초록

형법은 명문의 구성요건으로 배임죄의 손해를 규정하고 있으며, 그 결과 배임죄의 손해는 실체법인 형법에 있어서는 기술된 구성요건으로 매우 중요한 요소이나, 절차법인 형사소송법에 있어서도 구체적인 특정을 필요로 하는 공소사실에 해당한다.
그러나 지금까지 실무나 학계에서 배임죄 손해액 산정시 간과하여 온 것이 경제적ㆍ재무적 분석이며, 그 결과 공소사실의 특정에서도 피고인에 대한 공소사실의 보장기능을 소홀히 해왔다. 그리고 그 이유는 배임죄를 위험범으로 보면서 ‘재산상의 손해’에 손해발생의 위험마저 포함시켜 왔기 때문이다. 사기죄의 경우 재산상의 손해가 명문의 구성요건이 아니므로 재산상 손해를 완화해서 해석할 수도 있으나, 배임죄의 경우에는 구성요건 해석상 엄격하게 해석되어야 함에도 사기죄처럼 재산상 손해발생의 위험마저 포함하는 것으로 해석하여 온 것이다. 그러나 배임죄의 손해는 구성요건요소이며, 특정경제범죄법상 가중처벌을 위한 이득액과도 연결되어 있으므로 그 입증책임은 어렵지만 검사가 부담하여야 하며 불특정으로 인한 불이익도 마찬가지이다. 그리고 그때 손해산정의 기준은 배임행위가 되는 거래행위의 유형에 따라 각각 경제적 관점에서 실제 재산가치의 감소액을 기준으로 판단하여야 한다. 재산상 손해발생의 위험과 재산상 손해는 문언의 한계상 구별되는 것이며, 재산상 손해발생의 위험을 재산상 손해로 이해하는 것은 미수범 체계를 혼동한 것이기 때문이다.
