한국자치경찰제도 정착을 위한 광역자치단체의 과제 -경기도 사례를 중심으로 (A Study of the improving policy for municipal police system in korea)

초록

자치경찰제는 지방자치단체가 자체적인 경찰력을 가지고 지역의 특성에 맞는 치안서비스를 제공하고자 하는 제도로서 도입에 관한 논의는 정권 교체기마다 등장해 대선의 주요공약으로 채택되어 왔으나 도입을 위한 입법으로 이어지지는 못하였다. 「헌법」 제1조 제2항, 제117조 제1항에 근거 자치경찰제는 지방자치의 이념에 부합하는 제도이다. 즉, 지역적 특성, 주민의 요구를 반영하는 치안 서비스를 제공함으로써 시민이 통제·참여하는 경찰권을 행사하여 민주성·효율성을 제고할 수 있다. 중앙집권적, 획일화된 치안 등 경찰행정의 한계를 극복하기 위해서 지역특성에 부합하는 경찰행정, 그리고 주민의 생명과 재산보호를 통한 자치경찰의 실현은 주민자치의 목적인 지역주민의 복리 및 민생치안 증진 및 달성에 기여하기 위한 치안행정의 분권화 대두된 것이다. 경기도의 지방행정과 치안행정의 연계성을 확보한 자치분권을 실현하기 위해 지역주민에게 필요한 치안서비스를 제공하고 시민이 직접 통제하거나 참여하는 경찰권 행사의 중요성이 강조되었다.
이에 ‘광역단위 자치경찰제 도입’의 국정과제가 제시되어 자치분권 위원회의 도입(안)이 마련됨에 따라 경기도형 자치경찰의 특수시책 개발에 대한 필요성이 제기되어 자치경찰과 소방, 재해·재난 부서와 연계방안, 자치경찰과 보건복지국, 평생교육국 연계방안, 자치경찰과 관내 봉사단체 등과 연계방안 등 광역자치단체 시책 개발을 제안하고자 한다.

영어초록

The municipal police system is a system by which local governments have their own police force and provide security services suitable for the characteristics of the region. The debate on introduction has been adopted as a major pledge of the presidential election, and has been adopted as a major legislative election. I couldn't. Based on Article 1, Paragraph 2 and Article 117, Paragraph 1 of the Constitution, the municipal police system is a system consistent with the idea of ​​local autonomy. In other words, by providing security services that reflect local characteristics and the needs of the residents, it is possible to enhance democracy and efficiency by exercising the police power that citizens control and participate in. In order to overcome the limitations of police administration, such as centralized and uniform security, the implementation of the police administration in accordance with local characteristics, and the realization of municipal police through the protection of the lives and property of the residents is the welfare and welfare of the local residents. The decentralization of security administrations has been made to contribute to promotion and achievement. In order to realize municipal decentralization that secured the linkage between the local and police administrations of Gyeonggi-do, the importance of providing police services for local residents and the exercise of the police rights under the direct control or participation of citizens was emphasized.
As the national task of 'Introduction of Local municipal Police System' was presented, and the introduction of the municipal Decentralization Committee was proposed, the necessity for the development of special measures for municipal police in Gyeonggi-do was raised. I would like to propose a number of measures such as plans, municipal police and health welfare bureau, lifelong education bureau linkage plan, self-government police and jurisdiction service organization, and special measures for parking control.
