, 평화로운 지구촌의 구성원으로서의 어린이 인권 → 함께 행복할 권리를 지닌 어린이 인권 → 놀 권리를 지닌 어린이 인권 → 독립된 인격체로서 권리를 지닌 어린이 → 집합적 주체로서 어린이의 다양한 목소리를 반영한 인권 선언’으로 이어져왔다.
정부 주도로 이루어진 어린이 헌장이 독립된 인격을 지닌 존재로서 어린이를 호명하고 이로써 어린이의 권리에 대한 인식 수준을 높이는 데 주력했던 것에 비해 민간단체와 어린이들의 주도로 발표된 선언은 개별 사례에 토대를 두고 이를 수렴해가는 과정에서 집합적 주체로서 어린이들의 목소리를 반영하려는 노력을 보여주었다. 80년대와 90년대, 2000년대의 문화지형도 안에서 하나의 사건처럼 등장한 어린이 인권 선언은 역설적이게도 어린이라는 존재가 여전히 우리 사회의 타자이며 약자라는 사실을 내포하고 있다. 상징계의 질서 외부에 존재하는 타자들을 불러들이고 그들의 권리를 호명하는 선언이라는 행위가 본질적으로 약자들의 저항방식이라는 점은 어린이나 장애를 가진 사람들, 여성, 피식민 주체 등 하위주체들이 최소한의 대항담론으로 선언을 택할 수밖에 없었던 역사적 사실 속에서 더욱 분명해진다. 선언은 언어적 전회에서 존재론적 전회로 나아가는 타자들의 퍼포먼스이자 근대적 인간의 사유 너머로 나아가는 행위수행적 발화이다. 지금, 여기에서 반복되는 어린이 인권 선언이 개별자로서 어린이들의 목소리를 담고 연대를 만들어낼 때 선언은 현실을 탈구축하고 도래할 미래를 예기하는 수사학적 실천행위가 될 수 있다.

영어초록

This paper explores the inner workings of the life-political discourse that affects children's human rights, focusing on the two pillars of "children's human rights" and "declaration," and how the performative aspects of the children's declaration organize and reconstruct shared experiences from the 1980s to the 2000s. Furthermore, it examines how the awareness of children's rights that emerged from the problematization of the children's declaration is relevant to the cultural topography of today's post-human and AI era.
The children's human rights declaration, which has been examined from the 1970s to the present, has evolved from "children's human rights as Koreans" during the globalization era to "children's human rights as members of a peaceful global village" in the new millennium, "the right to happy play" for children, "children's rights as independent individuals," and finally "human rights declaration reflecting children's diverse voices as collective subjects." While the government-led Children's Charter primarily aimed to raise awareness of children's rights by calling them independent beings, the declaration, led by private organizations and children, made efforts to reflect the voices of children as collective subjects in the process of collecting individual cases. Ironically, the children's human rights declaration, which appeared as an event in the cultural topography of the 1980s, 1990s, and 2000s, implies that the existence of children is still considered "other" and weak in our society.
The act of calling others and their rights outside the symbolic order is essentially a resistance method for the weak, and this is made clearer in the historical fact that children, disabled people, women, and colonial subjects had no choice but to declare with minimal counter-discourse. Declaration is a performative speech that moves from linguistic to ontological and action-performance speech, going beyond modern human thought.
Now, as the repeated declaration of children's human rights contains the voices of children as individuals and enables solidarity, the declaration can be a rhetorical practice that deconstructs reality and predicts the future that will come.
