창조경제시대의 원동력 창의성과 특허 진보성과의 관계에 관한 고찰 (A Study on the Relationship between Creativity of the Driving Force of the Creative Economy and the Inventive Step of the Patent System)

초록

창조경제시대에 있어서, 창의적 지식에 기반한 혁신가치 창출이 경제 성장의 핵심이 되는 경제체제로서 창의성에 기반한 지식창출, 혁신이 새로운 경제발전의 핵심요소이다. 정부는 새로운 창의적 지식을 기반으로 아이디어, 개념, 기술들이 결합하여 새로운 제품, 서비스 비즈니스 창출, 새로운 산업창출을 통해 경제 성장과 일자리 창출에 나서고 있다. 또한 혁신적인 아이디어를 지식재산 권리화 하여 국가의 부를 창출하는 것을 최고의 정책을 알고 추진하고 있다. 지식재산이 지식기반 경제성장을 촉진하고 지식재산 생태계가 순기능을 하기 위해서는 특허권 등 지식재산의 보호는 강화하되, 공익에 반하지 않도록 조화를 유지하는 것이 매우 중요하다. 특허제도에 있어 진보성 요건에 대한 시대적 변천은 R&D의 성과를 높이거나 다른 한편으로 R&D의 비용을 대폭 늘려, 경제발전에 큰 영향을 미쳤음을 알 수 있었다. 진보성이 없는 자명한 발명에까지 특허권을 부여한다면 제3자의 이용이 부당하게 저해되고, 독점권이 난립하는 폐해가 따를 수 있다. 최근 진보성 요건수위가 높아져 창의성 발휘 정도가 큰 발명혁신에게 독점권의 혜택이 돌아가고 있어 다소 바람직한 방향으로 특허정책이 변모하고 있다지만, 지나치게 그 수위를 높일 경우에는 가치가 있는 발명혁신들이 사장되거나 발명자들이 기술의 공개를 꺼리게 되며, 특허권자의 권리남용 문제가 나타나 마찬가지로 창조경제발전에 역행하는 결과를 초래한다. 발명혁신의 공개를 통한 이용의 활성화와 이를 통한 창조경제 발전이라는 목적을 동시에 달성하기위해서는 특허권 획득에 있어 가장 도전적인 진보성 요건에 대한 판단수위를 적절히 조절하여야 한다. 아울러 특허제도에서 진보성이 갖는 존재적 의의를 고려해 볼 때 본질적으로 추상적인 진보성 요건 수위에 대하여 구체적이고 타당한 판단 근거를 통해 적절하게 정립하여야 한다. 따라서 진보성요건 정립에 있어 갈수록 빨라지는 기술의 발전 속도와 최근의 기술의 융⋅복합 현상을 고려한 창의혁신자인 발명자의 창의성, PHOSITA 상정, PHOSITA의 기술수준 및 결합발명에 유연한 TSM테스트 적용 등을 특허정책 측면에서 최적하게 적용하여야 한다.

영어초록

In the creative economy, knowledge-based innovation and value creation are based on creativity as an economic system that is the core of economic growth and innovation is a key element of the new economy. The government is based on a new creative idea, knowledge, concepts and techniques combined with newproducts, services and business creation, and is scrambling to economic growthand job creation through new industry creation. It also knows the best policy that promotes intellectual property rights from innovative ideas and creat esnational wealth. Intellectual property is to promote a knowledge-based economy and strengthens the protection of ecosystem with positive function. It is very important to maintain the harmony so as not to contrary the public interest. Inthat respect, the excessive protection for patents is sometimes said to decrease the use of the invention contrary to the public interest. On the other hand, thein sufficient protection of patent rights which is a real loss to the innovation system can weaken the motivation to create its own intellectual property.
Activation of the use of the invention by the public and the objectives of the industrial development of the patent system is dependent on the proper level control of the inventive step requirement. A far less apparent invention inventive step requirement shall occur in accordance with the exclusive rights abuses which unduly impede the third party’s free practice. On the other hand, if the inventive step is too high, valuable inventions are unused or inventors are reluctant to disclose the technology and is contrary to industry development.
However, as inventive step requirement is essentially notional, the suitable and specific requirements can be established through the accumulation of the auditpractices, cases and judgments. Recently, the United States and Korea tend to apply strictly to higher level of inventive step requirement and criteria since 2007 KSR ruling. We shall be attentive to too high an inventive step requirement considering the present the significance of patent system. In addition, due to the increasingly faster pace of technology and the complex phenomena of society the judgment of inventive step is becoming more difficult. Inventive stepby providing the appropriate requirements based on creativity, innovation, PHOSITA, technological level, and flexible TSM test and so on to create the invention will properly implement the creative economy development.
