군사망사고진상규명위원회 조사활동의 성과와 한계, 그리고 과제 (The Achievements, Limitations, and Task of the Investigative Activities of the Presidential Truth Commission on Deaths in the Military)

초록

군사망사고진상규명위원회는 군 사망사고 진상규명을 위한 특별법에 의하여 설립된 대통령 소속의 국가기관으로서, 국군조직법이 제정된 1948. 11. 30. 이후 2018. 9. 13.(위원회 활동 시작일 전일)까지 발생한, 군인(전환복무한 전･의경, 의무소방원, 경비교도대원 포함)이 복무 중 사망한 원인이 명확하지 않다고 의심할 만한 상당한 이유가 있는 사고 또는 사건에 대해 유족이나 사건에 특별한 사실을 알고 있는 사람이 진정을 제기하는 경우 이 군사망사고에 대해 조사한다. 아울러 2021. 9. 13.까지 발생한 군사망사고에 대해 특별한 사정이 있는 경우 위원회의 결정으로 직권으로 조사를 할 수 있다. 위원회의 존속기간은 2018. 9. 14.부터 2023. 9. 13.까지 5년이다.
이 글은 대통령 소속 군사망사고진상규명위원회의 활동 종료까지 3개월여를 남겨둔 시점에서 그동안 위원회가 수행한 군사망사고 진상규명활동을 평가하고 이러한 제도의 한계를 지적하면서 앞으로의 과제를 제시하고자 하였다.
위원회는 유족 등이 제기한 진정을 1,787건과 직권으로 조사를 개시한 사건 56건 등 1,843건 가운데 2023년 6월말까지 1,833건을 조사완료하였고, 위원회 활동 종료 이전까지 모든 사건의 조사를 완료할 예정이다. 위원회는 유족의 진정을 받아 조사를 하는 것을 원칙으로 하였으나, 이는 군복무 중에 사망한 군인에 대한 적절한 예우를 위한 것이라기보다는 군과 사망원인에 대해 다툼이 있는 사건의 해결에 치중한 제도라는 한계가 있다. 특히 오래된 사건의 경우 진정을 제기할 유족이나 동료가 없어서 위원회가 조사를 개시하는 데 한계가 있다. 한시적으로 활동하는 기관이라는 점 때문에 위원회가 직권조사를 하는 데도 제약이 있다.
그동안 사망한 군인 가운데 순직 등 예우를 받지 못하는 군인이 3만 9천 명 정도인데, 유족의 진정이 없어도 국가가 적극적으로 나서서 그동안 순직심사기준의 변화를 반영하여 순직 여부를 일괄하여 재심사할 필요가 있다. 그것이 공동체를 위한 희생과 헌신에 대한 마땅한 예우의 첫걸음이기 때문이다.

영어초록

The Presidential Truth Commission on Deaths in the Military is an institution under the direct jurisdiction of the President established by the Special Act for the Investigation of the Truth Behind Deaths in the Military. Petitions are filed to the Commission by bereaved family members or persons who knows relevant facts about an accident or incident in which there is considerable reason to suspect that the cause of death is suspicious. In addition, if there are suspicious circumstances surrounding a death in the military that occurred prior to September 13, 2021, the Commission may conduct an ex officio investigation by decision. The duration of the Commission is 5 years, from September 14, 2018 to September 13, 2023.
This article intends to evaluate the fact-finding activities conducted by the Presidential Truth Commission on Deaths in the Military, pointing out the limitations of the system and suggesting future tasks for the government.
By the end of June 2023, the Commission completed investigations of 1,833 out of 1,843 cases, including 1,787 complaints filed by bereaved families and 56 cases initiated by ex officio investigations, and it plans to complete investigations on all of its cases by the end of July. The Commission conducts an investigation after receiving a petition from the bereaved family. However, there’s a limitation in that this system focuses on resolving cases in which there is a dispute with the military over the cause of death, rather than focusing on the proper treatment of soldiers who died during military service. This is especially true for old cases in which there are no bereaved family members or colleagues to file complaints, so the Commission's investigation is limited as a result. Additionally, due to the fact that it is a temporary organization, there are restrictions on the Commission's ex officio investigative abilities.
There are about 39,000 soldiers who have not been given veteran benefits. The state needs to actively step in and reexamine the deaths in the military by modifying evaluation criteria so that even without a petition by the bereaved family these cases can be put forward and resolved. This is the first step towards proper respect for these veterans’ sacrifice for and dedication to the community.
