초록

디지털 전환을 주도하는 기술은 사물 인터넷(IoT), 클라우드, 빅데이터, 인공지능(AI) 등 다양하지만 이 중에서도 빅데이터와 AI는 모든 산업 분야에서 주목하고 있는 디지털 기술이라고 볼 수 있다. 우리나라는 2020년 8월 5일 ‘데이터 3법’ 개정법률이 시행에 들어갔으며, 2022년 4월 25일에 시행된 ‘데이터 산업진흥 및 이용촉진에 관한 기본법’(이하 데이터산업기본법이라 함)은 전 산업을 아우르는 세계 최초의 데이터 기본법으로 ‘데이터 경제’ 시대의 도래를 앞두고 제도적 초석이 될 것으로 보인다. 또한 금융 분야에서 시행되는 마이데이터(My Data) 서비스가 정보 주체의 데이터 이동권(Right to Data Portability)을 보장하고 데이터를 활용한 맞춤형 정보를 제공하고 있는 만큼, 초개인화 금융 서비스의 등장이 가능해질 것으로 보인다. 데이터 경제란 데이터의 활용이 산업 발전의 촉매 역할을 하고, 이를 통해 새로운 가치를 창출해내는 경제를 의미한다. 주요 선진국들이 이러한 데이터 경제의 중요성을 인지해 공공데이터의 활용을 장려하고 데이터 산업을 육성하고 있다. 2021년 7월 발표된 한국판 디지털 뉴딜의 핵심 정책 중 하나로 ‘데이터 댐’ 구축 사업이 포함되기도 하였다. 인공지능(AI), 사물인터넷(IoT), 자율주행, 빅데이터 등 미래 산업의 핵심 기술들은 모두 데이터 경제에 기반하고 있다고 해도 과언이 아니다. 4차 산업혁명시대의 원유는 데이터라는 말이 일반화 될 정도이다. 특히 코로나19 팬데믹을 거치며 전 세계적으로 공공데이터의 투명한 공개와 활용이 더욱 중요해지고 있는 추세이다. 디지털 전환과 함께 전반적인 산업혁신의 촉매 역할을 하는 데이터를 잘 활용할 수 있도록, 데이터 경제 시대를 잘 준비하는 것이 국가적 과제라고 할 수 있다. 4차 산업혁명 시대에 데이터 경제를 활성화하기 위해 전 세계는 데이터와 관련한 법제도들을 준비하고 있다. 특히 데이터 소유권과 관련해서 국내의 준비가 해외에 비해 미진한 상태이다. 이미 해외 여러 국가들은 데이터 경제를 활성화하기 위해 준비 중이며, 이를 위해 데이터 소유권과 관련된 법제도를 마련하고 있다. 개인정보와 관련해서는 유럽은 GDPR을 마련하였고, 저작권과 관련해서 일본은 저작권법을 개정하였다. 미국은 AI 등 첨단 산업의 동력을 불어 넣기 위해 판례로 데이터 소유권에 관해 정리하고 있는 것으로 보인다. 앞으로 데이터 경제가 도래하면 데이터 세금(Data-Tax)등 추가적인 법적 논의 계속될 것이다. 따라서 우리도 이제 데이터 소유권과 관련한 국내의 법제도 정비에 대해 적극 고민해봐야 할 때이다. 이 논문은 데이터 경제시대의 데이터 소유권 개념의 재정립에 대하여 학계에서의 논의되고 있는 이론적 배경을 살펴보고, 또한 데이터 경제시대의 데이터 거래를 함에 있어서 개인정보보호법을 중심으로 개인정보보호 관련 법제 검토를 하였다. 끝으로 데이터 경제시대가 도래함에 있어 데이터의 지식재산권법에 관한 내용도 함께 연구의 내용에 포함하였다.

영어초록

The technologies leading the digital transformation are diverse, such as the Internet of Things (IoT), cloud, big data, and artificial intelligence (AI). In Korea, the 'Data Industry 3 Act' revision law went into effect on August 5, 2020, and the 'Data Industry Promotion and Utilization Promotion Basic Act' (hereinafter referred to as the Data Industry Framework Act), which came into force on April 25, 2022 As the world's first basic data law that encompasses all industries, it is expected to serve as the institutional cornerstone ahead of the advent of the era of 'data economy'. In addition, as the My Data service implemented in the financial field guarantees the right to data portability of information subjects and provides customized information using data, the emergence of hyper-personalized financial services is expected to become possible. see. The data economy refers to an economy in which the use of data acts as a catalyst for industrial development and creates new value through it. Recognizing the importance of this data economy, major advanced countries are encouraging the use of public data and fostering the data industry. The ‘data dam’ construction project was also included as one of the core policies of the Korean version of the Digital New Deal announced in July 2021. It is no exaggeration to say that the core technologies of future industries such as artificial intelligence (AI), Internet of Things (IoT), autonomous driving, and big data are all based on the data economy. Crude oil in the era of the 4th industrial revolution is about the generalization of data. In particular, the transparent disclosure and utilization of public data around the world is becoming more important due to the COVID-19 pandemic. It is a national task to prepare well for the era of the data economy so that data, which serves as a catalyst for overall industrial innovation along with digital transformation, can be utilized well. In order to revitalize the data economy in the era of the 4th industrial revolution, the world is preparing data-related legal systems. In particular, in relation to data ownership, preparations in Korea are insufficient compared to overseas. A number of overseas countries are already preparing to revitalize the data economy, and for this purpose, legal systems related to data ownership are being prepared. With respect to personal information, Europe prepared GDPR, and with respect to copyright, Japan revised the Copyright Act. The United States seems to be arranging data ownership by precedent in order to fuel high-tech industries such as AI. When the data economy arrives in the future, additional legal discussions such as data-tax will continue. Therefore, it is now time for us to seriously think about reforming the domestic legal system related to data ownership. This paper examines the theoretical background being discussed in academia on the re-establishment of the concept of data ownership in the era of data economy, and also reviews the laws related to personal information protection, focusing on the Personal Information Protection Act, in data transactions in the era of data economy. Lastly, with the advent of the data economy era, the contents of the data intellectual property rights law were also included in the study.
