감청과 통신비밀의 갈등, 그리고 미래 (The Conflict between Wiretapping and Communication secret, and the Future)

초록

이 글은 통신비밀보호법의 내용을 중심으로, 감청과 통신비밀을 둘러싼 담론의 전개과정과 잔존하고 있는 문제점들을 살피기 위한 글이다. 따라서 통신비밀보호법의 제정을 기점으로 하여 현재까지 통신기술의 발전과 법적 문제점에 대한 논의를 전개하고, 차세대 통신기술의 동향을 기반으로 통신비밀의 미래를 간략히 짚어보는 것을 주요한 내용으로 한다.
글의 전반부에는 통신비밀보호법 제정당시의 상황을 담았다. 먼저 기술적 측면에 있어서는 아날로그 통신을 지나 본격적인 디지털 통신의 시대가 개막되었던 당시의 기술상황을 유선통신과 무선통신으로 구분하여 간략히 검토한다. 다음으로 법리적 측면의 검토에 있어서는, 먼저 당시에 크게 유행하게 된 문자서비스, 즉 데이터 통신에 대하여 별다른 고려 없이 감청대상의 하나로 흡수하게 된 점을 입법상의 한계로 지적한다. 또한 당시 디지털통신의 핵심이라 할 수 있는 이메일에 대하여도, 음성통화와 달리 비휘발성을 가진다는 점을 제대로 고려하지 못하여 차별화에 실패하면서 현재 발생하고 있는 심각한 부작용의 맹아가 되었다는 점을 입법상의 미비로 파악한다. 나아가 통신비밀보호법만이 가지는 특이한 용례의 사용이 결국 오늘날 ‘감청 오남용’의 본질적 사유가 된다는 점에서 이를 입법상의 오류로 평가한다.
글의 중반부에서는 현재의 통신기술과 그에 대한 감청을 둘러싼 뜨거운 논의들을 담았다. 먼저 기술적 측면에 있어서는 본격적인 ‘4G’의 시기를 달리고 있는 현재의 무선통신 기술과, 공중전화망을 넘어 인터넷전화가 널리 보급된 현재의 유선통신망에 대한 분석을 중심으로 음성통화 부문을 검토한다. 한편 감청기술에 대하여는 공식적으로 감청이 불가능하다는 입장을 표명하고 있는 국가기관의 입장을 정면으로 반박한다. 해킹기술을 기반으로 한 스마트폰 감청과 미국언론에서 보도된 바 있는 ‘가상 기지국’ 기술을 들어 현재의 통신기술에 대하여도 여전히 감청이 가능함을 밝힌다. 또한 ‘패킷감청’을 통해 전방위적인 감청이 진행되고 있는 데이터 통신부문의 심각성을 밝힌다. 다음으로 법리적 측면의 검토에 있어서는 지난 ‘카카오톡’ 사건에서 보듯 비휘발성이 기본적 특성인 현재의 통신특성에 전혀 대응하지 못하고 있는 통신비밀보호법의 정의규정이 가지는 문제점을 입법상의 한계로 평가한다. 다음으로 특정가능성의 결여로 헌법상 영장주의의 기본원칙을 제대로 지켜내지 못하고 있는 점을 입법상의 미비로 평가하였다. 마지막으로 통신사실확인자료, 특히 기지국 수사의 문제점을 입법상의 오류로 평가한다. 이는 본질적으로 위치정보이기 때문에 통신비밀보호법의 보호대상이 아니기 때문이다.
글의 후반에서는 차세대 네크워크 기술의 동향을 간략하게 소개하고, 이를 지금의 감청제도에 대입하여 미래의 상황을 간략하게 조망해본다. 통신비밀에 대한 형식적 보장으로 일관해 온 지금까지의 모습대로라면 참혹한 미래가 예상됨이 자명하다는 것이 바로 그것이다.

영어초록

This paper aims at reviews debate development process concerning the wiretapping and communication secret with it's remained problems, on the basis of the Protection of Communication Secrets Act. Thus, I analyze the technical development of communication and the legal problems from the enactment time of the Protection of Communication Secrets Act to the present, and point out the future of communication secret shortly based on the trend of next generation's communication technology.
The first part of this article is allotted to explain a situation at the time of enactment. Firstly, I make an brief explanation about technical aspect based on the technological situation which is progressing from analog to earnest digital communication in the light of the wire or wireless communication. Nextly, on the aspect of legal analysis, I point out that text messaging service to wiretapping object with careless consideration as the limitation of legislation. And about email, which can be called core digital communication at that time, the failure of discrimination against analog communication because of no care for nonvolatile feature becomes thin end of the wedge for serious side-effects of the present, thus I evaluate this point to the incompletion of legislation. Lastly, I decide that odd use of term in the Protection of Communication Secrets Act to the error of legislation, because it becomes radical reason of abuse-causing on wiretapping.
In the middle part of this article, I review hot issues about the present communication and wiretapping technology. Firstly, I analyze a sector of audio communication which consist of wireless communication that on the earnest ‘4G’ and widespread using of internet telephone over PSTN, about technical aspect. Then arguing with official opinion of our government that there is no technical method to wiretap, giving opposite evidence with hacking tools for smartphone and ‘virtural base station’ used in the USA. In addition, I reveal the magnitude of the problem about omnidirectional ‘packet-inspection’ on the data communication field. Nextly, I verify a legal aspects. The definition provision of the Protection of Communication Secrets Act not correspond with basic character of the present communication that is radically nonvolatile feature, which is fatal factor of the ‘kakao incident’, evaluated to the limitation of legislation. Then, I evaluate the failure to keeping principle of warrant because of the impossibility of specifying as the incompletion of legislation. Furthermore, the communication confirmation data, especially the investigation of base station criticized to the error of legislation. It is a location information radically, which is not included to a domain of the Protection of Communication Secrets Act.
In the last part of this article, I introduce the trend of next generation communication simply, substitute this to the present wiretapping system, and predict future situation briefly. That is we should meet a horrible circumstance, according to consistent attitude that keeping the perfunctory guarantee of communication secret.
