정당법 10년 성과와 과제 (Korean Party Law of Last 10 Years, It’s Accomplishments and Tasks)

초록

본 연구는 2004년 이후 정당법의 성과와 과제를 검토하고자 한다. 2004년 이후 정당법은 우리 정치에 다음과 같은 긍정적 변화를 가져왔다. 그것은 정당회계 투명화, IT 기술도입, 중앙당 경량화, 정당 정책기능 강화 그리고 여성 정치참여 확대 등이었다. 하지만 2004년 이후 정당법은 정부와 국민 간 연결고리로서의 정당강화를 위해 다음과 같은 과제를 갖고 있다. 첫째, 지구당 폐지는 ‘저비용 고효율의 의도한 결과’보다 정치현실을 왜곡시키는 부정적 효과가 더 컸다. 따라서 운영의 민주화, 개방화 그리고 분권화를 전제로 지구당 부활이 필요하다. 둘째, 정당 스스로 공천방식을 선택하도록 하되 선거 전 일정시기까지 공천을 마무리하도록 법정화해야 한다. 셋째, 정당설립 요건을 완화하고 ‘중앙당의 수도소재 의무’를 폐지하여 국민의 정치참여 기회를 확대해야 한다. 넷째, 원내정당과 원외정당 간의 합리적 차별을 유지하되 장기적으로 기회균등의 원칙을 확대 적용해야 한다. 다섯째, 의원총회를 의사결정 기구화 하여 국회중심의 정치를 지향하고 의원의 정당 조직원으로서의 의무와 국민대표로서의 의무 간 조화를 추구해야 한다. 향후 우리 정당법은 국민의 정치적 의사형성 매개체로서의 정당역할을 강화하는 방향으로 변화하여야 할 것이다.

영어초록

This essay focuses on the accomplishments and tasks of the party law since 2004. It finds such affirmative points of the party law since 2004 as: fiscal transparency, central party organization weight reduction, establishment of party policy institute and enlargement of women political participation. However, this study underlines some tasks for the party law. They are: First, restoration of party district chapter is necessary with the conditions of democratic, autonomous and open operation of the organization. Second, the party law is supposed to specify due time for parties to nominate their official candidates for elections. Third, the law is required to ease the conditions for party foundation for the purpose of enlarge people’s chance of political participation. Fourth, keeping the current discrimination between parties with and without legislative seats we are going to expanded application of the principles of equal opportunity. Finally, it is necessary to organize the general meeting of the National Assembly of parties as the top decision making body. The Korean party law is required to change into the one to maximize political parties’ role in the political process.
