국가경찰위원회의 법적 지위 그리고 역할의 재정립 (The Legal Status of the Korean National Police Commission and the Reestablishment of its Role)

초록

국가경찰위원회는 주지하는 바와 같이 경찰의 민주성과 공정성을 확보하기 위한 방안으로 마련된 것이다. 1991년 5월 31일 제정된 경찰법은 경찰위원회의 설치를 규정하였고, 같은 해 7월 23일 경찰위원회규정(대통령령)이 제정되었다. 이렇게 설치된 경찰위원회는 경찰청이 이에 소속되거나 경찰청장 및 경찰관을 지휘․관리하는 것이 아니라 경찰의 주요정책 등이나 내무부장관, 경찰청장이 부의한 사항을 심의․의결하는 기관으로 설정되었다는 점에 그 특징이 있다. 이는 경찰위원회를 경찰에 관한 최상급 기관으로 하고 그 아래경찰청을 두는 것보다 법적 지위를 낮추고 역할과 기능을 축소한 형태이다.
2020년 12월 22일 전부개정된 「국가경찰과 자치경찰의 조직 및 운영에 관한 법률」(이하 ‘경찰법’이라 한다)에서 경찰위원회의 명칭이 국가경찰위원회로 변경되었고, 국가경찰위원회가 국가경찰행정에 관한 사항의 심의․의결 등을 행하는 것으로 규정되었다. 새로운경찰법은 자치경찰의 전국적 시행, 국가수사본부의 설치 등 경찰권의 분산과 통제를 위한제도들을 도입하고, 정보활동 임무를 개정하여 보다 올바른 경찰작용의 수행이 이루어지도록 하고 있다. 그러나 국가경찰위원회에 대해서는 명칭 변경과 약간의 자치경찰 관련 사항심의․의결 업무를 추가할 뿐 특별한 입법적 개선은 하고 있지 않다.
국가경찰위원회에 대해서는 과거 경찰위원회 시절부터 출범한 지 30년이 지난 지금까지그 위상과 기능, 구성, 업무수행 등에 관하여 많은 비판적 논의들이 있어 왔다. 이들은 공통적으로 경찰법과 이에 근거한 (국가)경찰위원회의 업무수행에 문제가 있다고 보며 이의 개선을 요구하고 있다. 이 글은 이와 같은 입법현황과 논란 속에서 법적 성격, 행정안전부장관 및 경찰청장과의 관계 등 국가경찰위원회가 갖는 법적 지위를 분명히 하고, 경찰의 정치적 중립과 민주적 권한 통제를 위하여 국가경찰위원회의 역할과 위상이 어떻게 정립되어야 하는지를 고찰하고 있다.
현행 법제에서 국가경찰위원회는 행정안전부의 분류와 같은 자문기관이 아닌, 심의․의결권 등을 갖고 독립적으로 업무를 수행하는 ‘합의제행정기관(행정위원회)’에 가깝다고 본다. 경찰의 정치적 중립과 민주적 통제에 있어 국가경찰위원회가 실질적으로 기능하도록하기 위해서도 이와 같은 법적 지위의 인정에 적극적일 필요가 있다.
여러 논란에도 불구하고 국가경찰위원회가 경찰권의 독단적 행사나 남용을 방지하는 데에 일정 부분 기여했다고 평가할 수 있다. 그러나 경찰법 규정에 따라 그 역할과 기능에한계가 있음도 부인할 수 없다. 이미 다수의 문헌들과 법안들이 제안했던 바와 같이 국가경찰위원회의 위상과 역할의 재정립, 구성 및 운영의 변화, 권한의 확대․보완 등 입법적 개선을 통해 공정하고 민주적인 경찰작용이 실현될 수 있는 체계가 확립되어야 한다.

영어초록

The Korean National Police Commission (KNPC), as it is known, was established to secure democracy and the fairness of the police. The Police Act, enacted on May 31, 1991, stipulated the establishment of the Korean Police Commission (KPC). The Korean Police Commission Regulation (President's Decree) was enacted on July 23 of the same year.
The Korean National Police Agency (KNPA) did not belong to KPC and the KPC did not direct or manage the commissioner of the KNPA or police officers. The KPC was set up as an institution for deliberation and resolution on the main policies of the police that the interior minister or the commissioner submits. This is a form of lowering the legal status of the KPC and reducing its role and function rather than having the KPC as the highest level agency for the police and placing the KNPA below it.
The name of the KPC was changed to the KNPC in the Organization and Operation of the National Police and Autonomous Police Act (hereinafter referred to as the Police Act), which was fully revised on December 22, 2020, and the KNPC was prescribed to deliberate on and resolve on matters related to national police administration. The new Police Act introduced a system for the dispersion and control of police power, such as the nationwide enforcement of the autonomous police and the establishment of the National Investigation Headquarters, and revises the duty of police intelligence operations so that more correct police action is achieved. However, the Police Act just changed the name of the KNPC and added the right for deliberation and resolution related to some matters of the autonomous police to the KNPC.
Thirty years after its launch from the past KPC, there have been many critical discussions on the status, function, composition, and performance of the KNPC. It is generally said that there are problems with the Police Act and the performance of the KNPC based on it, and people demand solutions to the problems. In this article, the legal status of the KNPC, such as its legal nature and relationship with the minister of the Interior and Safety and the commissioner of the KNPA, is confirmed in the current state of legislation. This article also examines how the role and status of the KNPC should be established for the political neutrality and democratic control of the police.
In the current legislation, the KNPC is not an advisory body, such as the classification of the Ministry of the Interior and Safety. The KNPC is close to a collegial administrative organ (Administrative Committee), which has the right to deliberate on and resolve issues and performs its duties independently.
Despite various controversies, it can be acknowledged that the KNPC has contributed to the prevention of arbitrary exercises or abuses of police power. However, it is also clear that there are limitations to the role and function of the KNPC under the Police Act. As many reports and bills have already proposed, a system to realize fair and democratic police action should be established through legislative improvements such as the reestablishment of the status and role of the KNPC, changes in its composition and operation, and expansion and supplementation of authority for the KNPC.
