동물의 지위에 대한 논의와 법적 함의— 『재산』에서 『반려』 그리고 『권리』로 — (A Study on Discussion of Animal Status and Legal Implications — Focusing on from Property to Companion and Rights —)

초록

이 글은 큰 틀에서 보면 먼저 동물의 법적 지위에 관한 논증을 정리하고, 그 다음으로 현행 법제도에서 동물의 지위의 보장을 위한 입법론을 제시하였다. 이 과정에서 동물의 지위에 관하여 3가지의 카테고리로 구성되었는데 첫째 반려의 대상으로서의 동물의 지위, 둘째 동물의 권리론, 그리고 마지막으로 동물의 지위 보장을 위한 입법론으로 구성되었다.
그 구체적인 내용으로 동물의 지위에 관한 논증은 중세부터 근대까지로 구분해보면 동물은 단순한 물건이라는 입장이 주류이다. 하지만 현대에 들어오면서 동물의 감각성을 인정하게 되어 동물의 복지를 주장하는 동물복지론, 그리고 더 나아가 동물에게 권리를 인정해야 한다는 동물권리론이 주장되고 있다. 전자의 대표적인 견해로는 피터 싱어이고 후자의 대표적인 견해로는 톰 리건으로 대별되지만 그 외에도 다양한 견해가 있다.
이러한 사상적 흐름은 현행 법ㆍ제도적 측면에서 보면 동물의 복지를 고려하는 상황에서는 일견 타당하지만 동물의 권리를 주장하는 입장에서는 인정되기 어렵다. 왜냐하면 근대법상 동물은 권리의 주체인 인간의 소유의 객체가 되는 물건이기 때문이다. 따라서 근대 『민법』의 3대 원칙 중 하나인 소유권 절대의 원칙이 유지되는 한 물건으로부터 벗어날 수 없다.
이러한 상황 속에서 동물에게 권리성을 인정하는 것은 불가능하기 때문에 서구의 각 국가들은 동물의 복지를 생각하는 방향으로 변화되었다. 그 변화의 시작으로 20세기 후반부터 선진외국에서는 법률적 차원에서 동물을 단순한 물건과 구별하여 규정하게 되었다. 그 후 21세기 초에는 동물을 법률적 차원이 아닌 『헌법』 차원에서 국가목표규정으로 동물을 보호하는 상황까지 이르게 되었다. 그 대표적인 국가인 독일은 2002년에 『독일기본법』 제20a조에 ‘자연적 생활기반과 동물을 보호한다.’고 규정함으로서 국가의 동물을 보호할 책무가 있음을 명시적으로 규정하고 있다.
한편, 우리나라에서도 이러한 흐름의 영향으로 동물에 대한 인식의 변화가 이루어지고 있다. 그 대표적인 예로는 기존의 동물을 단순한 물건 내지 애완동물에서 반려동물로 인식하게 되었다는 점이다. 이러한 인식의 변화가 중요한 이유로 우리나라의 현행법상 동물은 여전히 단순한 물건에 해당하고 단지 동물의 보호 내지 복지를 고려하는 『동물보호법』이 시행되고 있기 때문이다.
하지만 최근 『민법』 개정안에는 동물을 단순한 물건의 개념에서 벗어나려는 내용이 포함되어있는 점은 주목할 만 하다. 때마침 현재 대한민국 『헌법』의 개정에 관한 논의가 활발하게 이루어지고 있는 상황이다. 물론 그 『헌법』 개정의 중심에는 권력구조개편이지만 기본권에 관한 규정 중 하나인 환경권에 관한 개정의 논의도 포함될 것으로 예상된다.
따라서 이번 『헌법』 개정 시에 우리나라도 서구 독일의 사례처럼 국가목표규정으로 동물을 보호하는 규정을 신설하는 계기가 되어야 한다. 또 『헌법』 제11조의 권리주체간의 평등조항이라면 『헌법』 제35조에는 권리의 객체인 동물 간에 있어서 동물복지평등의 원칙(가칭) 조항을 신설이 필요하다고 생각한다.

영어초록

In a big frame, this article first concludes the argument concerning the legal status of animals, and then presents the legislation to ensure the status of animals in the current legal system. In this process, it consisted of three categories concerning the status of animals, the status of companion animals, the animal rights discourse, and the principle of legislation to ensure the status of animals.
The specific content is that the main argument on animal status is that animals are simple objects, separated from the medieval times to the modern times. However, modern day, animal rights groups are urged to recognize animal instincts, which insist on the welfare of animals, and, by extension, recognize rights to animals. Peter Singer is the representative view of the former and Tom Regan is the representative view of the latter, but there are many others.
Such an ideological trend is seemingly plausible given the welfare of the animal in view of the present legal system, but hardly acceptable from the position of claiming animal rights. Because under modern law, animals become objects that belong to human beings that are the subject of rights. Therefore, one can not escape from the object as long as the principle of ownership, one of the three principles of modern civil law, is maintained.
Under these circumstances, it is impossible to recognize the rights of animals, so the countries of the West have changed to think about animal welfare. The change started in the latter part of the 20th century when more advanced countries defined to distinguish between the animals and the simple objects things in the legal sense. Then, in the early 21st century, the protection of animals was carried out not at the legal level but as a constitutional provision, rather than as a state goal provison. Germany, the representative country, protects its natural life base and animals under Article 20a of the Framework Act in 2002. By defining it, it specifically states that the nation has a responsibility to protect its animals.
Meanwhile, in our country, due to the influence of this flow, a change in perception of animals is being made. A typical example is the perception of an existing animal as a companion animal in a simple object or pet. Such a change in perception is important because the current law in Korea still stands for simple objects, and only animal protection laws are in effect that consider animal protection or welfare.
However, it is noteworthy that the recent revision to the civil law includes a content that tries to deflect animals from the concept of simple objects. At the moment, there is a brisk discussion about revising the Constitution of the Republic of Korea. Of course, at the center of the amendment is expected to be a power structure reform but discussion on one of the basic rights - environmental reform.
Thus, the revision should serve as an occasion for Korea to establish regulations to protect animals with state goal provison, as was the case in western Germany. In addition, if Article 11 of the Constitution's equality between rights holders, Article 35 of the Constitution requires the establishment of a new clause on the principle of equality of animal welfare among the animals subject to rights.
