공공갈등과 거버넌스 그리고 제도변화:물관리 일원화의 성과와 과제 (Transboundary Water Conflict, Governance, and Institutional Change: Achievements and Challenges of Unifying Water Management)

초록

여러 행정구역을 거치면서 다양한 이해관계를 표출하는 물 갈등(transboundary water conflict)의 특성 때문에 물 거버넌스 성공의 핵심은 공공갈등 관리에 있고, 어떻게 합의형성에 이를 것인가가 핵심 논제이며, 이 논제를 푸는 것이 이 연구의 목적이다.
물관리 전문가 12명에 대한 심층면담 결과에 따르면, 2018년 5월 물관리기본법 제정과 정부조직법의 개정을 통해 통합물관리의 제도적 기반이 제공되었지만, 물관리위원회의 여러 가지 한계 때문에 거버넌스가 실질적으로 작동하지 못하고 있는 것으로 나타났다. 첫째, ‘2018년 물관리 일원화 이후 물을 둘러싼 갈등이 완화되었다는 의견’에 대해서 58.3%가 동의하지 않는 것으로 나타났다(5점 척도 평균 2.4점). 둘째, 거버넌스가 물 갈등해결에 기여하고 있지 않다고 생각하는 의견이 국가물관리위원회는 83.3%(평균 2.1점), 4대강 유역물관리위원회의 경우 75%(평균 2.3점)로서 부정적 평가가 다수를 이루고 있었다. 셋째, 41.6%의 전문가들이 우리나라 물 관련 갈등관리를 위한 제도적 정비 수준이 높다는 의견에 동의하고 있지 않는 부정적인 평가(평균 2.8점)가 나타났다. 넷째, 물 관련 공공갈등을 해결하는데 어떤 제도적 방안이 바람직한지 물었을 때 물관리기본법 활용(평균 3.8점)을 가장 적합한 법제도 방안으로 평가하였다. 그리고 물 갈등과 관련하여 갈등유형별 갈등관리 및 해결방식에 대해서 조정(조정협의체 구성 포함) 방안을 가장 적합하다고 평가(평균 3.9점)하였다.
2018년 물관리 정책의 변동과 거버넌스의 변동이 나타났으나 여전히 운영상의 한계에 직면하고 있고, 공공갈등 해결을 위한 갈등관리기본법 입법실패가 2005년 이후 지속적으로 나타났음이 확인되었다. 그러므로 기존 갈등관리제도를 활용하면서 점진적으로 제도개선을 해나가는 것이 필요하다는 결론에 이르렀다.

Due to the nature of water conflict that goes through several administrative districts, the key to the success of water governance lies in public conflict management, and how to reach consensus is a key issue, and the purpose of this study is to solve this issue.
Although an institutional foundation was provided through the enactment of the Framework Act on Water Management and the revision of the Government Organization Act in May 2018, it was found that governance was not actually working due to various limitations of the Water Management Committee. First, among 12 experts, 58.3% disagreed with the statement that ‘conflicts over water have been alleviated since the unification of water management in 2018’ in Korea. Second, 83.3% of the respondents thought that the governance of Korea's National Water Management Committee was not contributing to resolving water conflicts, with the majority giving a negative evaluation. And 75% of experts thought that the governance of Korea's Four Major Rivers Basin Water Management Committee is not contributing to resolving water-related conflicts. Third, because 41.6% of experts did not agree with the opinion that the level of institutional arrangements for water-related conflict management in Korea was high, the negative evaluation was higher than the positive evaluation. Fourth, when asked what institutional measures they thought were desirable in resolving water-related conflicts, the use of the Framework Act on Water Management was evaluated as the most appropriate legal system plan. In relation to water conflict, the mediation method including the formation of a mediation council was evaluated as the most appropriate for conflict management and resolution methods by conflict type.
From the perspective of path creation, changes in water management policy and governance were observed since 2018, but it was confirmed that operational limitations were still encountered. Furthermore, the failure to enact the Framework Act on Conflict Management in Korea was seen since 2005 from the perspective of historical institutionalism and path dependence. And since there are experts who argue for the use of the existing system, we have come to the conclusion that it is necessary to gradually improve the system while preserving the operational excellence.
