경찰청 소관 민간자격 운영에 관한 연구 (A Study on Operation of Private Qualifications under Jurisdiction of the National Police Agency)

초록

본 연구는 민간자격 제도를 개관하고 경찰청 소관 민간자격의 운영 현황 분석을 통해 한계점을 도출하여 이에 대한 제언을 하고자 하였다.
경찰청장은 산업보안, 경비 및 경호 관련 분야의 민간자격을 등록받거나 공인하고 소관 자격의 신설 금지분야를 정하며, 이에 대한 사무 처리는 경찰청 소속 혁신기획조정담당관이 담당한다. 경찰청 소관 민간자격의 등록 업무는 한국직업능력개발원에 위탁하여 처리하고, 경찰청장은 소관 민간자격의 관리자 등이 자격기본법을 위반하면 지도·감독, 시정명령, 행정처분 등의 권한을 행사한다.
본 연구에서는 2021. 1. 4.자 기준 164개의 경찰청 소관 민간자격을 분석하였다. 경찰청 민간자격은 영업을 목적으로 하는 영리 법인과 개인사업체가 74개(약 44.6%)로 나타났고, 서울과 경기를 중심으로 117개(약 71.2%)의 민간자격이 등록되었다. 직무 분석을 통해 분야별로 경찰청 민간자격을 분류하면, 조사 분야 45개(약 27.4%), 경비·경호 분야 43개(약 26.2%), 도로교통 분야 30개(약 18.2%), 범죄예방 분야 16개(약 9.7%), 기타의 순으로 나타났다. 또한 경찰청에 등록만 되어 있고 실질적으로 검정현황을 확인할 수 없는 자격은 111개(약 67.6%)로 나타났고, 44개(약 26.8%) 민간자격등록자들은 1년에서 5년 정도의 기간 내에 검정을 실시하였으며, 6년 이상 검정을 실시한 자격은 9개(약 5.4%)로 나타났다. 그리고 민간자격의 취득은 취득자 현황이 없는 자격이 111개(약 67.6%)이고, 취득자 100명 미만인 민간자격 31개(약 18.9%), 취득자 100명 이상-500명 미만인 민간자격 16개(약 9.7%), 취득자 500명 이상-1000명 미만인 민간자격 3개(약 1.8%), 취득자 1000명 이상 민간자격 3개(약 1.8%) 순으로 나타났다.
경찰청 소관 민간자격 운영 실태를 분석한 바에 따르면, 경찰 기능별 민간자격 직무 분야의 구분이 명확하지 않아 타 부처 분야의 자격이 경찰청에 등록되거나, 경찰 기능과 상관없는 자격임에도 불구하고 경찰청 소관으로 등록 처리될 수 있다. 또한 경찰청장은 경찰청 소관 민간자격의 신설 금지분야를 공고하고 있으나, 조사 분야 민간자격의 직무를 살펴보면 위법한 개인정보 수집과 처리가 될 수 있는 여지가 있으며 국가전문자격의 근거 법률 등에 위반될 소지가 있다. 그리고 경찰청 소관 민간자격도 자격기본법 제33조에 따라 표시의무 등에 따른 작위 및 부작위 의무를 준수하여야 하지만, 민간자격의 광고 목적으로 자격 정보를 게시하면서 표시사항을 누락하는 등 소비자 분쟁으로 연결될 우려도 있다.
따라서, 경찰청 소관 민간자격의 제도적 개선방향에 대한 제언은 다음과 같다. 첫째, 경찰 기능의 법률적 근거에 따라 민간자격의 직무 구분이 명확하게 이루어져 경찰 직제별로 직무 관련 담당부서에서 민간자격 등록 여부를 판단할 수 있는 체제를 마련하여야 한다. 둘째, 민간영역의 조사 분야에 대한 조사 업무의 정의와 유형, 의뢰 받은 조사 업무 수행의 절차 및 방법 그리고 조사과정에서 수집된 개인정보 처리를 위한 근거 등 입법적 조치가 시급하다. 셋째, 공공성과 공익적 성격이 강한 경찰청 소관 민간자격의 표시의무 준수 여부에 대하여 경찰청 내부의 전담기구에 의한 단속과 이에 대한 시정명령 및 행정처분을 통해 정상적인 경찰청장의 지도·감독권 행사가 가능하도록 하여야 한다.

영어초록

The purpose of this study was to derive limitations and make policy suggestions through analysis of the private qualification system and the operation status of private qualifications under the jurisdiction of the National Police Agency.
The Commissioner General of the National Police Agency obtains or accredits private qualifications in the fields related to industrial security, security and security. The private qualification work of the National Police Agency is handled by the Innovation Planning Coordinator. The registration of private qualifications under the jurisdiction of the National Police Agency is entrusted to the Korea Research Institute for Vocational Education & Training.
This study analyzed 164 private qualifications under the jurisdiction of the National Police Agency as of January 4, 2021. The National Police Agency's private qualifications consisted of 74 for-profit corporations and private businesses (about 44.6%), and 117 (about 71.2%) were registered in Seoul and Gyeonggi. By classifying the private qualifications of the National Police Agency by field through job analysis, 45 investigation fields (about 27.4%), 43 security/security fields (about 26.2%), 30 road traffic fields (about 18.2%), and 16 crime prevention fields (about 9.7%) and others were found. In addition, 111 qualifications (approximately 67.6%) were registered only with the National Police Agency and the status of the certification could not be verified. 44 (approximately 26.8%) registered private qualifications conducted the test within a period of 1 to 5 years.
According to the analysis of the operation of private qualifications under the jurisdiction of the National Police Agency, It is not clear that the division of the private qualification job field according to the police function. Looking at the jobs of private qualifications in the field of investigation, there is a possibility that they may violate the law. Some of the private qualifications under the jurisdiction of the National Police Agency are not obligated to display.
Therefore, the policy suggestions for the institutional improvement direction of private qualifications under the jurisdiction of the National Police Agency are as follows. First, according to the legal basis of the police function, the division of duties of private qualifications should be clearly made, and a system in which the department in charge of duty related to the police office can decide whether to register the private qualifications. Second, legislative measures are urgently needed, such as the definition and type of investigation work in the private sector, the procedure and method of performing the requested investigation, and the basis for processing personal information collected during the investigation. Third, whether or not to comply with the duty to display private qualifications under the jurisdiction of the National Police Agency is confirmed by a dedicated organization within the National Police Agency, and the Commissioner General of the National Police Agency should direct and supervise.
