경찰 ‘수사경과제’ 운영에 따른 개선방안 연구 : 충남경찰청 경찰관 인식조사를 중심으로 (A Survey on the Professional Detective System of the National Policy Agency in Korea)

초록

경찰이 2005년 수사경과제 도입 이후 조직 이원화와 같은 문제점들이 지속적으로 제기되어 왔다. 본 연구는 수사경과제의 주요 성과지표를 살펴보고, 수사경찰관들의 수사경과제에 대한 인식과 지역경찰관 등 일반경과자가 바라 본 수사경과제에 대한 인식의 차이가 어떤지를 실증적으로 분석하였다. 수사경과제 시행 전·후 5대 범죄 발생·검거율, 수사·형사 1인당 검거건수가 수사경과제 시행 이후 지속적으로 하락하였으며, 구속영장 미 발부율도 지속적으로 증가하고 있다. 또한, 수사경찰에 대한 국민만족도 역시 타 분야에 비해 만족도 점수 상승폭이 작은 것으로 나타났다. 심층면접 및 설문조사 결과, 폐쇄적 경과운영으로 인한 수사경과와 일반경과 사이에 이질감 확대 및 조직 이원화 현상 발생, 지구대·파출소 순찰경찰관들의 초동수사에 대해 많은 불만을 가지고 있다는 것이 확인되었다. 인사운영 측면에서도, 우수인력 선발 및 확보방안 미흡, 수사경과자의 무사안일 심화, 지나치게 경직된 전과규정, 수사업무에 맞는 승진 및 보상체계 미구축 등이 지적되었다. 응답자의 89.9%가 수사경과제의 전면폐지 및 개선이 필요한 것으로 인식하고 있었다. 특히, 수사경과제중 우선적으로 개선이 필요한 사항으로 ‘경과 간 교류를 불허하는 인사원칙’이라는 응답이 가장 많은 것으로 나타났다. 현행 폐쇄적 수사경과제는 득보다 실이 크게 운영되고 있는 것으로 판단되며 따라서 수사경찰 인력운영의 유

National Policy Agency (NPA) in Korea introduced the 'Professional Detective System' in 2005 against the backdrop of an increase in violent crimes, low attraction for detectives inside NPA, and falling investigative capacity as a result. During the past 9 years since its inception, there has been much critique on its performance. Extant research on this subject deal mostly with the level of institutional support and surveys on professional detectives themselves. This study is distinct because first, unlike the previous ones, we survey not only the professional detectives but includes the policy crew in other functional departments such as planning, administrative, traffic control, etc. In so doing, we focus on whether the introduction of the 'profession detective system' actually created organizational and psychological dichotomy inside NPA, thereby impairing the initial investigative capacity often encountered by policy officers not in the path for a professional detective. Second, we found worrisome trends in crime arrests, arrest warrant rejections, and public satisfaction with detective functions of NPA. We trace the underlying reasons for this to the unintended byproduct of the 'professional detective system' with focus group interviews and an extensive survey on the subject. Nearly 90% of both the detectives and the policy officers in other functions think the current system has to be remedied. A falling intial investigative capacity is cited to be the key collateral damage of the new system, since many non-detective police officers now seem to think of detective works as something outside their job descriptions, causing the careless and delayed handling of the crimes in its initial stage until the detectives take over. Moreover, what is striking is the fact that detectives themselves show greater dissatisfaction with the current system than other officers. Inflexible personnel management of the current system seems to have hurt the investigative capacity of NPA more than it nurtured the professionalism as intended.
