초록

이 글은 동북아에서 인권과 민주주의에 관련된 담론을 반성적 고찰을 통해 대안을 제시하고자 한다. 따라서 이 글은 유교적 인권담론이 갖는 상대주의와 특수주의에 대해서 비판적인 지지를 하지만, 서구주의가 갖는 보편주의와 역사주의적 실천주의에 대해서도 일방적 지지만을 수용하지도 않는다. 이 글의 목적은 정체성에 대한 일방적 주장은 그 정체성의 일관성을 위해 타 정체성들에 대한 억압과 수동성을 유도한다. 또한 그러한 타 정체성들을 인정하고 존중하고자 하는 노력은 이미 분명하게 나타나 있는 자아들의 안정성을 해치는 곤란한 결과를 가져온다. 미래의 인권담론은 차이와 다름을 승인하지 않는 일방적이고 순환 논리적 사고에서 벗어나 관용과 배려가 있는 보편주의를 구해야 한다.
동북아의 문화와 언어, 그리고 역사적 경험은 동일하지도 않지만 그렇다고 상반되지도 않는다. 이러한 토대가 유교라는 종교적이고 정치적인 담론 틀 속에 범주화한다는 것도 그리 타당하지도 않다. 동북아국가들이 유교적 내지 유사한 문화에 뿌리를 두고 있다는 사실을 승인한다면 이제는 동북아에서 출발하는 보편적인 인권담론을 형성할 필요가 있다. 유교와 서양의 비판적 수용, 근대의 민족해방 투쟁과 지구화라는 이중과제를 통해 현대성을 실현하는 것이다. 유일하게 서구에 대항할 문화담론을 제시할 수 있는 비서구적 인간중심적인 인권담론이다. 시대적 요청인 <동북아문화공동체>의 형성과 오직 아시아와 동북아에만 설치되지 않은 <동북아인권체제>의 실현에 노력해야 할 것이다.

영어초록

This thesis intends to re-constitute the Confucian discourse on human rights in Northeast Asian, through reflexively studying the discourse on human rights and democracy in the region.
Foremost, this thesis is consistent in critical support for Western discourse on human rights that emphasizes generalism and historical practicism. Also, the thesis takes into notice that a strong assertion on one’s own identity is bound to be dependent and passive due to following reasons: a strong assertion on one’s own identity demands suppression on other constructive identities for the sake of consistency, such strong assertions may harm other identities' stability; such suppression also signifies that an identity needs another subject in order to have its own identity. The future discussion on human rights we should fully debate has to be on global and generalistic human rights that stem out from Northeast Asia, the human rights from which has generosity and consideration for others.
Northeast Asian nations does not have same culture, language, and historic experience; yet, it is also true that the three nations do not contradict each other in such aspects. The modernization of the three nations, which occurred on different time frame, brought weakening of similarity especially the community spirit by broadening political, economic, and social gaps among the three nations. However, the political and cultural characteristics of the three nations still show much similarity. If it is well admitted that the Northeast Asian nations root themselves on Confucian, or at least similar, culture, there is a need to form a generalistic discourse on human rights that begin from Northeast Asia.
The thesis will become a new alternative to the failed human rights discourses- those by existing-socialist state and those that are unilateral and Europocentric, through the resolution of the following theme a critical acceptance of Confucianism and the West, the modern struggle for liberation of ethnic groups, and the nativism of globalization. So I propose the establishment and vitalization of <Northeast Asian Cultural Community>, <Regional Human rights Forum>, which not only in East-north Asia.
