생성형 AI 커버 곡에 관한 형사입법적 대응방안 연구 (Study on Criminal Legislative Response to Generative AI Cover Songs)

초록

생성형 AI 커버 곡은 하나의 유행으로 번져, 각종 SNS에서 큰 인기를 끌고 있다. 이 과정에서 생성형 AI 커버 곡은 저작권이나 퍼블리시티권의 침해 문제를 발생한다. 저작권과 관련해서는 주로 복제권의 침해, 공연권 및 공중송신권 침해가발생한다. 이에 대해서는 현행 저작권법상 형사처벌이 가능하며 민사상으로 책임을 부담시킬 수 있다. 그러나 생성형 AI 커버 곡의 영리 창출 방법이 다양해지면서그와 관련된 새로운 법적 해석이 문제가 되고 있다. 예컨대, 유튜브 및 각종 SNS 는 생성형 AI 커버 곡 등 다양한 방법으로 수익을 창출할 수 있게 되었는데, 이들방법이 과연 저작권법상 영리 목적의 저작권 침해인지가 법적으로 해결되어야 한다. 또 퍼블리시티권의 침해는 개인의 목소리를 제3자가 별도의 이용 허락 없이 사용하는 점이 문제가 되는 것이다. 현재 퍼블리시티권에 관한 법적인 보호와 규제가명확하지 않아 그 침해를 처벌하거나 규제할 법규가 마땅치 않은 상황이다. 특히, 퍼블리시티권의 인정 여부에 대해서도 하급심 법원은 상반된 태도를 나타내고 있으며, 대법원은 이에 대해 어떤 판시도 밝힌 바가 없다. 생성형 AI 콘텐츠의 문제는 비단 우리나라뿐만 아니라 지구촌 전체의 문제이기도 하다. 이에 생성형 AI 커버 곡의 무분별한 제작 및 유통을 방지하고자 저작권이나 퍼블리시티권의 침해 여부를 중심으로 입법적 개선방안을 제언하였다. 앞으로도 계속 발전할 생성형 AI와관련하여 입법 및 기본법의 개선은 불가피하기 때문이다. 이 연구에서는 생성형AI 커버 곡을 둘러싼 문제를 형사법적 관점에서 고찰하였다. 이 연구가 생성형 AI 의 무분별한 사용을 예방하고 저작권자를 보호하는데 일조할 수 있기를 기대한다.

영어초록

Generative AI cover songs have spread into a trend and are gaining great popularity on various social media platforms. Generative AI cover songs are mainly produced by extracting the voice of a celebrity, converting it into data, duplicating and modifying the data, then erasing the voice of the original composer and substituting the extracted voice. In this process, generative AI cover songs infringe copyright and publicity rights. In relation to copyright infringement, infringement of reproduction rights, public performance rights, and public transmission rights mainly occur. This is punishable under the current criminal law and can also result in civil liability. However, as the methods for profit-making generative AI cover songs have become more diverse, new legal interpretation issues related to this have arisen. In other words, YouTube and various SNS are now able to generate profits in various ways, but the issue of legal interpretation of whether this constitutes copyright infringement for profit under the Copyright Act must be resolved. In addition, the infringement of publicity rights is problematic because a third party used an individual's voice, which is sensitive information, without separate permission. However, currently in Korea, the regulations regarding the right of publicity are unclear, so there is no suitable way to punish or regulate it. In particular, lower courts have conflicting positions on whether to recognize the right to publicity, and moreover, the Supreme Court has not expressed any position on this issue. The problem of generative AI content is not only a problem for our country, but also for the entire global village. Therefore, through this study, the author proposed new legislation and improvements to prevent the indiscriminate production and distribution of generative AI cover songs that infringe copyright and publicity rights. This is because improvements in legislation and basic laws are inevitable in relation to generative AI, which will continue to develop in the future.
However, in Korea, there is a severe lack of legal discussion and related legislation related to generative AI cover songs. Therefore, this study sought to examine whether criminal punishment is possible by applying the problems related to generative AI cover songs to criminal law. In other words, generative AI cover songs pose problems of copyright infringement and infringement of publicity rights individually or in combination, and since this is an illegal act, it is judged that criminal legal discussion cannot be avoided. We hope that this study will prevent the indiscriminate use of generative AI and protect copyright holders.
